05-01-2007 Regular MeetingCity of Clermont MINUTES PLANNING AND ZONING COMMISSION May 1, 2007 Page 1 The meeting of the Planning & Zoning Commission was called to order Tuesday May 1, 2007 at 7:03 p.m. by Vice Chairman Sy Holzman. Members present were Nick Jones, Gail Ash, Robert Boyatt, and Cuqui Whitehead. Not present were Bill Banzhaf, David Outlaw and David Pape. Also in attendance were Curt Henschel, Planner, Daniel Mantzaris, City Attorney, and Rae Chidlow, Administrative Assistant. MINUTES of the Planning and Zoning Commission meeting held Apri13, 2007 were approved as written. REPORTS There were no reports. 1. REQUEST FOR CONDITIONAL USE PERMIT PROJECT NAME: Clermont Pizza & Pasta Company OWNER: William Laboy APPLICANT: William & Leah Laboy REQUESTED ACTION: Request a Conditional Use Permit to allow a Restaurant within the Central Business Zoning District. LOCATION: 789 W. Montrose St. EXISTING ZONING: CBD (Central Business District) EXISTING LAND USE: Vacant FUTURE LAND USE DISTRICT: Established Business District-1 - (EBD-1) FUTURE LAND USE CLASSIFICATION: Central Business District - (CBD) Curt Henschel stated the applicant is requesting a conditional use permit for a restaurant to be located at 789 W. Montrose St. The previous use was a gallery. The proposed family restaurant would serve Italian food and pizza. No alcohol is proposed. Mr. Henschel stated the applicant intends to operate the restaurant in a manner which will improve and compliment the existing atmosphere of downtown Clermont. City of Clermont MINUTES PLANNING AND ZONING COMMISSION May 1, 2007 Page 2 Mr. Henschel stated that staff recommends approval of this Conditional Use Permit request to operate a Restaurant located at 789 W. Montrose St. with the following conditions as listed. Mr. Henschel stated that staff wants to point out one correction that needs to be added to the conditions under section 2 of Land Use. He stated they would like to put a time frame, and suggested amending the second sentence to state "should the restaurant cease operations for 6 months or more the owner and applicant must reapply for a new conditional use permit". Meeting Discussion: William Laboy, 412 Macchi Ave., Oakland, stated he was the applicant and was present to answer any questions the commission may have. Commissioner Boyatt asked what the business hours for the restaurant would be. Mr. Laboy stated the business hours would be from 11:00 am to 9:00 pm Monday thru Saturday and closed on Sundays. Commissioner Ash moved to approve the request as amended, seconded by Commissioner Whitehead. The vote was unanimous to recommend for approval to City Council. 2. REQUEST FOR CONDITIONAL USE PERMIT OWNER: Glenn Winn APPLICANT: Team Thrust International Church REQUESTED ACTION: Request for a Conditional Use Permit (CUP) to allow a church facility in a C-2 zoning district. LOCATION: 2220 Cluster Oaks Dr. EXISTING ZONING: C-2 (General Commercial) EXISTING LAND USE: Vacant office/ business space (2,700 sq. ft. +/-) FUTURE LAND USE DISTRICT: Undeveloped District 8 - (UD-8) FUTURE LAND USE CLASSIFICATION: Commercial Curt Henschel stated the applicant intends to establish a church at an existing business plaza. City of Clermont MINUTES PLANNING AND ZONING COMMISSION May 1, 2007 Page 3 Mr. Henschel stated the church is looking to occupy a 2,700 square foot space available at the Cluster Oak Professional Center. The church intends to have 50 seats for services that will operate Sunday afternoon and Wednesday evenings from 7:00 to 9:30 P.M. Mr. Henschel said that with the existing businesses operating at normal business hours, and the church operating at "after business" hours, staff believes there will not be any parking issues on or off site. If the church has 50 seats, there would be a 13 parking space requirement. The lease space that the church is proposing to occupy was parked for 14 spaces per code requirements. Mr. Henschel stated that staff recommends approval of the request for a CUP to allow a church at the Cluster Oak Professional Center with the following conditions. Meeting Discussion: Pastor Kevin Cunningham, 1003 Princeton Dr., Clermont, stated he is thrilled with Clermont and everything that is going on here and is glad to be a part of it. Commissioner Whitehead asked if Sunday afternoons meant 7:00 pm to 9:30 pm. Pastor Cunningham stated that it would be Sundays and Wednesdays. The hours would be Sunday mornings at 10:00 am until around 12:00 pm and then Wednesday at 7:00 pm. Commissioner Jones asked about the denomination being independent. Pastor Cunningham stated yes and their background is Assembly of God. Commissioner Whitehead asked if this was going to be a temporary position for him. Pastor Cunningham stated he will be here for at least two years. Commissioner Ash moved to approve the request as presented, seconded by Commissioner Jones. The vote was unanimous to recommend for approval to City Council. There being no further business the meeting was adjourned at 7:12.
