PLANNING AND ZONING COMMISSION
June 3, 2003
The meeting of the Planning & Zoning Commission was called to order Tuesday, June
3, 2003, at 7:00 p.m. by Acting Chairman David Pape. Members present were Maggie
Miller, John Carlson, Dave Lange, Ronaldo Camargo, Sy Holzman, and Jim Douglas.
Richard Tegen and John Atwater were absent. Also in attendance were Barry Brown,
Director of Planning, Robert Guthrie, City Attorney and Jane McAllister, Planning
Technician II.
MINUTES of the Planning and Zoning Commission meeting held May 6, 2003 were
approved as written.
1. REQUEST FOR A CONDITIONAL USE PERMIT
APPLICANT: Bob Riddle
OWNER: Nacoochee Corp., John Smithgall, President
• REQUEST: For a Conditional Use Permit to allow the construction of a hotel with
convention facilities and a restaurant.
LOCATION: North of SR 50 between Citrus Tower Blvd. and Hancock Road; between
the radio antenna tower and the Clermont water tower.
EXISTING LAND USE: Vacant.
FUTURE LAND USE DISTRICT: Undeveloped District 5 (UD-5).
FUTURE LAND USE CLASSIFICATION: General Commercial
EXISTING ZONING: C-2, General Commercial
Planning Director Barry Brown introduced this request by saying that a conditional use
permit for this project was originally approved on January 23, 2001. Subsequently,
construction plans were approved on February 22, 2002. Both the conditional use
permit and the construction plans have expired. The applicant is requesting that the
hotel CUP and the constructions plans be reapproved.
The hotel site on State Road 50 is conveniently located to support the South Lake
• Hospital and the National Training Center as well as meet the lodging and meeting
facility needs of the greater Clermont area. The proposed uses are consistent with the
land use and zoning regulations.

Mr. Brown indicated some changes he wished to make in Section 4, Transportation
Improvements. The first was to Item #5 where he deleted "60 feet of right-of-way" and
replaced it with "up to 80 feet of right-of-way". In item #6 Mr. Brown wished to add "up

to 80 feet of right-of-way in the first sentence. He wanted the last sentence in item #6 to
read "The frontage road must be constructed from the subject property to Citrus Tower
Blvd. or to Hancock Road prior to the issuance of a certificate of occupancy for the
hotel."
Mr. Brown pointed out that the applicant would be requesting three variances from the
City Council.
David Pape asked if the applicant was present. Rick McCoy, 713 W. Montrose St.,
Clermont, FL was sworn in. Mr. McCoy is the project engineer and offered to answer
any questions the Commission might have.
Maggie Miller asked why the hotel had not been built before.
• Mr. McCoy indicated the there wasn't enough money to do the project the last time.
Barry Brown mentioned that one of the requested variances is to be able to use the old
landscaping code under which they were granted the first CUP, but that they will use
plants from the new preferred list.
_ _ Sv Holzman made a motion to approve the request. Maggie Miller seconded the motion.
The vote was 6 to 1 for ~proval with Jim Douglas voting nay.
2. REQUEST FOR A CONDITIONAL USE PERMIT
APPLICANT: Dick Candler
Barry Brown stated that this request has been withdrawn.
3. REQUEST FOR A CONDITIONAL USE PERMIT
APPLICANT: Walmart Stores East, LP
• OWNER: Lost Lake Reserve, L.C.
GENERAL LOCATION: Parcel "K" of the Lost Lake Reserve DRI; located at the
northeast corner of U.S. 27 and Johns Lake Road.

SIZE OF PARCEL: +/- 30 acres.
EXISTING LAND USE: Undeveloped.
FUTURE LAND USE DISTRICT: Undeveloped District -9 (UD-9).
FUTURE LAND USE CLASSIFICATION: Mixed Use Classification II.
EXISTING ZONING: PUD, Planned Unit Development.
Barry Brown introduced this request by stating that the applicant is proposing to
construct a Walmart Super Center that will include general retail sales, garden center,
grocery store, pharmacy, personal services, professional offices, restaurants, a gas
station, and a Tire and Lube Express.
The site is Parcel "K" of the Lost Lake Reserve DRI. This site is designated for
• commercial uses in the DRI and the PUD. The Lost Lake Reserve PUD allows for a
retail establishment of over 100,000 square feet in size.
The project is appropriately located at the intersection of a principal arterial, U.S. 27,
and a collector roadway, Johns Lake Rd. This location is off of the S.R. 50 corridor and
provides for a dispersal of trips to roadways with less traffic than S.R. 50.
The surrounding roadway network was designed to support commercial uses at this
_ location and with the planned improvements will support the Wal-Mart Super Center.
Planned roadway improvements include: the construction of Citrus Tower Blvd. from
S.R. 50 to U.S. 27; construction of a frontage road from Citrus Tower Blvd in the south
to Steves Road in the north; signalization of U.S. 27 and Johns Lake Road; the
widening to six lanes of U.S. 27; and improvements to Johns Lake Road including the
signalization of the Johns Lake Road and Citrus Tower Blvd. intersection.
Mr. Brown stated that the project meets the criteria of the land use designations and
zoning district.
Mr. Brown mentioned some changes to the conditions of the CUP as follows:
Section 4, Item #3 shall state "Citrus Tower Blvd. shall be constructed from ~R-~A
Hooks Street to Johns Lake Road prior to issuance of the certificate of occupancy for
the Wal-Mart SuperCenter." Item #5 is to be completely deleted and Item #8 is to read
• "Dual southbound left-turn lanes from US 27 onto Johns Lake Road or an alternate
design aQproved by D.O.T., the City and the County shall be constructed prior to
issuance of a certificate of occupancy." Section 7, Item #1 shall read "All signs for the
project shall be monument signs and their size and height, etc. shall be in accordance
with the approved Lost Lake PUD and with the pending sign revision ordinance."

Chairman David Pape asked if the applicant was present and would like to address the
Commission on behalf of the project.
Attorney Hal Kantor, 215 N. Eola, Orlando, FL introduced Harry Lerner.
Harry Lerner, Westshore Development Group, Inc., 3434 Colwell Ave., Tampa, FL
33614 was sworn in and proceeded to tell the Commission how far work has
progressed on the Lost Lake Reserve Project with respect to the roadways and the new
city park.
Peter Such, 500 S. Bolton, Sanford, FL was sworn in and gave a presentation of how
the site would be constructed. He said the retaining walls would be landscaped and
that the trailer storage area depicted in the northwest corner of the lot and along the
back of the store would not be visible from the roadway. Mr. Such also indicated that the
landscape package exceeds city code. He said lighting would include "shoebox" fixtures
which shoot light down on the development and do not permit it to shine on surrounding
• areas.
Boyd Rau, 6700 Antioch Plaza, Suite 300, Merriam, Kansas 66204, architect for
Walmart for this project was sworn in and described the outside elevations of the
building.
David Pape asked if there was anyone in the audience who would like to address this
request. There was no one. Mr. Pape then asked the Commission for questions or
comments on the project.
Jim Douglas expressed concern that allowing any outdoor storage would cut into the
already reduced parking spaces.
Peter Such demonstrated with the use of a chart that the parking at this Walmart site is
at a higher ratio than other Walmarts. He indicated there would not be a parking
problem.
Maggie Miller expressed concern about the loss of parking spaces to store
merchandise, but commended the landscape plans. She did not, however like the
facade used and suggested that the arches are too shallow and that the building still
looks like a big box.
• Boyd Rau said that he would certainly consider a change in the architecture in order to
gain the City's approval.
Ronaldo Camargo pointed out that if there were trailers behind the store there might not
be enough room for emergency vehicles to get through.

Peter Such assured Mr. Camargo there would be fifteen to sixteen feet left behind the
building after the trailers were in place. He said that would be enough room for access
for emergency vehicles, but said he would consult with the Fire Chief.
Ronaldo Camargo said he was concerned about giving up parking spaces for outdoor
sales, and that outdoor sales do not make the property look good.
Peter Such stated that Walmart would respect the decision of the City and will not have
outdoor sales if the City doesn't think it appropriate.
Sy Holzman said that the traffic projections were "soft" and that he would like to see a
study done at 3:00 p.m. when the school lets out.
Harry Lerner informed those present that the traffic was discussed at the last City
Council meeting and that everything had been analyzed for the DRI.
• The signage was discussed and it was suggested by Barry Brown that the blue color
behind the word "Walmart" on the front of the building was excessive.
David Lange said that the "Always" sign does not fit in with the building design.
Mr. Rau said that he has an alternative to the "Always" sign that he thinks will be
acceptable.
Peter Such said that Walmart would like to be able to have some outdoor display near
the garden center and to the side of the grocery entrance. He said it would be used for
things such as seasonal flowers or barbeque grills.
Ronaldo Camargo made a motion to approve the request with the changes on record.
David Lange seconded the motion. The vote was unanimous for approval of the
recLuesf.
There being no further business the meeting was adjourned.
