03-21-1989 Regular Meeting• • CODE ENFORCEMENT BOARD F , 1989 The regular scheduled meeting of the Code Enforcement Board was called to order on Tuesday, March 21, 1989 at 7:30 P.M. The invocation was given by Rev. Ed Ivey and followed by the Pledge of Allegiance. Members attending were Emma Higgins, Edward Whitehead, Joe Wiebush, Rev. William McKinney, Martin Wright, Rev Ed Ivey and George Wood. Also attending were James McAllister Planning Director and Jane Warren Planning and Zoning Technician. ELECTION OF OFFICES Emma Higgins nominated Ed Whitehead of Chairman, seconded by Rev. McKinney and approved by a unanimous vote. Joe Weibush nominated Rev. Ed Ivey and seconded by Emma Higgins and approved by a unanimous vote. NEW BUSINESS CASE NO. 89-02 CITY OF CLERMONT A Municipal Corporation Plaintiff, vs. Mr. David Johnson 4245 Bear Gully Road. Winter Park, Fla. 32792 Defendant (s). Ordinance 207-C, Section 26-74 TEMPORARY FUTURE IMPROVEMENT SIGNS. Two (2) signs announcing building or future improvements may be placed on any lot or parcel of land in a zoned district at the time of preliminary plat or site plan approval. Mr. McAllister informed the Board that Mrs. Johnson has contacted the City and advised him that the sign would be removed by February 22, 1989. Mr. McAllister stated he felt Mrs. Johnson was most sincere in her intentions to remove the sign and suggested that the case be dismissed. The property owners were not present. After a brief discussion a motion was made by Rev. Ed Ivey to table this case, mending the removal of the sign, seconded by Emma Higgins and approved by unanimous vote. CASE NO. 2 CITY OF CLERMONT A Municipal Corporation Plaintiff, CASE NO. 89-04 vs. Barbara Causey 312 Crystal Lake Drive Clermont, Florida 32711 Defendant (s). 1 • • Chapter 14 Section 12 (6) NOISES, UNNECESSARY-PROHIBITED, DEFINITIONS. KEEPING OF ANIMALS - The keeping of any animals or bird which by causing frequent or loud noise shall disturb the comfort and repose of any person in the vicinity. LOCATION: 312 Crystal Lake Drive Mr. McAllister stated that the City has received numerous complaints from one resident regarding the continued barking of dogs at the referenced address. Mr. McAllister also informed the Board that the police department has been called out at various times in the night to check on the reported nuisance. Mr. McAllister recommended that the Board require that the dogs be taken inside and quieted in some humane manner. The defendant was not present. Mr. Wiebush asked how many dogs were on the premises and was advise that there were three (3) dogs. Rev. Ivey questioned if the Board had the authority to subpoena any witnesses or the complainant. Mr. McAllister informed the Board that they did have the authority to subpoena the complainant. Rev. Ivey stated he felt the discussion of a fine might be unappropriated at this time, since the defendant, complainant and legal council were not present. After a brief discussion a motion was made by Rev. Ivey to table this case until legal council can be present, seconded by George Wood and approved by a unanimous vote.
