CODE ENFORCEMENT BOARD
MINUTES
Tuesday, June 15, 1982
This meeting of the Code Enforcement Board was called to
order at 7:30 p.m. on Tuesday, June 15, 1982 in the City Council
Chambers by Chairman Kathleen Parsell. The Pledge of Allegiance
to the Flag was given by all present.
ROLL CALL. Present: Glen Curtis, Emma Higgins, Marcus
McGowan, Bill McGuire, Sue Mecanick, Kathleen Parsell.
Absent: None.
Representing the City: Attorney Leonard Baird, Director of
Code Enforcement Harvey Nagel, Code Enforcement Clerk Marilyn
George.
MINUTES of the meeting of May 18, 1982 were approved as
presented. The motion was made by Mrs. Higgins and seconded by
Mr. McGuire, and carried by unanimous vote.
PROGRESS REPORTS. Mr. Nagel made the following progress
reports on hearings previously before the Board:
Case No. 82-001. The fencing of the junkyard is 99% com-
plete, and has been done in a satisfactory manner.
Case No. 82-004. Mr. Dean complied with all City Codes in
regard to his signs.
Case No. 82-005. Mr. Nagel reported that the job is nearly
finished on the driveway at Calico Jack's and that the land-
scaping will meet the City's requirements. He is very happy
with these results.
Case No. 82-002. There has been a great improvement in Mr.
Edwards' property. The extra vehicles have been removed, as have
the building materials and restaurant tables. If he is given
enough time he will be in complete conformity.
Case No. 82-003. Mr. Thomas did not appear for the meeting
with Mr. Nagel ordered by the Board, but his wife contacted City
Hall and stated that they have contracted to have the rubble
removed from the lot by June 28. There must be another consul-
tation about whether the existing slabs and wall can remain.
In response to a question from a Board member about Mr.
Edwards' refusal to permit an inspection by the Fire Chief, Mr.
Baird said this could be considered lack of cooperation, but that
a court order is required to enter the premises, and this case
was not presented to require visiting inside the premises.
After further discussion, Mr. Baird stated that the case is
continued, in order to allow monitoring by the .Director.
HEARING NO. 82-006. CITY OF CLERMONT vs. MAHLON MOORE
In violation of Ordinances No. 36-C Sections 11A-16 and 11-10,
and Zoning Ordinance for R-2 Medium Density Residential.
Mr. Nagel gave a brief history of the case, explaining that
Mr. Moore is a long time resident of the area, well known, and
that he and his sons have a great interest in repairing cars,
boats and other items. This interest led to complaints by neigh-
bors of noise and lights and the appearance of the property dis-
turbing their right to peaceful enjoyment. It was mentioned that
Mr. Moore has been in poor health, that Mr. Nagel is in posses-
sion of letters of complaint from neighbors, and that Mr. Nagel
feels Mr. Moore will cooperate.
Mr. Moore told the Board that, partly because of his illness
and the effect of the medications he has taken, he did not real-
ize what a mess had been made of his property, and that the vio-
lations had been taken care of. He referred to a complaint of
light bothering a neighbor and stated that he had been very co-
operative with that neighbor in reducing light nuisance.
A short discussion resulted in a motion by Mrs. Mecanick,
seconded by Mr. McGowan and unanimously approved that the case
against Mr. Moore be dismissed.

Mr. Moore stated that Mr. Nagel has been a perfect gentle-
man in all their dealings and that he should be considered an
asset to the community.
ADJOURNMENT was moved at 8:10 p.m. by Mr. McGuire, and Mr.
Curtis seconded the motion. The vote was unanimous.
