CODE ENFORCEMENT BOARD
November 20, 1984

This regular meeting of the Code Enforcement Board was called to
order by Chairman Bill McGuire at 7:33 p.m. on Tuesday, November 20,
1984 in the City Council Chambers. The Pledge of Allegiance to the
Flag was given by all present.
Minutes of the meeting of August 21, 1984 were approved as presented.
Hearing No. 84-008. City of Clermont vs John R. "Doc" Jones
Ron Thomas, Director of Building and Zoning, was sworn in by the clerk.
He stated that he had had numerous conversations with Mr. Jones re-
garding cleaning up his property in Block 88, and that some effort
had been made to comply, but that plenty of time had passed for the
job to have been completed.
Mr. Jones, under oath, stated that he has been working to clean up
the property, and that the rest of the trash and the last refriger-
ator would be removed the next day.
After a lengthy discussion itemizing the types of debris on the
property, a motion was made by Mr. Smith, seconded by Mr. Wiebush and
approved by unanimous vote THAT MR. JONES BE GIVEN TWO WEEKS TO
COMPLETE THE JOB OF CLEANING UP HIS PROPERTY IN BLOCK 88.
Hearing No. 84-009. City of Clermont vs Wilmer Pace.
Mr. Thomas reviewed Mr. Pace's appearance before the Board on
August 21, 1984 when he was given two weeks to remove all cars under
repair or being stored from his yard at 580 East Highland, and to
cease doing business as a repair shop. He stated that there had been
substantial improvement and that it appeared that Mr. Pace is no
longer in business at the site, but that the Board ought to address
the number of cars Mr. Pace should be allowed to have on his property.
After Mr. Pace was sworn in, there was much discussion about the
number of cars on his property, and whether he is in business as a
car dealer. It was finally agreed that there would be a problem if
there were an inordinate number of cars bearing twenty-day tags.
A motion was made by Mr. Smith, seconded by Mrs. Higgins and carried
by unanimous vote TO DISMISS THE CASE.
Hearing No. 84-010. City of Clermont vs John Boyett.
Mr. Thomas stated that Mr. Boyett has been keeping a large number of
quail and pheasants on his property at 1211 Bloxam Avenue, and after
being notified verbally and by letter, he had given his assurance
that they would be removed. Some of the birds have been removed,
but the problem still exists. A City Ordinance prohibits the keeping
of fowl in the City.
Under oath, Mrs. Dorothy Boyett stated that the birds are her hus-
band's hobby, and that there are approximately 100 of them. She
asked that four months be allowed for them to get rid of the birds
so that the babies would be mature. She also stated that no birds
are sold, but that they are given away.
After being sworn in, Mr. Glenn Middleton spoke at length suggesting
that Mr. Boyett's birds were not a nuisance, and that dogs and com-
mercial uses are more of a nuisance. He suggested that all caged
birds in the City should be outlawed.

Mr. John Lyons stated, under oath, that he helps care for the birds
and that there are others in the City, including the ducks on the
City property at Center Lake. He asked if fewer birds would be
permissible.
During discussion which followed, it was suggested that fewer birds
might not have been noticed, but that the large number of birds is
what caused the complaint. It was also stated that there have been
no complaints about other birds in the City, and that a complaint
must be received before action can be taken by the Board.
A motion was made by Mr. Smith that Mr. Boyett be given 60 days to
dispose of the birds. The motion died for lack of a second.
After further discussion, a motion was made by Mrs. Higgins, seconded
by Mr. Wiebush and unanimously approved THAT MR. BOYETT BE GIVEN
UNTIL THE YOUNG QUAIL GROW LARGE ENOUGH, OR 90 DAYS, TO DISPOSE OF
THE BIRDS.
There being no further business, the meeting was adjourned at 8:30 p.m.
