10-01-2002 Regular Meeting• • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION October 1, 2002 The meeting of the Planning & Zoning Commission was called to order Tuesday, October 1, 2002, at 7:30 p.m. by Chairman Richard Tegen. Members present were, Sy Holzman, Maggie Miller, Ronaldo Camargo, David Pape, and John Carlson. John Atwater and Dave Lange were absent. Also in attendance were Barry Brown, Director of Planning, and Jane McAllister, Planning Technician II. MINUTES of the Planning and Zoning Commission meeting held September 3, 2002 were approved as written. 1. REQUEST FOR A CONDITIONAL USE PERMIT APPLICANT: Kings Ridge Office Park OWNER: Lennar REQUEST: For a Conditional Use Permit to allow the construction of a professional office park that will include five (5) buildings each over 20,000 square feet in size. Planning Director Barry Brown informed the Commission that the applicant has withdrawn the request. 2. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: NTR Development Inc. OWNER: Rabi & George Nesheiwat REQUEST: For a Conditional Use Permit to construct a shopping center. GENERAL LOCATION: Northwest corner of S.R. 50 and Hancock Road. SIZE OF PARCEL: +/- 7 acres. EXISTING LAND USE: Undeveloped and vacant. FUTURE LAND USE DISTRICT: Undeveloped District - 5 (UD-5); the requested use is an allowable use in UD-5. FUTURE LAND USE CLASSIFICATION: Commercial. The requested use is allowed in the Commercial land use classification. • • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION October 1, 2002 Page-2- EXISTING ZONING: C-2, Commercial District. A shopping center is a conditional use in the C-2 zoning district. Planning Director Barry Brown introduced this request by saying that this project was originally reviewed by the Planning & Zoning Commission in August. At that time the Commission recommended denial because the full amount of the right-of-way requested for the frontage road had not been depicted on the site plan. Accordingly, the Council postponed hearing the request and sent it back to P&Z. In September, the P&Z Commission again recommended denial due to site plan design deficiencies. Subsequent to the September meeting, the applicant revised the site plan to address concerns of the P&Z Commission and staff. The applicant is proposing to develop a shopping center that will consist of three (3) commercial parcels, an anchor parcel with up to 25,100 square feet of general retail space and two {2) commercial out parcels. The out parcels may include retail, pharmacy, and financial institution users. The project is appropriately located at the signaled intersection of a principal arterial, S.R. 50, and a collector roadway, Hancock Road. The north boundary of this project is on the planned alignment for the frontage road between Citrus Tower Blvd. and Hancock Road. The permittee will be required to dedicate 40 ft. of right-of-way along the north property line in order to accommodate the frontage road. The permittee will be required to construct the frontage road along the entire length of the property. Initially the frontage road will only need to be constructed from Hancock Road to the first driveway. At such time as impact fee reimbursement is available the remainder of the frontage road shall be constructed. Mr. Brown mentioned that the revised site plan includes a 20 ft. landscape buffer along Highway 50, which is a better plan than before. He then read an addition to Section 4, Item 4 to those present which states "If the north half of the right-of-way for the frontage road is not dedicated by the adjoining property owner in time to allow for the construction of the frontage road, temporary access to the project will be allowed. A letter of credit or other instrument that would cover the cost of roadway construction must be provided to the City before temporary access will be approved." Richard Tegen pointed out a change to Page 5, Section 7, Item 1 stating it should read 2 out parcels. Attorney Cecelia Bonafay reiterated the changes made to the site plan at the suggestion of the Commission. She stated that the cooperation between the City and the developer has allowed the goals and objectives of both to be met. • u CI TY OF CL ERMONT MINUTES PLANNING AND ZONING COMMISSION October 1, 2002 Page-3- Sy Holzman wanted clarification about how many businesses would occupy the buildings designated as retail. Terry Lubinsky, of Trycon, Inc. 300 International Parkway, Suite 184, Heathrow, FL 32746 was sworn in and stated that there will possibly be two businesses in the smaller portion of the retail section and up to eight in the larger portion of the retail section. John Carlson asked if there was going to be a bicycle lane on the frontage road as there is no available path going east to west for bicycle. Barry Brown said that to his knowledge there were no plans for a bicycle lane along the frontage road, however, he stated that at the Oakley Seaver Drive alignment there is a spur from the trail that will go along the north boundary of the college that will be extended over into the hospital campus in the future. Maggie Miller suggested it might be safer and more convenient to patrons for the bank to position its drive thru lanes in another place. There was further discussion about where to position the drive thru lanes of the bank. Tom Skelton, American Civit Engineering Co, 207 N. Moss Road, Suite 211, Winter Springs, FL 32708 was sworn in and said that the bank decides how the drive thru will be situated, but it is possible that they might take the suggestion and change the plan. Ronaldo Camargo suggested there should be a right turn lane on Hancock Road into this project south of the frontage road. Barry Brown said that would be kept in mind when the roadway is designed. Richard Tegen mentioned that on Page 2, Item 3 the date should be changed from September 18, 2002 to September 26, 2002. David Page made a motion to approve the reguest Ronaldo Camargo seconded the motion. The vote was unanimous in favor of approval There being no further business the meeting was adjourned.
