04-18-2000 Regular Meeting• • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD April 18,2000 The regular scheduled meeting of the Code Enforcement Board was called to order on Tuesday, April 18, 2000, at 7:00 p.m. Members attending were Vice Chairman Pauf Lienard, Vernon Schneider, John Atwater, and Joe Janusiak. Members Betty Schrader, Martin Wright and Emie Waters were absent. Also attending were Robert Guthrie, City Attorney, Jeff Jones, Code Enforcement Officer, Mimi Ogden, Planner I, and Jane C. McAllister, Code Enforcement Clerk. MINUTES of the meetings held September 21, 1999 were approved as presented. CASE NO. 00-01 .. Reuben Jamison P.O. Box 120775 Clermont, FL 34712 LOCATION OF VIOLATION: 907 Scott Street VIOLATION: City of Clermont Code of Ordinances, Chapter 34, Section 34-95 Code Enforcement Officer Jones explained that the car, which has no motor, has been parked on the property for some time. Staff recommends that the owner or heir of the property, as Mr. Jamison is deceased, be given until April 30, 2000 at 5:00 p.m. to remove the inoperable vehicle. Should the defendant fail to comply, Staff recommends that a fine of $25 per day be imposed until the violation has been cleared. Upon clearing the violation, the defendant(s) be given ten (10) days to pay any fine imposed or a lien be placed on the property. Discussion followed regarding the fact that someone is accepting mail for Mr. Jamison and someone is living in the residence. Code Enforcement Officer Jones stated that whoever signed the green card would probably be caretaker of the property. City Attorney Guthrie suggested that Jeff Jones determine if the estate is in probate or not. If there is a representative of the estate that person should be served regarding this matter. A motion was made by Board Member Atwater that the defendant be given until April 30, 2000 at 5:00 p.m. to remove the inoperable vehicle. Should the defendant fail to comply, Staff recommends that a fine of $25 per day be imposed until the violation has been cleared. Upon clearing the violation, the defendant(s) be given ten (10) days to pay any fine imposed or a lien be placed on the property. Joe Janusiak seconded the motion and it was unanimously approved. • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD April 18, 2000 Page 2 CASE NO. 00-02, CASE NO.00-03, AND CASE NO.00-04 The above cases were withdrawn due to the fact that the defendants complied with Code Enforcement. Attorney Guthrie explained that it was not necessary to have a motion to dismiss since the cases had already been withdrawn. CASE NO.00-05 Steve Pruitt P.O. Box 561537 ~ _ Orlando, FL 32856 LOCATION OF VIOLATION: Across from Roane Road apartments ontheright-of--way and down the hill. VIOLATION: City of Clermont Code of Ordinances, Chapter 34, Section 34-95, Prohibition of storage within residential areas. Code Enforcement Officer Jones presented into evidence pictures of the trash that has been discarded at the above location as well as sworn statements from citizens who have observed the defendant dumping trash at the site. The defendant asked for a postponement. However, since the evidence was presented and was very clear the Board decided to hear the case at this session. Staff recommended the defendant(s) be given until May 16, 2000 at 5:00 p.m. to clean the area and remove the trash and other items. Should the defendant fail to comply, Staff recommended a fine of $100 per day be imposed starting May 20, 2000 until the violation has been cleared. Upon clearing the violation, the defendant(s) be given ten (10) days to pay any fine imposed or a lien be placed on the defendant(s) property. A motion was made by Vem Schneider that the defendant be given until May 16, 2000 at 5:00 p.m. to clean up the trash and other items. Should the defendant fail to comply, a fine of $100 per day be imposed starting May 20, 2000 until the violation has been cleared. Upon clearing the violation, the defendant(s) be given ten (10) days to pay any fine imposed or a lien be placed on the defendant(s) property, as recommended by Staff. The motion was seconded by Joe Janusiak and approved by a unanimous vote. • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD April 18.2000 Page 3 CASE NO.00-06 -This case has been withdrawn due to the fact that the defendant has complied with Code Enforcement. ,,Vice Chairman Lienard called for nominations for officers to serve for the next year. Vern Schneider nominated Paul Lienard for Chairman. Joe Janusiak seconded the nomination. The vote was unanimous in favor of Paul Leinard serving as Chairman. Joe Janusiak nominated John Atwater for Vice Chairman. The nomination was seconded by Vern Schneider and unanimously approved by the Board. There being no further business, the meeting was adjourned.
