11-21-2000 Regular Meeting• • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD November 21, 2000 The regular scheduled meeting of the Code Enforcement Board was called to order on Tuesday, November 21, 2000, at 7:00 p.m. Members attending were Vernon Schneider, John Atwater, Joe Janusiak, Paul Leinard, Betty Schrader. Member Martin Wright was absent. Also attending were Robert Guthrie, City Attorney, Jeff Jones, Code Enforcement Officer, Barry Brown, Director of Planning, and Mimi Ogden, Planner MINUTES of the Code Enforcement meeting held September 19, 2000 were approved as presented. CASE NO. 00-05 Steve Pruitt P.O. Box 561537 Orlando, FL 32856 LOCATION OF VIOLATION: North side of Roane Road across from the Roane Road apartments on the right-of-way and down the hill on Mr. Wert's property. VIOLATION: City of Clermont Code or Ordinances, Chapter 34, Section 34-95, Prohibition of storage within residential areas. Code enforcement officer Jeff Jones state as a review of this case please refer to the minutes of the September 19, 2000 Code Enforcement Board meeting. As noted in the minutes, Mr. Pruitt removed several loads of trash from Mr. Wert's property. However, Mr. Wert expressed to the defendant that he did not want anyone else back on his property to remove trash and that he (Mr. Wert) would be erecting a fence to prevent any further dumping. Although trash and debris still remain on Mr. Wert's property an on the City right-of-way, Staff believes Mr. Pruitt has done his fair share to clean up the debris. Staff recommends dismissal of this case. Mr. Paul Leinard read the Staff Recommendation to the board and asked for comments. There were no comments. A motion was made by Joe Janusiak to dismiss the case. The motion was seconded by John Atwater and the vote was unanimously in favor of dismissal. • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD November 21, 2000 Page - 2 - CASE NO. 00-07 Jeffrey E. Richardson 239 Bent Bough Drive Leesburg, FL 34748 LOCATION OF VIOLATION: 1011 4T" Street VIOLATION: City of Clermont Code of Ordinances, Chapter 34, Section 61, Enumeration of prohibited items, conditions or actions constituting nuisances. Code Enforcement Officer Jeff Jones stated that City Staff postponed this case numbered 00-07 from the 16~' of May 2000 due to a medical condition. This case has correspondence dating as far back as September 15, 1997 regarding the same violations. Staff recommends that Mr. Richardson be given two weeks from the date of this hearing (November 21, 2000) to have a demolition permit secured from Lake County Building Department to remove the burned structure and the property mowed of all weeds. If Mr. Richardson has not secured such permits, then the Code Enforcement Officer shall send a directive to the City Manger to have the structure at 1011 Fourth Street demolished by the City of Clermont. Mr. Richardson shall pay for the fee for this work within two weeks of the completed demolition, or the City of Clermont shall then place a lien for the cost of this demolition on the property. Paul Leinard read the violation to the Board. Jeff Jones presented 8 photos of the property in question which were entered into evidence. Mr. Richardson stated that someone deliberately burned the house and that he was a victim. Mrs. Richardson stated that they were granted payments for restitution by the court since this was an arson case, and that the mother of the person charged with the crime has chosen to ignore her responsibility in paying. Betty Schrader asked if the City Fire Department could burn the house for practice. Jeff Jones informed her that the house had asbestos siding and could not be burned by the City. • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD November 21, 2000 Page-3- Joe Janusiak made a motion to accept Staff's Recommendation and solicit bids for the demolition of the structure. The property owner would then be responsible for payin_q the fee and a lien will be placed upon the property until such time as that occurs. The motion was seconded by Betty Schrader and the vote was unanimous in favor of the motion. CASE NO.00-08 Ruth K. McCance P.O. Box 121042 Clermont, FL 23712 LOCATION OF VIOLATION: 1632 East Avenue VIOLATION: City of Clermont Code of Ordinances, Chapter 34, Section 61. Paul Leinard read the Staff Recommendation to those present, which was as follows: to pursue the motion of the Code Enforcement Board meeting of September 19, 2000, Lake County Licensing Investigator Anita Hendrix performed a detailed inspection of this structure. This inspection was performed on November 1, 2000. Inspector Hendrix found several existing conditions, which influenced her to declare 1632 East Avenue an unsafe structure. Since the City of Clermont has jurisdiction within the City limits by having their own Code Enforcement Board, the order from the City of Clermont will take precedence over the decision of Lake County. However, after reviewing their decision, City Staff recommends to concur with their findings. Staff recommends the following: Prior to November 30, 2000, the defendant be requested to provide, in writing, to the City of Clermont and the Building Official of Lake County a letter stating whether the defendant has chosen to bring the structure into compliance with the current Standard Building and related Codes, or demolish/remove the structure from the property. The required building/demolition permits must be secured and the work/demolition in progress prior to December 7, 2000 and continued to completion by March 7, 2001 for the reconstruction or by January 7, 2001 for the demolition. If the required actions are not accomplished within the time frames delineated above, the City of Clermont will cause the structure to be demolished at which time appropriate procedures will be enacted for recovery of the demolition cost. • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD November 21, 2000 Page - 4 - Bob Turley, 1632 East Avenue, Clermont, and Martha Turley, 1632 East Avenue, Clermont, FL. were sworn in. Mr. Turley asked for time to get bids to fix the house and also to demolish it. He asked for an additional 4 months. Jeff Jones said that case has gone on for a long time, and that neighbors have endured this problem for a long time. The County inspector red tagged the building as an unsafe structure. Mrs. Turley stated that people she has talked to could not start demolition by December 7, 2000. The people who do the actual demolition do not do the asbestos siding. They need to get other people to do that. It will be impossible to get this done on the City's timetable. Mr. Schneider said that a work in progress is a fuzzy date but that a permit would give a definite date. He further asked for a completion date. Mrs. Turley said she had no idea how long it would take to demolish the house once they had an acceptable bid. Jeff Jones stated that in his experience it takes approximately one week to actually demolish a premises. Mrs. Turley stated that it will take some time to find a bid that she will be able to afford. She requested she be given until March 4, 2001 to find a company to do the work. Richard Meyers, 1640 East Avenue, Clermont, FL was sworn in. Mr. Meyers stated he is a next door neighbor and feels the City should have someone come in and take the structure down and place a lien on the property until the owners pay the fee. He stated that there is trash and vermin and he has had about all he can stand. Sterling Frey, 1647 First Street, Clermont, FL was sworn. Mr. Frey asked if the garage was included in the demolition order. Jeff Jones replied that it included all structures on the property. Mr. Atwater made a motion to have a finish date for demolition and one for bringing fhe property up to code. He suggested it be demolished by February 1, 2001 or broughf up to City Code by March 7, 2001. Otherwise the City takes over and gets bids for demolition. In addition, the Turley's must inform the Board, in writing, by Januar~5, • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD November 21, 2000 Page-5- 2001 as to which action they will be taking. • Mr. Fry asked if in the event the structure is demolished, would the lot then be graded and seeded? Jeff Jones replied that it would be graded and it would be up to the owner to keep the property clean. The motion was seconded by Joe Janusiak and approved by a unanimous vote. CASE NO. 00-09 Amos Thomas 520 E. Juniata Street Clermont, FL 34711 LOCATION OF VIOLATION: Homedale Lot 4, less the east 8 feet, Lot 5, Blk 3. VIOLATION: City of Clermont Code of Ordinances, Chapter 23, Section 23-3. Code Enforcement Officer Jeff Jones stated that correspondence from this violation date back as far as August 9, 1994. Staff is requesting that a resolution is brought to this by imposing a fine for each future offense of parking commercial vehicles that occurs at this location. A recommendation of a fine of $50.00 (fifty dollars) for each future violation regarding the same ordinance that is noted and documented by a City of Clermont Police Department officer, or the City Code Enforcement Officer. Any accumulation of over two hundred ($200.00) dollars will result in a directive to the City Attorney to place a lien on the property owned by Mr. Thomas. Jeff Jones stated that since he sent the subpoena the situation has cleared up. The area is being revitalized and this lot has been unsightly and the situation must stop. Robert Guthrie, City Attorney suggested that since there have been numerous violations in the past that all future violations be documented by the Police Department or Code Enforcement Officer. In the future Staffs Recommendation could be followed. Joe Janusiak made a motion to charge $50.00 per day as long as a violation exists and then file a lien for anY accumulation over two hundred ($200.00) dollars. John Atwater seconded the motion. The vote was unanimous for approval of the motion. CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD November 21, 2000 Page - 6 - CASE NO. 00-10 Evelyn McFarland 2147 Alclobe Circle Ocoee, FL 34761 LOCATION OF VIOLATION: 299 West Highway 50 VIOLATION: City of Clermont Code of Ordinances, Chapter 34, Section 34-95m Prohibition of storage within residential areas. Code Enforcement Officer Jeff Jones stated that one of the vehicles has since been removed. They are in the process of putting proper registration on the second vehicle which will make it legal. Staff recommends that this case be dismissed do to compliance. Vernon Schneider made a motion to dismiss this case do to compliance. The vote was unanimous in favor of dismissal. CASE NO. 00-11 Billie Dean P.O. Box 308 Clermont, FL er712 LOCATION OF VIOLATION: 307 West Highway 50 VIOLATION: City of Clermont Code of Ordinances, Chapter 34, Section 34-61 (1)(2)(3), Enumeration of prohibited items, conditions or actions constituting nuisances. Code Enforcement Officer Jeff Jones stated that Mr. Dean refuses to accept his certified correspondence at this time. Staff recommends that this case be closed until such time as proper posting of the property, and notice posted by other resources.
