12-01-1998 Regular Meeting~ ~ CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION DECEMBER 1, 1998 The meeting of the Planning & Zoning Commission was called to order Tuesday, December 1, 1998 at 7:00 P.M. by Chairman Robert Smythe. Members present were Joseph Janusiak, Joseph Wiebush, Darryl Bishop, Keith Mullins, and Scott Grubbs. Member Marilyn MacLauchlin, Bill Rauch and Michael Floyd were absent. Also attending were Lanny Harker, Director of Planning, and Mimi Ogden, Planning and Zoning Specialist. MINUTES of the Planning and Zoning Commission meeting held November 3, 1998 were approved with the start time being amended from 7:00 p.m. to 7:30 p.m. 1. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: Veronica's Hair Designing LOCATION: 1224 and 1236 Grand Highway REQUEST: To allow the operation of a beauty parlor and a residential dwelling unit with a common parking area in the R-3-A ResidentiaVProfessional District. Planning Director Harker explained that the applicant is requesting a Conditional Use Permit to allow formal operation of a beauty salon and a single family residential dwelling unit at the above referenced addresses. The requested uses are proposed for two (2) individual lots, and are to occur in two (2) separate, existing structures. The subject site(s) are located on the west side of Grand Highway approximately 135 feet north of the intersection of Grand Highway and Almond Street. The Conditional Use Permit is to encompass both lots and both structures. According to the information provided in the application, the beauty salon is to occupy the building located at 1236 Grand Highway (south property) and the building located at 1224 Grand Highway (north property) is to remain as a single family residence. Parking to accommodate both uses will be relocated to the rear of the buildings. The two (2) existing driveways will be eliminated and one (1) shared ingress/egress drive is to be constructed to serve both uses. The proposed parking configuration has been provided on the property surveys supplied as part of your review materials. The subject site is zoned R-3-A (residential/professional district) which allows the requested uses. However, the beauty salon business requires approval of a conditional use permit in order to operate in that zoning district. Surrounding zoning is R-3-A (ResidentiaUProfessional District) to the north and south, R-2 (Medium Density Residential) to the west, and C-2 (Highway Commercial) to the east. Surrounding land uses include residential to the north and west; residential, professional office, and commercial uses to the south; and commercial (Clermont Regional Shopping Center) to the east. The future land use map indicates the area as a future residentiaUprofessional office district. CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION DECEMBER 1, 1998 Page-2- Mr. Harker further stated that understanding the proposed site is located in a transitional area of the City, and demonstrates consistency with required zoning district classification and future land use designations, Staff recommends approval of the proposed use with the conditions as outlined in the Commissions packet. At this time Chairman Smythe asked all those present who wished to speak in regard to this case be sworn in. Persons sworn in were Katherine Wolfe of 1275 West Lakeshore Drive, Clermont, Florida. Mrs. Wolfe explained that she has searched diligently for another location for this use, however, there is a lack of appropriate sites as far as zoning and adequate parking within the City for this type of use. A motion was made by Joseph Wiebush to recommend approval to the City Council as.presented by staff. seconded by Joseph Janusiak approved by a unanimous vote 2. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: Jaymark Builders and Developers, Inc. LOCATION: 260, 262, 264 and 266 Mohawk Road REQUEST: To allow the operation of a church and multiple professional offices, located in the M-1 Light Industrial District. Planning Director Harker explained that the applicant is requesting a CUP to operate a professional office building that would include a temporary church facility on lot 3 in the existing Office~Business Park at Clermont Commons. According to applicant information three (3) professional office uses would be located in the structure along with the proposed temporary church. Professional office uses include a dentist office, a construction business office, and a radiology facility (outpatient MRI service). The site plan submittal indicates fifty-four (54) parking spaces available for the building. The professional office uses require thirty-six (36) spaces leaving eighteen (18) spaces for any demonstrated daily church office business use. The peak parking demand for the proposed church use is indicated as Wednesday nights and Sundays. This scenario essentially provides anoff--hour parking demand from any of the office uses to be located in the building. Therefore, ample parking for all proposed uses appears available. • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION DECEMBER 1, 1998 Page - 3 - Adopted City Code indicates all of the professional office uses as being permitted uses in the M-1 zoning district. However, utilization of the structure for a temporary church facility requires the approval of a Conditional Use Permit by the City Council. The subject site is situated on Lot 3 of the park which is located approximately 300 feet north of the intersection of the two (2) Mohawk Roads. The property is presently zoned M-1 which with approval of a Conditional Use Permit (CUP) allows location of a church. The Clermont Commons Business Park is a multi-use development that presently provides industrial distribution warehouse space, manufacturing enterprises, physical fitness facilities, various types of business offices, dance studios and a temporary Montessori School site. Land uses of the surrounding area include the business~Professional park and residential subdivisions to the north and west; a residential subdivision to the east; and office and industrial uses to the south. The Future Land Use District designation (UD-5) and Future Land Use Map (Industrial use designation) will not be adversely affected by the request for the proposed temporary church use. Mr. Harker further stated that based upon consistency with adopted City zoning regulations, conformance with Comprehensive Plan directives, and compatibility with existing land uses of the area, Staff recommends approval of the Temporary Church facility with the conditions as outlined in the Commissions packet. At this time Chairman Smythe asked all those present who wished to speak in regard to this case be sworn in. Persons sworn in were Robert Shaker of 230 Mohawk Road, Clermont, Florida. Mr. Shaker stated that the only condition they would like to ask to be change would be condition #12, where Staff recommends the use be allowed for two (2) years. The tenant has signed a lease for three (3) years, and they would therefore request that the use be permitted for three years. Planning Director Harker noted that the two (2) year time frame has no specific reason, this is just the amount of time customarily given as the City Council does like to review the progress a temporary church is making toward a permanent facility. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: Family Christian Center GENERAL LOCATION: Parcel generally located on the west side of U. S. Highway 27, approximately 1,100 feet south of Brogden Drive. REQUEST: To allow the construction of a church with related facilities, in the R-1-A Urban Residential District. Planning Director Harker explained that the applicant is requesting a conditional use permit for a 36+/_ acre parcel located on the west side of US Highway 27, approximately 1,100 feet south of the intersection with Brogden Drive. The proposed Family Christian Center is intended to evolve and develop in phases over a period of years. The application provided for consideration at this time is essentially the initial phase of the ultimate facility. Subsequent amendment of the Conditional Use Permit will occur as demonstrated needs and desires of the community and congregation become better defined, and resources become available for additional expansion. Initially the Christian Center is to commence development with a single 12,480 +/_ square foot building (128' x 100'). The building is intended to be utilized as the sanctuary for worship services (without fixed seats- 400 seat capacity) and provide multiple function for other related church activities. It is to be constructed with 1,300 SF of Sunday School classroom and Bible study space. This area would dual perform as apre-school education facility during the week. The Church staff offices containing approximately 800 +/- SF of area would also be provided within the building. The first stage of construction is to include opportunity for preliminary development of picnic areas and sites for outdoor recreation activities. The applicant has requested that two (2) variances be addressed within the Conditional Use Permit. The first request would be to allow grass parking on fifty (50) of the one hundred, ten (110) spaces required. It was stipulated by the applicant that all grass parking spaces would be watered, maintained and defined for use by concrete bumper stops. Planning Director Harker explained that the second variance relates to landscape buffering and directed the Commission to the site plan included in their packet. Mr. Harker explained that the dark lines on either side of the driveway indicates that area proposed to be a landscape buffer, up to the existing guard rail, from that point on it would consist of a fifty (50) foot natural vegetative buffer be placed around the remainder of the site. CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION DECEMBER 1, 1998 Page - 5 - Mr. Harker explained that based upon compliance with future land use directives of the City and Lake County, and consistency with established development and zoning patterns of the area, Staff recommends approval of the Conditional Use Permit for the Church with the conditions as outlined in the Commissions packet and with the amendment to the landscape buffer requirement as discussed previously. At this time Chairman Smythe asked all those present who wished to speak in regard to this case be sworn in. Persons sworn in were James Senator, Architect, of 1317 Sumter Street, Leesburg, Florida. Mr. Senator explained that the site is an old orange grove site and that there is a mixture of old orange trees and scrub oaks on the property. Mr. Senator further explained that the reason for the landscape buffer variance is that, near the beginning of the guard rail, the property has a very steep grade/drop off. Hence the planting of a landscape buffer would not serve a purpose in this area. Also realizing that FDOT maybe expanding Highway 27 in the near future, if a landscape buffer were to be installed along Highway 27 it may need to be set inside the property line to avoid destruction and possible relocation should Highway 27 be widened and the same would apply to the sidewalk. The existing guardrail is located directly on the FDOT right-of--way. Mr. Senator asked that the church be given extra time to install the sidewalk. Mr. Senator stated that as shown on the site plan, they would want to align their entrance across Steve's Road with the entrance that FDOT has already approved for Mayfair Park Subdivision. Planning Director Harker noted that condition #20 gives them one year from the date of the certificate of occupancy to install the sidewalk. Chairman Smythe suggested that the condition be changed to state at such time as a sidewalk is installed on either side of the applicants property, the church would the install a sidewalk. Mr. Senator asked if the condition could be changed to state whichever comes later.
