02-02-1999 Regular Meeting• • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION FEBRUARY 2,1999 The meeting of the Planning & Zoning Commission was called to order Tuesday, February 2, 1999 at 7:00 P.M. by Chairman Robert Smythe. Members present were Joseph Janusiak, Bill Rauch, Misty O'Bar, Elaine Renick, Charles Forth and Matt Modica. Members Wanda Andrews and Michael Floyd were absent. Also attending were Lanny Harker, Director of Planning, Barry Brown, Principal Planner and Mimi Ogden, Planning and Zoning Specialist. MINUTES of the Planning and Zoning Commission meeting held January 19, 1999 were approved as presented. 1. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: New Horizons Church LOCATION: 655 West Broome Street REQUEST: A request for a Conditional Use Permit to allow the temporary operation of a Church in the C-1 Light Commercial District. Planning Director Harker explained that the applicant is requesting approval for establishment of a tem~orarX Church in the building historically utilized by the Clermont Women's Club. It is understood this is a temporary use and location until such time as the church achieves the ability to secure a permanent site and facility. Use of the site is indicated to be Sundays and possibly one other night during the week. The applicant has requested use of the facility for a period of one (1) year. Parking for the present use (Women's Club) and the proposed temporary church is not available on-site. The applicant has requested a variance from the City Council to provide parking in the adjacent First United Methodist Church Parking area that lies directly to the west. The Board of Trustees of the Methodist Church have given permission for use of their parking area. Surrounding zoning is C-1 (Light Commercial District) to the east, west and south, and R-3, ResidentiaVProfessional Office to the north. The Future Land Use District Map indicates Commercial uses to the east, west and south, and ResidentiaUProfessional uses to the north. Based upon consistency with adopted zoning district requirements, future land use district designations and existing land uses pertinent to the site Staff recommends approval of the temporary church facility with the conditions as outlined in the Commissions packet. At this time Chairman Smythe asked all those present who wished to speak in regard to this case be sworn in. • • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION FEBRUARY 2,1999 Page-2- Persons sworn in were Dr. Richard Tindell of 11103 Mandarin Drive, Clermont, Florida. Member Charles Forth stated, regarding condition #6 of the Staffs recommendation, that he would assume the City will monitor the parking situation to ensure that no parking problem arises. Planning Director Harker stated that it would be monitored. A motion was made by Charles Forth to recommend approval to the City Council as presented by staff,' seconded by Bill Rauch and approved by a unanimous vote. 2. REQUEST FOR CONDITIONAL USE PERNIIT APPLICANT: Droor & Associates, Inc. LOCATION: Southwest corner of Broome Street and Lake Avenue. REQUEST: A request for a Conditional Use Permit to construct an unmanned equipment building (fiber optic) for Time Warner Communications. Planning Director Harker explained that the applicant is requesting a Conditional Use Permit for a fiber optics switching facility (building) at the southwest corner of Broome Street and Lake Avenue. The proposed facility will be a 1,200 square feet unmanne building utilized as a switching facility for the fiber optic system. A 200 square feet unroofed equipment enclosure would be attached to the switching facility. The equipment enclosure would contain an emergency propane generator and 2 air conditioning units. Monitoring and boosting of the signal is a part of the switching operation. Surrounding land use includes vacant property and single family residential to the north, Commercial and Professional uses (Clermont Travel and a small commercial business center) to the south, the Women's Club to the west, and Lake Dot and a single family residence to the east. The property is zoned C-1(Light Commercial District). Surrounding Zoning includes C-1 (Light Commercial) to the south, east ,and west. R-3 (Residential/Professional District) is located to the north. The Future Land Use District designation (NED-3) and Future Land Use Map (Commercial use designation) will not be adversely affected by the request for the proposed fiber optic switching facility. • • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION FEBRUARY 2,1999 Page - 3 - Included as part of the Conditional Use Permit is a request for a variance for a reduction in provision of on-site pazking from the required six (6) spaces to construction of two (2) spaces. Therefore, based upon consistency with adopted City zoning regulations, conformance with Comprehensive Plan directives, and compatibility with existing land uses of the azea, Staff recommends approval of the fiber optic switching facility with the conditions as outlined in the Commissions packet. At this time Chairman Smythe asked all those present who wished to speak in regard to this case be sworn in. Persons sworn in were Noel Droor, P.E., Droor and Associates of 580 N. Wickham Road, Melbourne, Florida. Member Misty O'Baz asked if noise would be produced from the facility, as there is residential housing nearby. Mr. Droor stated that the only noise would be from the propane powered generator, which would be exercised once a week for a few minutes. Other than that, the only time the generator would be used would be if there were a power failure. The reason for installing the eight foot wall around the facility is to dampen the noise. Chairman Smythe asked how tall the building would be. Mr. Droor stated that the building would be approximately thirteen feet to the top of the roof. Member Elaine Renick asked when the generator would be tested, during the day or night. Mr. Droor stated that it could be set to run in the daytime. At this time Mr. Joel Pinckney, representative of Time Warner Cable of 130 Ingram Circle, Longwood, Florida. Mr. Pinckney explained that TWC needs to be in the center of there service azea, which in this case being South Lake County, with Clermont being the very center of the service azea. This is the most cost effective way to provide service. Member Charles Forth asked Mr. Pinckney if there was anything generated from this facility that could be hazazdous to the surrounding azea. C17Y OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION FEBRUARY 2,1999 Page - 4 - Mr. Pinckney stated that there would be absolutely nothing hazardous produced from this facility and further noted that fiber optics transmission is probably the cleanest electronic transmissions known to man. Chairman Smythe stated that he is concerned with the aesthetics of the site, as there is residential property to the north and east, and this appears to be a very imposing building to be in a residential neighborhood. Mr. Droor stated that due to the fact that this is in a residential area, they have provided some landscape islands and are proposing to heavily landscape in these islands to hide the building. Chairman Smythe stated that there would appear to be a wide open view to the front going up the driveway. If the driveway were angled and had proper landscaping, the building would be better hidden from view. Member Matt Modica asked Mr. Droor if this were a request that they could adapt too. Mr. Droor stated that it is possible they could relocate the driveway. Mr. Pinckney stated that the driveway was intentionally made longer so the building would be set further back on the property. What can't be seen on the site plan is that the property slopes thirty-five feet front to back. Member Charles Forth noted his concern with water run-off into Lake Dot. Noting that perhaps a french drain or a Swale along the roadway to prevent the water from getting into the street and then into the Lake. Planning Director Harker noted that the water will have to be retained on-site, other than that from the portion of the driveway that is on the City right-of--way. Member Elaine Renick asked if there were to be complaints from the neighbors about the noise level, is there any other way to muffle the sound. Mr. Droor stated that the only thing they could do would be to put a roof over it, but the generator does need to have ventilation for the exhaust. Further discussion followed regarding the potential noise from the generator. SMALL SCALE COMPREHENSIVE PLAN AMENDMENT OWNER: Chester C. Fosgate Company APPLICANT: C. Douglas Kelly, AICP LOCATION: Parcel generally located on the east side of North Hancock Road, approximately 1,300 feet north of State Road 50. REQUEST: A request for a Small Scale Comprehensive Plan Amendment to change the Future Land Use Map Classification from Residential to Commercial. Barry Brown, Principal Planner, stated that this is a request to change the Land Use Classification from Residential to Commercial. The subject property is approximately 6 acres of a larger 39 acre parcel. The remaining 33+/- acres already has the commercial land use and C-2 zoning. Property to the south is classified as commercial land use, property to the west is institutional and property to the north and east is classified as residential land use. The requested land use change is consistent with the objectives of the Comprehensive Plan. It locates commercial in what is already a designated commercial node along an arterial (State Road 50) and a collector (North Hancock Road). Approval of this request will eventually provide convenient neighborhood and community retail services for residents of the area. Staff recommends approval of this request. At this time Chairman Smythe asked all those present who wished to speak in regard to this case be sworn in. Persons sworn in were Mr. Daryl Carter of 908 South Delaney, Orlando, Florida. Mr. Carter stated that they do not presently know exactly what uses will go on the property, but they type of uses they have in mind are grocery stores, restaurants, banks and potentially a large retail user (i.e. Target or Home Depot). Member Elaine Renick asked if the ingress/egress would be from State Road 50 or Hancock Road. • • CITY OF CI.ERMONT MINUTES PLANNING AND ZONING COMMISSION FEBRUARY 2,1999 Page - 6 - Mr. Carter explained that they have had discussion with Planning Director Harker, FDOT and Lake County, working out the access points along State Road 50 and Hancock Road. Further discussion followed regarding the landscaping requirement between this commercial area and the abutting residential areas. Mr. Carter stated that the reason far the irregular shape of this parcel is due to the location of the rails-to-trails project which runs along the eastern and northern boundaries of this property, which will also act as a buffer between the commercial and residential areas. A motion was made by Charles Forth to recommend approval to the Ci#y Council as presented by sta ff. seconded by Joseph Janusiak and approved by a unanimous vote 4. SMALL SCALE COMPREHENSIVE PLAN AMENDMENT APPLICANT: South Lake Center, Inc. LOCATION: Parcel generally located south of State Road 50, approximately 660 feet west of Citrus Tower Blvd. (aka East Jacks Lake Road). REQUEST: A request for a Small Scale Comprehensive Plan Amendment to change the Future Land Use Map Classification from ResidentiaVProfessional Office to Commercial. Principal Planner Barry Brown explained that the subject property is the northern 3.1 acres of a larger 9 acre parcel. The requested change is from ResidentiaVProfessional Office to Commercial Land Use. Staff would prefer to assign this aMixed-Use Professional Office/Commercial classification that would require the parcel to be developed in its entirety as a PUD. However, such a classification does not currently exist and it will be 9 to 12 months before such a land use classification is adopted by the City and approved by the Department of Community Affairs. Therefore, Staffis proposing that the request be granted subject to a developers agreement specifying the types of commercial uses allowed. Property to the north is classified as Commercial Land Use where the Kash and Karry shopping center is proposed, properties to the west, most of which is in the City, already has commercial zoning (DeWitt mine), property to the south is vacant and property to the east is residential. Staff recommends approval of the request, subject to a developers agreement. . ~ • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION FEBRUARY 2, 1999 Page-7- Principal Planner Brown explained that there will be a road from State Road SO running south along the western border of this property, which will be an extension of Oakley Seaver Boulevard, that will go to the future extension of Hook Street. Discussion occurred regarding the development of Boulevards with landscaping in the medians and the timing of the construction of Oakley Seaver Blvd. south of State Road 50. A motion was made by Misty O'Bar to recommend approval to the City Council as presented b~ staff, seconded by Joseph Jarrusiak. Member Elaine Renick suggested that the motion be amended to state that the Developers Agreement include the road issues. the motion was amended bvMisty O'Bar and seconded bx Joseph Janusiak and approved by a unanimous vote.
