MINUTES
PLANNING AND ZONING COMMISSION
April 2, 2002
The meeting of the Planning & Zoning Commission was called to order Tuesday, April
2, 2002, at 7 p.m. by Chairman Richard Tegen. Members present were John Atwater,
Gene Crossley, David Pape, John Carlson, Dave Lange, Sy Holzman, Maggie Miller
and Ronaldo Camargo. Also in attendance were Barry Brown, Director of Planning,
Robert Guthrie, City Attorney and Jane McAllister, Planning Technician II.
MINUTES of the Planning and Zoning Commission meeting held March 5, 2002 were
approved as written.
REPORTS
Planning Director Barry Brown reported that he attended a City Council retreat where
the topic of discussion was the continuing growth in Clermont and what the joint
planning boundary would be. It was concluded that the Board of County Commissioners
needed to be included in any discussion regarding joint planning. Mr. Brown reported
there was no date set as yet, but that there will be a meeting between the City Council
and the County Commissioners. He said he would contact the Planning & Zoning
Commission members and inform them of the date of the meeting so those who wish to
attend may do so.
City Attorney Robert Guthrie gave a presentation to the Commission regarding the legal
role of the Planning & Zoning Commission, their duties and the various issues that
come before the Commission. He explained the "Sunshine Law" and related matters. A
copy of Mr. Guthrie's presentation notes are part of this record.
Commission Member Maggie Miller reported that she attended a workshop in Leesburg
about conservation designs for subdivisions. Ms. Miller there were some interesting
concepts on how to save green areas.
1. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: Kim Patiry
OWNER: Clermont 8, Inc.
REQUEST: To allow for a retail furniture store in excess of 3000 square feet in the
Central Business District.
LOCATION: On Eighth Street south of the On The Corner Seafood Grill.
EXISTING LAND USE: Unoccupied building.

FUTURE LAND USE DISTRICT: Established Business District -1 (EBD-1 ).
FUTURE LAND USE CLASSIFICATION: Central Business District.
EXISTING ZONING: CBD, Central Business District. Any retail use occupying 3,000 or
more square feet of total floor area requires a conditional use permit.
Planning Director, Barry Brown, introduced this request by saying this matter was tabled
by the Commission in March because the applicant was not present to answer
questions. He went on to say that the applicant is proposing to operate a retail furniture
store in the former bowling alley, former Army-Navy store, which for years was used as
storage. Any retail use in the CBD that occupies 3,000 or more square feet of total floor
area requires approval by a conditional use permit. The proposed use is consistent with
the surrounding uses and the property has the proper land use and zoning
designations.
Mr. Brown went on to point out that he and Mr. Tegen went to the site and discovered
that the rear door to the building is a single wide door and can not serve as the delivery
point. He said the front door is a double door and that is where loading and unloading of
merchandise will have to take place.
Kim Patiry, 11301 Preston Cove Road, Clermont, FL., was sworn in and said that
loading and unloading from the street in front of the store will not cause a traffic
problem. She stated the loading and unloading could be done early in the morning
when traffic is light.
Richard Tegen asked if the merchandise would be sold mostly from inventory or from
catalogs.
Juan Muniz, 17565 Deer Isle Circle, Winter Garden, FL. was sworn in and stated that
the store will be used as a showroom and office. Most orders will be delivered from the
manufacturer to the customer's home. However, some furniture may be sold off the
floor on occasion.
Ronaldo Carmargo asked about the possibility of using the parking lot to the north
belonging to Seafood on the Corner restaurant, as an entryway to the rear of the store
for deliveries to the back door.
Barry Brown said the truck may be able to park in the lot belonging to the restaurant but
that delivery would have to be made through the front door.

Kim Patiry said she has spoken to the owner of the restaurant property and that he was
agreeable to allowing her tenant to use the parking lot to temporarily park delivery
trucks. She said that three property owners whose rear yards meet hope in the future
to make a parking lot that will service all three businesses.
A motion was made by John Carlson to approve the request. David Pape seconded the
motion and the vote was unanimous in favor of approval.
2. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: Elaine Peebles of Pinnacle Financial
OWNER: Marguarite L. Burns
REQUEST: For a Conditional Use Permit to allow for the construction of a professional
office building in the R-3 Residential/Professional zoning district.
LOCATION: First undeveloped lot on the west side of Bowman St. south of S.R. 50;
south of Dennis Cannon's building and north of Nick Jones office.
EXISTING LAND USE: Vacant
FUTURE LAND USE DISTRICT: EBD-2, Established Business District -2.
FUTURE LAND USE CLASSIFICATION: Professional Office.
ZONING: R-3 Residential/Professional; professional office is a conditional use in the R-
3zoning district.
Planning Director Barry Brown announced that the applicant has withdrawn their
application for a Conditional Use Permit.
3. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT AND OWNER: South Lake Presbyterian Church
REQUEST: To amend an existing conditional use permit, Resolution No. 954, to
include additional properties owned by the church and to allow for an existing
residential structure to be used as classroom space.

LOCATION: Corner of East Avenue, Chestnut St. and Linden St.
EXISTING LAND USE: Church and residential properties.
FUTURE LAND USE DISTRICT: Established Residential District -2 (ERD-2).
FUTURE LAND USE CLASSIFICATION: Institutional.
EXISTING ZONING: R-3-A Residential/Professional; a church is a conditional use in
the R-3-A zoning district.
Planning Director Barry Brown introduced this by saying that the church wants to
amend its CUP to include additional property it owns and to use an existing residential
structure on Lot #6 for classroom space. The additional property is comprised of Lots
6,7,9,10, and 11 of Block 14, Sunnyside Unit. These lots are adjacent to and west of
the existing sanctuary property. The property has the proper land use designations and
zoning.
Marilyn MacLaughlin, 1736 Sunset Drive, Clermont, FL. was sworn in and stated she
was the representative of the Presbyterian Church and would answer any questions.
Richard Tegen asked what days and times the classrooms would be used and if there
would be a need for additional parking.
Mrs. MacLaughlin said the classrooms would be used in the evenings and on Sundays
for youth activities. The youths using the classrooms will not be old enough to drive so
there will be no additional parking required.
Ronaldo Camargo asked if the residence scheduled to be used as a classroom would
comply with A.D.A.
Barry Brown answered that by saying it would be the responsibility of the Lake County
Building Department to determine that.

A motion was made by David Pape to approve the request. John Atwater seconded the
motion. The vote was unanimous for approval.
There being no further business the meeting was adjourned.
