CODE ENFORCEMENT BOARD
MINUTES
April 19, 1983
This meeting of the Code Enforcement Board was called to order at 7:32 p.m.
on Tuesday, April 19, 1983 by Chairman Marcus McGowan in the City Council
Chambers. The Pledge of Allegiance to the Flag was recited by all present.
ROLL CALL. Present: Emma Higgins, Marcus McGowan, Bill McGuire, William
McKinney, Kathleen Parsell and Mary Wright. Absent: Glenn Curtis.
MINUTES of the meeting of March 29, 1983 were approved as presented.
HEARING No. 83-009 City of Clermont vs. Elvira Garcia. Mr. Nagel explained
that dogs had been reported at large in the area of Ms. Garcia's home. He
read a letter from Ms. Garcia stating that she had found a temporary home
for her dog outside the City Limits, and that the other dogs which have
been seen on her property belong to neighbors.
Ms. Garcia stated under oath that she has tried to contact Animal Control
to pick up the dogs not belonging to her, and she further verified the state-
ments made in the letter.
A motion was made by Mrs. Parsell and seconded by Mr. McKinney as follows:
IN VIEW OF MS. GARCIA'S EFFORTS TO COMPLY WITH REGULATIONS, THE CASE SHOULD
BE DISMISSED. The motion passed by unanimous vote.
HEARING No. 83-010 City of Clermont vs. Homer Davis. Mr. Nagel reported
that a dog belonging to Mr. Davis had been reported running at large.
Under oath, Mr. Davis explained that he owed a bill at the veterinarian's
office and was waiting to get the dog's rabies shot until he could settle
his account.. At present Mr. Davis is unemployed. He has purchased a strong
chain to keep the dog confined until such time as he can afford the shot.
The following motion was made by Mr. McGowan, seconded by Mr. McGuire and
passed by unanimous vote: A FINE OF $20.00 IS TO BE SUSPENDED IF PROOF OF
RABIES VACCINATION IS PRESENTED AND A LICENSE OBTAINED WITHIN TWO WEEKS.
Mrs. Parsell suggested to Mr. Davis that he may be able to work out an
equitable arrangement with the veterinarian if he explained his situation.
HEARING No. 83-Oll City of Clermont vs. George Stewart. Mr. Nagel reported
that the City had been unable to serve a subpoena on Mr. Stewart, and was
advised by Mr. McGowan to keep trying to serve it, and that the case would
be continued until such time as Mr. Stewart could be subpoenaed.
HEARING No. 83-012 City of Clermont vs. Carla Livingston. Mr. Nagel
stated that complaints had been received about a dog residing at Ms. Liv-
ingston's address being at large.
Ms. Livingston was sworn in and stated that the dog belongs to a friend of
her husband and is only there in the daytime. The owner of the dog, Steve
Pembrook, stated that the dog has all its shots and lives in Leesburg with
him.
A motion was made by Mrs. Parsell, seconded by Mr. McKinney and passed by
unanimous vote as follows: THAT THE CASE BE DISMISSED.
OLD BUSINESS. Mr. Nagel made the following follow-up reports: Jimmie Lee
Jackson has been keeping his site clean, Mr. Pontier has paid his fine, and
Mr. Lowery has cleaned up his property satisfactorily.
The meeting was adjourned at 8:00 p.m.
