08-21-1984 Regular Meeting• CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD August 21, 1984 A regular meeting of the Code Enforcement Board was called to order by acting chairman Don Smith at 7:38 p.m. on August 21, 1984 in the City Council Chambers. The Pledge of Allegiance to the Flag was recited by everyone present. ROLL CALL. Members in attendance were Emma Higgins, Don Smith, Marvin Styles and Mary Wright. Absent and excused were Bill McGuire and Joe Wiebush. Absent were William McKinney and City Attorney Leonard Baird. Also attending were Director of Building and Zoning Ron Thomas and Code Enforcement Clerk Marilyn George. MINUTES of the meeting held May 15, 1984 were approved as presented. CASE No. 84-006. City of Clermont vs Wilmer Pace. Elisha Pace represented his brother, Wilmer Pace, who could not attend because he was working. Ron Thomas explained that Wilmer Pace appears to be running a home occupation, either as a car repair service or a junk yard., in an R-1 Single Family Residential zone. He stated that there had been no response from Mr. Pace to two letters, and that the activity must cease. Elisha Pace stated that brother is an auto mechanic and does paint and body work, but that all cars on the property belong to Wilmer, and that he works on them to keep his skills active. Mr. Smith stated that it appeared that Wilmer Pace had moved his business from its burned-out location on Highway 27 to his residential property. He also mentioned that the yard contains refrigerators, rear-end assemblies and a frame. He explained that the area is not zoned to do repair, painting, or to keep trash. Elisha Pace reported that there were plans to clean up the yard, and that his brother was not running a business from this location. He further stated that his brother is a licensed auto dealer who works at the auto auction. Mr. Smith stated that it appears that Mr. Pace is still in the auto business and that he wishes him well, but that it can't be done in the R-1 zone, and that a junk yard is not a permitted use in R-1. He suggested that Mr. Pace be given a week to explain to Ron Thomas what he is doing at the location. Elisha Pace asked how many cars are allowed on a piece of property at once. At this point in the proceedings Mr. Wilmer Pace arrived and Mr. Smith summarized what has transpired earlier. Wilmer Pace stated that he had tried to see Mr. Thomas, but that Mr. Thomas had not been at City Hall when he made his attempt. He also said that he had signed for the Certified letters. He stated that he is not doing business at this site, but that he plans to open a shop soon. He asked who made the complaint and was told that the violation was reported by the City Inspector. Mr. Pace expressed disappointment that Mr. Thomas had not stopped to talk to him, even though he goes by every day. • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD August 21, 1984 Page two • Mrs. Wright explained that the letters are a standard procedure of the Board and that Mr. Pace should have responded. Mr. Smith stated again that it appears that Mr. Pace has moved his business from its former location, and that R-1 zoning won't permit such activity. He suggested that Mr. Pace compare the appearance of his property with that of others in the neighborhood, and act accord- ingly. Mr. Pace said that when Mr. Smith drove by there were a lot of cars in the yard and that he does do paint and body work. He stated that he hopes to have a business location soon - perhaps in two weeks. After a statement by Mr. Pace that he would meet with Mr. Thomas in two weeks, a motion was made by Mary Wright, seconded by Marvin Styles and unanimously carried THAT MR. PACE BE GIVEN TWO WEEKS TO CEASE DOING BUSINESS IN THE R-1 ZONE AND TO CLEAN UP HIS YARD.
