PLANNING AND ZONING COMMISSION
August 25, 2003
The special meeting of the Planning & Zoning Commission was called to order
Tuesday, August 25, at 7:00 p.m. by Chairman Richard Tegen. Members present were
David Pape, Maggie Miller, Dave Lange, Ronaldo Camargo, Sy Holzman, Jim Douglas,
and John Atwater. Also in attendance were Barry Brown, Director of Planning, and
Jane McAllister, Planning Technician II.
This meeting was held in order to allow the Planning and Zoning Commission of the City
of Clermont to have the opportunity to review and comment on two proposed projects in
the Joint Planning Area.
1. Property located on the South side of State Road 50, East of Hancock Road next
to the proposed 7-Eleven.
APPLICANT: Trycon, Inc. and Ackerman, Senterfitt
OWNER: Byron H. King, Trustee
• REQUEST: The applicant intends to construct a commercial center and has applied to
Lake County to change the land use designation from the county designation of
Employment Center to Urban and to change the zoning from Industrial to Commercial.
Planning Director Barry Brown introduced these requests by saying that City staff
recommends that no changes to zoning or future land use designations within the Joint
Planning Area occur until a Future Lane Use Map for the JPA is adopted as called for in
the Joint Planning Agreement.
The Joint Planning Agreement document is the first step in planning for the Clermont
area; however, the creation and adoption of the JPA Land Use map is the principal tool
to accomplish sound growth management.
Staff would also recommend that due to the contiguity of the parcel to existing municipal
boundaries that the owners consider annexation into the city prior to obtaining
development approvals.
Cecelia Bonifay, Esquire of Akerman, Sentertitt Law Firm representing Trycon, Inc. told
the Commission that her client wished to change the zoning from industrial to
commercial since the site is located in a commercial node, and is much better suited to
commercial use than any other use. Ms. Bonifay added that she and her client are here
to engage in a dialog with the Planning and Zoning Commission and would like a
• positive recommendation from the Commission.
The consensus of Commissioners was that the site is certainly better suited to
commercial development than anything else.

Richard Tegen asked if the developer would be asking for city utilities.
Ms. Bonifay replied that he would, and that Utilities Inc. has said they would not fight to
serve this area.
Richard Tegen suggested that if they were going to ask for city services they should
seek annexation at the same time.
Ms. Bonifay said there was not much difference between what the developer wants and
what the JPA will allow and therefore the project could be developed without annexation
into the city.
Frank Cannon of Trycon, Inc. said they would prefer to finish the project in the County
and then annex into the City.
Ronaldo Camargo asked why that was the case.
• Frank Cannon replied that it would be faster to go through the county.
Barry Brown explained that the change in land use requires a Large Scale
Comprehensive Plan Amendment.
Cecelia Bonifay said the County has assured them that the Large Scale Comprehensive
Plan Amendment will be adopted by the end of December 2003.
Barry Brown said he would not commit that the City could adopt by December, but it
would probably be no more than an additional month or two.
Frank Cannon said his project would be an attractive project, like Hancock Village. He
said that parking was an issue, stating that he needs less parking in the County than in
the City, and that he prefers to do the project with fewer parking spaces than the City
would require.
Mr. Cannon is also concerned with the grading requirements in the City, although he
said his grading would be close to what the City requires.
Maggie Miller expressed concern that the City will not be able to oversee the project
and then will be asked to annex it. She thinks it should be annexed before development.
• Paula Zahn said allowing the project to go forward would fuel the economy by keeping
services in Clermont, and that Commercial use is a better use than Industrial on this
site. She went on to say that high end restaurants are needed along the Highway 50
corridor.

Ms. Zahn pointed out that delaying a project of this size would place a great financial
burden on the developer.
John Atwater asked if the Hooks Street extension was still on the drawing board.
Barry Brown answered. that it was, and that it will go through the Bosserman property to
Emil Jahna Road.
Several members of the Commission expressed concern that the project would be built
to county standards and would then be annexed into the city.
Barry Brown said that the project should be built to JPA standards, which is a
compromise between City and County standards.
David Pape made a motion to support the recommendation for the change of land use
to commercial, subiect to being built to JPA Standards, and annexed and rezoned prior
• to receiving any zoning clearance from the City of Clermont. Ronaldo Camargo
seconded the motion. The vote was 7-1 in favor of the motion with Jim Douglas voting
against.
2. Property located East of Hancock Road and North of Hartwood Marsh Road
and Hartwood Pines Subdivision.
APPLICANT: Jimmy D. Crawford, Gray, Harris and Robinson PA
OWNER: Hart Family, LLC
REQUEST: The applicant intends to develop a residential subdivision and has applied
to Lake County to change the land use designation from Rural to Urban Expansion.
Jimmy Crawford told the Commission that the 142 acres would be developed as a
residential subdivision. He said there could possibly be some townhomes that might be
age restricted.
John Atwater asked if there would be any commercial or retail.
Jimmy Crawford replied that the city has discouraged that, and there would be no
• commercial development on this site.
After some discussion about the need for more schools when considering building
more homes, Jimmy Crawford said that the request under consideration here is the

change in land use. He also added that if the City so desires, the property would be
annexed and built to City standards.
David Pape made a motion to support the recommended change in land use, with the
condition that the property be annexed and developed enfirely to City standards.
Maggie Miller seconded the motion. The vote was unanimous in favor of fhe
recommended change in land use with the additional condition.
There being no further business the meeting was adjourned.
