06-01-1999 Regular Meeting~ i C/TY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JUNE 1,1999 The meeting of the Planning & Zoning Commission was called to order Tuesday, June 1, 1999 at 7:00 P.M. by Vice Chairwoman Elaine Renick. Members present was Robert Smyth, Joseph Janusiak, Charles Forth, Matt Modica, Bill Rauch and Misty O'Bar. Also in attending were Barry Brown, Director of Planning and Sharon Martin, Planning Clerk. MINUTES of the Planning and zoning Commission meeting held May 4,1999 and Special meeting held April 20,1999 were approved as presented. 1. REQUEST FOR A CONDITIONAL USE PERMIT APPLICANT: Lake Christian Fellowship LOCATION: 151 North Highway 27 REQUEST: To allow the operation of a church ZONING DISTRICT: C-2 General Commercial Business District The applicant is requesting a Conditional Use Permit for the operation of a Church in the Citrus Tower Centre that is located on the southeast corner of U.S. 27 and Grand Highway. The Citrus Tower Centre is a mixed-use commercial and professional office complex that is zoned C-2 General Commercial. Surrounding zoning is C-2 (General Commercial District) to the north, south, east, and west. The Future Land Use Map indicates Commercial land uses to the north, south, east, and west. Based upon consistency with adopted zoning district regulations, future land use classifications and district designations, and existing land uses on and adjacent to the site, staff recommends approval of the church facility as outlined in the Commission packet. Member Charles Forth asked Barry Brown, Director of Planning, if it was a requirement to have two restrooms instead of one that was indicated on the floor plan. Brown stated that was not the City's jurisdiction, that it was that of Lake County Building Department's requirement. Brown did go on to say that the City would require a City fire inspection prior to occupancy. Member Charles Forth stated his concerns for not having a separation between male and female restrooms because of it being a public meeting facility. Brown explained it is an existing building and does not require a building permit. After a brief discussion, a motion was made by Joseph Janusiak to recommend ~proval to the City Council as presented by staff, seconded by Bill Rauch and approved by a unanimous vote. • • C/TY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JUNE 1,1999 Page -2- 2. REQUEST FOR A CONDITIONAL USE PERMIT APPLICANT: Moonlight Players LOCATION: 732 West Montrose Street REQUEST: To allow the operation of a Community Theatre ZONING DISTRICT: CBD Central Business District The applicant is requesting a Conditional Use Permit to operate a community theatre in the downtown Central Business District. The subject site is located on the north side of Montrose St. midway between Seventh and Eighth Streets. The subject building was formerly a warehouse that is being converted into a community theatre. The theatre will be the venue for shows. musicals, plays and readings. The change in use will not require the provision of additional parking spaces. Surrounding land uses are retail and professional office to the east, west and south and the Clermont-Groveland Lions Club to the north. The surrounding zoning is CBD (Central Business District) to the north, south, east and west. The proposed request is consistent with existing land use of the area, and directives of the adopted Comprehensive Plan which provides for a mixture of uses to be located in the Central Business District. Based upon information provided for the proposed use, staff recommends approval of the Conditional Use Permit with the conditions as outlined on the Commissions packet. Bill Rauch stated that the owner of the property wasn't the Lions Club but instead it belong to the Elks Club. A motion was made by Bill Rauch to recommend approval to the City Council as presented by staff and seconded by Charles Forth and approved by a unanimous vote. 3. REQUEST FOR A CONDITIONAL USE PERMIT APPLICANT: First United Methodist Church LOCATION: 950 Seventh Street REQUEST: To allow the expansion of an existing church • . CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JUNE 1,1999 Page - 3 - ZONING DISTRICT: R-3 Residential/Professional District The First United Methodist Church is located north of State Road 50 between Seventh and Eighth Streets. The applicant is requesting a Conditional Use Permit to allow construction of an addition to the existing sanctuary. This addition will include a balcony, narthex, classroom, bathrooms and elevator. The project will increase sanctuary seating by 84 persons and bring the facility into compliance with ADA regulations. The existing parking lots provide the required number of parking spaces per code. Existing zoning of the site is R-3 (Residential/ Professional District), the future land use classification is Institutional and the future land use district is NED-2 (Non-established district -2). Surrounding land use include South Lake Hospital to the north, residential to the east, commercial to the south and Center Lake to the west. Based upon consistency with adopted City zoning regulations, conformance with Comprehensive Plan directives, and compatibility with existing land uses of the area, staff recommends approval of the Conditional Use Permit with the conditions as outlined in the Commission packet with a few revisions. Director of Planning Barry Brown stated that he would like to add two more items that were not included in the original list of conditions. They are as follows: (1) To provide an enclosure for the dumpster (2) Need to dedicate a 25' utility easement from east to west. Brown stated Broome Street Right of Way had been vacated and there would be a meeting prior to the council meeting with the City Engineer and Director of Public Services to further discuss the actual specification of the easement. Mr. Brown stated they were unable to meet prior to this meeting. Member Charles Forth stated he had a problem leaving it as is, without making a firm commitment so that everyone involved will know the location. Sworn in was Mr. Stephen Cook of 9200 Edgewater Drive, Clermont Florida. Mr. Cook stated that at the City Council meeting at which time the Broome Street was vacated, he understood the City didn't close the right -of-way, just the street and retained the right-of-way for utilities. If not, he would be willing to agree to this easement. • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JUNE 1,1999 Page - 4 - Barry Brown stated he would research the ordinance and get back with them on the issue. Member Charles Forth again stated the easement should specifically state Broome Street instead of only east and west. Barry Brown agreed. After a brief discussion a motion was made by Misty O'Bar to recommend ~prova/ to the City Council as presented by staff, seconded by Bill Rauch and approved unanimous vote. 4. REQUEST FOR A CONDITIONAL USE PERMIT APPLICANT: David L. Allyn, M.D. GENERAL LOCATION: Parcel tying on the south side of Grand Highway, approximately 750 feet east of Highway 27. REQUEST: To allow the construction of a medical office/clinic and ambulatory surgical center to include doctors offices and other professional offices. ZONING DISTRICT: C-2 General Commercial Business District The applicant is requesting a Conditional Use Permit to allow construction of up to 2 (two) buildings to house doctorslmedical offices and an ambulatory surgical center. The subject property is located on Grand Highway, east of the Citrus Tower and west of the Orlando Christian School (formerly Church of God). Surrounding land uses include vacant property to the north and south, a Christian school to the east, and the Citrus Tower complex to the west. Surrounding zoning is R-1 to the north and C-2 to the east, south and west. The Future Land Use District designation for the site and adjacent property is UD-5 which permits development of professional offices. Based upon information provided for the proposed use, staff recommends approval of the Conditional Use Permit as outlined in the Commissions packet. Barry Brown emphasized on condition #4 and explained that eventually we will have 80' right-of-way along Grand Hwy/Citrus Tower Blvd which is needed for future improvements. Brown also brought up condition #5 to explain the need for the access easement for safety concerns that should run west to the adjoining property. In addition to the conditions outline • • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JUNE 1,1999 Page - 5 - in the packet Brown explained he wanted the applicant to provide a west bound turn lane into the project due to the fact this project has the potential to generate considerable amount of traffic on Grand Highway. Persons sworn in were David L. Allyn, M.D, of 349 N Highway 27, Clermont Florida and Bob Thompson of 141 N. Highway 27, Clermont, Florida. Vice Chairwoman Elaine Renick had questions pertaining to the square footage. Dr. Allyn explained, it would be determined by the architect and the engineer. He also stated that he envisioned at least two phases to the project. Phase I would be approximately 8,000 to 15,000 square feet. The remaining project square footage would be based on area left over after meeting the requirements mandated by the City of Clermont such as set backs, retention, parking, etc. Member Misty O'Bar stated that the Landscaping Ordinance was in the process of being changed and wanted to know if we could implement the new ordinance on phase II. Vice Chairwoman Elaine Renick suggested to implement the new ordinance on phase I. Brown and member Charles Forth stated that they would have to comply with the ordinance that was current at the time of construction. Member Matt Modica stated that he didn't think the new Landscape Ordinance would be in effect at the time of phase I but, most likely would effect phase II. Brown explained that during the site review of phase If they would need to comply with the new regulations. Dr. David Allan stated that he had no problem adhering to the new landscape ordinance. Brown explained that majority of the landscaping will be addressed in phase I. Vice Chairwoman Elaine Renick asked if the previously mentioned right-of-way would cause a delay in the landscaping along the front of the property. Brown stated it would not. Member Matt Modica asked if anyone had a problem with the right-of -way. Bob Thompson wanted to know at what point should the turn lane be constructed, at the time of constructing the project or the road? Brown stated the turn lane needs to be provided during the development of the project and specifications will be discussed at the Site Plan Review Meetings. Member Matt Modica made a motion to recommended approval to the City Council, seconded by Joseph Janusiak and approved bra unanimous vote. C/TY OF CLERMONT u MINUTES PLANNING AND ZONING COMMISSION JUNE 1, 1999 PAGE -6- 5. REQUEST FOR A CONDITIONAL USE PERMIT APPLICANT: Jaymark Builders and Developers, Inc. GENERAL LOCATION: Parcel generally lying south of Mohawk Road, east of Citrus Tower Blvd., north of North Ridge Blvd., and west of Grand Highway. REQUEST: To amend a currently approved PUD (Resolution No. 987) by amending the legal description to add three and one-half (3.5) acres more or less. The applicant is adding a 1.8 acre parcel purchased from the City for "B" uses as described in the PUD and a 1.7 acre parcel purchased from the Gibb Family Trust for additional stormwater retention area. The previously approved Planned Unit Development consists of single family residential, multifamily residential, commercial and light industrial uses. General Project Description and Background The proposed project, containing 75.39+/- acres, is presently termed "Skyview" Planned Unit Development. It is generally located between Mohawk Road, North Ridge Boulevard, Willow Lake, and a northerly extension of East Jack's Lake Road. The applicant is proposing a mixture of land uses consisting of residential, professional office, commercial, and light industrial uses. A definitive list of proposed land uses and location criteria (Planned Unit Development Master Plan) is contained within the materials and documentation provided for your review and consideration. Consistent with development scenarios for Planned Unit Development magnitude projects the principal infrastructure will be constructed at the initial development stage. Individual parcel improvements will be provided on a site by site basis as specific site uses are identified, reviewed, and ultimately constructed. All proposed land uses will be developed and constructed in accordance with standards specified in the adopted City Land Development Regulations (LDR's) and applicable City Codes. The proposed project is located in the Future Land Use District area designated as UD- 5 (Undeveloped District - 5). This classification provides that a mixture of land uses may be permitted with design and construction as a Planned Unit Development project. The project therefore is consistent with Future Land Use directives for the area. Surrounding land use patterns, including the City's of Clermont, Minneola by the Lake, and Lake County jurisdictional areas, presently consist of residential, commercial, professional office, and light industrial uses. Land uses proposed by the applicant/developer are compatible with existing development of the area. • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JUNE 1,1999 Page -7- Based upon demonstrated consistency with future land use development directives of the appropriate jurisdictional entities, and compatibility with existing development patterns for the area, Staff recommends approval of the Planned Unit Development subject to the conditions outlined in the Commissions packet with the following corrections made to the Matrix of Permitted Land Use. The correct Matrix was included in the original Conditional Use Permit. Matrix of Permitted Uses Changes as per original PUD Multi Family should include B & B-1 Townhouse should include B & B-1 Shopping Centers is new and is not requested Light Manufacturing per LDC M-1 Remains as C only, B is not requested Wholesale Warehousing/Enterprise remains as C only, B is not requested Section 4 -Transportation #8. Change wording to Direct roadway access shall be provided from Tract B-1 to Mohawk Rd. (CitrusTower Boulevard to the North.) This access will be via a private driveway. Barry Brown stated that staff has been unable to meet prior to this meeting to discuss if there are any other conditions but added he didn't foresee any. Matt Modica had some concerns that possibly we were moving too fast. Brown stated that we were changing our approach to Conditional Use Permits. He explained that the applications will be brought before the Site Review Committee prior to the conditions being drafted. Persons sworn in were Bob Shaker and Dusty Twyman of 230 Mohawk Road, Clermont. Elaine Renick asked Mr. Shaker what was the intended use for this property because she doesn't want to approve any more multi-family. Mr. Shaker stated that his intention was to construct more multi-family. He went on to explain that it was previously approved for that use. During a lengthy discussion, Mr. Shaker brought to the Commissions attention the changes in the above mentioned Matrix and that B uses included multi family. ! ~ CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JUNE 1, 1999 Page-8- Mr. Shaker stated that the additional 1.7 acres to the south would be used for retention area. He went on to say the surrounding area to the north was industrial uses. Member Elaine Renick stated that she felt the parcel should be used for industrial instead of multi family. Member Matt Modica wanted to know the price range of the multi-family units and the density of the property. Barry Brown stated that the PUD was approved for 12 units per acre. Member Elaine Renick stated that the PUD didn't include this property and Brown stated it didn't. Mr. Shaker stated that neighbors in the area have indicated they didn't want commercial or industrial business located there. Brown asked how many additional units would be constructed and Shaker responded thirty-six units. Shaker went on to describe plans far the project. Member Matt Modica went on to say he thought the density was to high for the area. Bob Shaker went on to describe the use of the property and the specifications of the units. Member Charles Forth questioned if the road along the truss plant was going to stay private with Lake County putting in the new road. Bob Shaker explained it would because of the traffic of the truss plant trucks. After a brief discussion concerning the roads, Charles Forth stated his concerns of this parcel not withstanding the industrial area as far as traffic and noise. He went on to give suggestions about this area Bob Shaker went on to say that the parcel is land locked and the only access was through residential area. Member Misty O'Bar stated that she wasn't real happy about the request, but it was land locked and there wasn't much they can do with the land except include it in the development. Member Elaine Renick wanted to know if they would be willing to compromise and build twenty four unit instead of thirty six units. Shaker went on to explain the buffering around the project and after meeting with staff on numerous occasions and had come to agreement by already making several changes. Barry Brown stated the he agreed with the Planning and Zoning Commission that very soon we will have approved all the multi-family that we need for a long time, but understanding that the additional units doesn't really create a significant impact as far as the whole project in general. • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JUNE 1,1999 Page - 9 - Elaine Renick asked Barry if they will be required to conform to the new landscape ordinance and Brown stated they will have to conform to whichever code was in effect at the time of the site plans are review. Member Charles Forth made a motion to recommend approval to the City Council. The motion was seconded by Joseph Janusiak and approved by a unanimous vote.
