CODE ENFORCEMENT BOARD
May 15, 1984
This meeting of the Code Enforcement Board was opened by City
Attorney Baird, acting as Chairman, at 7:30 p.m. on Tuesday,
May 15, 1984 in the City Council Chambers.
ROLL CALL. Members in attendance were Emma Higgins, Bill
McGuire, William McKinney, Don Smith, Mary Wright and Joseph
Wiebush. Also in attendance were City Attorney Leonard Baird
and Code Enforcement Clerk Marilyn George. Director of Code
Enforcement Harvey Nagel represented the City.
MINUTES of the meetings held September 20, 1983 and February 21,
1984 were approved as presented.
ELECTION. Mr. Baird stated that nominations were open for
Chairman. William McKinney was nominated by Mr. McGuire and
Mrs. Higgins, but declined the nomination. Bill McGuire was
nominated by Mrs. Higgins, seconded by Mr. Smith and unanimous-
ly elected to the Chairmanship of the Code Enforcement Board.
Per. McGuire led the Pledge of Allegiance to the Flag.
HEARING No. 84-004.
City of Clermont vs Isaac McCall.
Mr. Nagel explained that Mr. McCall has been a resident of
Clermont for many years, and that his property is very visible
from Highway 50. He stated that there is a large accumulation
of cans, building materials, vehicle parts and other debris on
this property. Some improvement was made after Mr. Nagel noti-
fied Mr. McCall that he was in violation of Section 11-10 of
bhe Clermont Code of Ordinances, but that more work is needed.
Mr. D4cCal1 stated that he collects the items mentioned above
so that he can sell them to supplement his income during the
off-season for citrus. He stated that all vehicles located on
his property are licensed and insured.
After a period of discussion on the condition of Mr. McCall's
property, A MOTION WAS MADE BY MR. SMITH, SECONDED BY MR.
MC KINNEY AND UNANIMOUSLY CARRIED THAT MR. MC CALL BE GIVEN
ONE WEEK TO BRING HIS PROPERTY INTO COMPLIANCE WITH THE CODE.
HEARING No. 84--005. City of C-lermont vs Mahlon Moore.
Mr. Nagel stated that Mr. Moore's property has been under ob-
servation for some time because__:o€ past violations, and that
past promises haven't been kept,. Mr. Moore's son works on
cars belonging to friends and family, and that cars are some-
times parked on the right-of-way. The violations Mr. Moore
is charged with are of Zoning Ordinance Article XVI and 11A-16
of the Clermont Code of Ordinances.
Mr. Moore explained that the car parked on the right-of-way is
for sale, and that no money changes hands when car repairs are
done. He said that he has been hauling debris to the dump and
should be able to do a better job of keeping his property clean.
Discussion concerned the fact that Mr. .Moore has appeared before
the Board before and had not made an effort to remain in com-
pliance with the orders of the Board.
A motion was made by Rev. McKinney that D4r. Moore be given two
to achieve compliance. After a brief discussion he withdrew
the motion.

Mr. Baird suggested that the Board issue an order requiring
compliance, and keep the order in effect for a period of six
months. This would allow the Board to call Mr. Moore back for
another hearing and a possible fine if he failed to stay in
compliance at any time during the six months.
A MOTION WAS MADE BY MR. SMITH, SECONDED BY MRS. HIGGINS AND
UNANIMOUSLY APPROVED THAT THE CITY KEEP MR. MOORE'~S PROPERTY
UNDER OBSERVATION FOR SIX MONTHS, AND THAT IF MR. MOORE FALLS
OUT OF COMPLIANCE HE BE CALLED BACK BEFORE THE BOARD.
Mr. Baird stated that he had attended a seminar with other
City Attorneys and that he considered it to be very helpful
in the area of code enforcement. He also emphasized that
the Code Enforcement Board is important and has greater in-
fluence as the City grows.
Mr. Nagel, who will retire on June first, thanked the Board
for working with him and expressed the feeling that he will
miss the group.
There being no further business, the meeting was adjourned
at 8:10 p.m.
