MINUTES
PLANNING AND ZONING COMMISSION
October 5, 2004
The meeting of the Planning & Zoning Commission was called to order Tuesday,
October 5, 2004, at 7:00 p.m. by Chairman David Pape. Members present were
Maggie Miller, Carolyn Mathieson, Sy Holzman, Henry Rhee, and David Lange.
David Outlaw, and Roger Pierce were absent. Also in attendance were Darren
Gray, Assistant City Manager, Curt Henschel, Planner, Daniel Mantzaris, City
Attorney and Jane McAllister, Planning and Zoning Clerk.
MINUTES of the Planning and Zoning Commission meeting held September 7,
2004 were approved as written.
Following the Invocation and Pledge of Allegiance those present observed a
moment of silence in memory of Commission Member Dick Tegen.
1. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT & OWNER: Clermont Highlands Development, Inc.
REQUEST: To allow for the construction of multifamily town homes in the C-2
Commercial district.
. LOCATION: Parcel generally located West of Grand Highway, East of Highway
27, North of State Road 50 and South of Pitt Street.
EXISTING LAND USE: Vacant.
SIZE OF PARCEL: 3.3 +/-acres
EXISTING ZONING: C-2, General Commercial.
FUTURE LAND USE DISTRICT: Undeveloped District 5 (UD-5).
FUTURE LAND USE CLASSIFICATION: Residential/Professional
Planner Curt Henschel introduced this request by saying that the applicant wants
to expand an existing multi-family development in the C-2 zoning district. The
expansion will consist of 26 multi-family units grouped together within six
buildings. This development will be an expansion of the existing Clermont Hillside
Villas to the north. Clermont Hillside Villas is nearing its build out of
approximately 92 units and is proposing to make an internal connection to this
proposed development. The west side of the parcel is heavily wooded with large
oak trees. The developer has a plan to preserve as many trees as possible by
placing the street and dwellings around the existing trees.

Mr. Henshel also stated that the applicant was requesting variances for two
issues: 1) Access to public street; The applicant is requesting an internal street
connection to the existing development., and 2) Landscape materials, the
request is to not buffer the north property line as it abuts other residential units of
the same nature. Staff recommends approval of this request.
Chairman David Pape asked if the applicant was present.
Rick McCoy of McCoy and Associates, 713 W. Montrose St, Clermont, FL 34711
representing the applicant stated that this was the highest and best use for this
property.
Chairman David Pape asked if there was anyone else who wished to speak
regarding this issue. There was no one.
Commission Member Holzman asked if the buildings in this phase will look like
those in the first phase.
Rick McCoy said that the buildings in this phase would look the same as those in
phase one.
• Commission Member Miller asked how many school age children would likely be
living in the development.
Rick McCoy replied that there were possibly 6 children living in the 92 units
already constructed. He stated further that the units are small, and that the
development is not family oriented.
Commission Member Holzman moved to approve the request; seconded by
Commission Member Mathieson. The vote was unanimous for approval of the
request.
There being no further business the meeting was adjourned.
