08-19-1986 Regular Meeting• • CITY OF CLERMONT MINUTES CODE ENFORCIIriENT BOARD August 19, 1986 The regular scheduled meeting of the Code Enforcement Board was called to order by Chairman Russell Wagner at 7:30 p.m. on August 19,1986. Members attending were Emma Higgins, Gloria Johnson, William Mckinney, Russell Wagner, Edward Whitehead and Martin Wright. Jne Wiebush was excused. Also attending were City Attorney Leonard Baird, Planning Director Dean Perlick and Code Enforcement Clerk Jane Warren. Minutes of the meeting held June 17, 1986 were approved as presented. HEARING N0.86-007- City of Clermont vs. Jimmy Lee Jackson Mr. Perlick stated that the property located at 792 Montrose Street has a history of Code Enforcement violations dating back to 1971. In reference to the current case, Mr. Perlick provided pictures of the present condition of the property in question, which showed dismantled vehicles, car parts and junk stored on the property. Mr. Perlick stated he personally took the pictures on the morning of August 19, 1986. Speaking under oath Mr Jackson stated he had several vehicles on the property, but only one of them was not in working condition. Mr. Jackson stated he did not understand how the City felt he was in violation with only one non-working vehicle on his property and requested to see the photographs Mr. Perlick had presented to the board. Mr. Leonard Baird, the City attorney asked Mr. Jackson if the pictures depicted the property in its present state. Mr. Jackson stated the photograph was his property and a 1 so property owned by Mr. Thomas. Mr. Thomas's son, Amos Thomas was present and stated under oath that the vehicles in the photograph belonged to him. Mr. Jackson also stated the glass and cans that were piled up, were on his property, and that the photographs did accurately depicted the condition of the property. Mr. Perlick also informed Mr. Jackson and Mr. Thomas that vehicles, the size of the ones photographed were too large to be stored on property zoned R-3. After a brief discussion, a motion was made by Mrs. Higgins, seconded by Mr. McKinney and carried by unanimous vote that 1~Ir. Jackson be given until September 15, 1986, to correct the present violation by removing any vehicles which might be in violation of the City Code as well and any trash or junk on the property. 1 • • Mr. Baird also advised Mr. Thomas, that the vehicles that were stored on his father's property were in violation of the City Ordinance, and could also be cited by the Code Enforcement Board if the violations continued to exist. Case No.86-008 City of Clermont vs. Tom Snail Mr. Perlick stated that Mr. Snail is presently building a wood structure in his yard without a Zoning Clearance. The structure in question does not meet any of the required setback, and would therefore not be given Zoning Clearance. Speaking under oath Mr. Snail stated it was his intention to obtain a Zoning Clearance. Mr. Snail also said he realized that if there were any requirements that could not be met by his request for a Zoning Clearance, that he would have to remove the structure. After a brief discussion, a motion was made by Mr. McKinney, seconded by Mrs. Higgins and carried by unanimous vote that Mr. Snail be given until September 15, 1986, to obtain a Zoning Clearance or remove the structure. Case No. 86-009 City of Clermont vs. Richard Miller Mr. Perlick stated that Mr. Miller's property was in violation of City Code because of the high grass and weeds on the property, along with an abandoned shed. Mr. Perlick advised the board that the grass had been cut, but the weeds were still high and the shed still needed to be removed. In a phone conversation with Mr. Per 1 ick, Mr. Mi 1 1 er stated he would correct the violation. After a brief discussion, a motion was made by Mr. Whitehead, seconded by Mrs. Higgins and carried by unanimous vote that Mr. Miller be given until September 15, 1986 to bring the property into compliance with the City Code.
