08-04-1998 Regular Meeting• • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION AUGUST 4, 1998 The meeting of the Planning & Zoning Commission was called to order Tuesday, August 4, 1998 at 7:00 P.M. by Chairman Robert Smythe. Members present were Joseph Janusiak, Bill Rauch, Marilyn MacLauchlin, Darryl Bishop, 3oseph Wiebush, Keith Mullins, Scott Grubbs and Michael Floyd. Also attending were Lanny Harker, Director of Planning and Mimi Ogden, Planning and Zoning Specialist. MINUTES of the Planning and Zoning Commission meeting held July 7, 1998 were approved as presented. 1. REQUEST FOR REZONING APPLICANT: Mary Hull-Harris LOCATION: 1560 Bloxam Avenue REQUEST: Rezoning from R-2 Medium Density Residential District to R-3 ResidentiaU Professional District. Planning Director Harker explained that the applicant is initiating rezoning of the parcel located on the northwest corner of Minnehaha and Bloxam Avenues. The rezoning will amend only lot 3 of the Forty Pines Subdivision Surrounding zoning of the area is C-1 (Light commercial District} and C-2 (General commercial District) to the north, C-2 (General commercial District} to the east, R-2 (Medium Density Residential District) and R-1 (Urban Residential District) to the west, and R-1-A (Urban Residential District) to the south. Surrounding land uses include duplex (two-family) residential and the newly constructed Adult Independent Living Facility (AILF) to the west. Commercial, retail businesses, professional offices, personal service oriented uses, and three (3) single family residential dwellings intermixed with the non-residential uses are located to the north. The recently renovated shopping center is located directly across the street to the east. Single family residential is the predominant land use located south of Minnehaha Avenue. It should be noted that Minnehaha Avenue has historically provided the physical boundary between residential and non-residential land uses. Planning Director Harker further explained that the applicant has recently received City Council approval for a small scale Comprehensive Plan Amendment to permit ResidentiaUProfessional Land Use Classification for the site. As part of the approval process it was agreed the subject property should receive no greater intensity zoning classification than the R-3 (ResidentiaU Professional District) classification. Therefore, the proposed action is simply a continuation of the process to coordinate approved future land use directive with zoning district classification. A motion was made by Marilyn MacLauchlin to recommend approval to the City Council as presented by staff, seconded by Darryl Bishop and approved by a unanimous vote. 2. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: Mary Hull-Harris LOCATION: 1560 Bloxam Avenue REQUEST: A request for a Conditional Use Permit to allow the operation of a professional office (real estate), located in the R-3 ResidentiaVProfessional Office District. Mr. Harker explained that the applicant is requesting a Conditional Use Permit for a real estate office in the existing building to be located on the above described property. The requested action is a change in use from existing residential use to a professional office utilization. The site, property and general area information has been provide in the preceding request for rezoning. The request provides a transition of use from commercial activities that are principally located adjacent to SR 50 to the residential uses that predominately occur on the south side of Minnehaha Avenue. Based upon demonstrated consistency with required zoning district classification, future land use district directives, land use map designations, surrounding land use information previously provided and the sites ability to accommodate the proposed use, Staff recommends approval of the Conditional Use Permit for a professional office with the conditions as outlined in the Commissions packet. A motion was made by Bill Rauch to recommend approval to the City Council as presented by staff, seconded by Keith Mullins, approved by a unanimous vote. 3. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: Rick McCoy, P.E. OWNER: John Wert GENERAL LOCATION: Parcel generally located on the west side ofU.S. Highway 27, approximately 190 feet north of Montrose Street. • CITY OF CLEIZ~LIONT MINUTES PLANNING AND ZONING COMMISSION AUGUST 4, 1998 Page - 3 - REQUEST: A request for a Conditional Use Permit to allow the operation of a landscape materials business in the C-2 General Commercial Business District and a petition for a variance to allow the storage of horticultural materials in conjunction with the retail sales, in the R-3 ResidentiaUProfessional District. Mr. Harker explained that the applicant is requesting a conditional use permit fora 2.4+/- acre parcel located on west side of US Highway 27, approximately 190 feet north of the intersection with Montrose Street. The proposed project is a landscape materials business providing trees, shrubs, mulch, bark, stone, and other various materials utilized for landscaping. The business will also have a 600 square foot combination office and storage building located on the south end of the site. The applicant, as part of this request, is asking for a variance to provide tree storage on a portion of the property that is presently zoned R-3 (ResidentiaVProfessional District). The combination office/storage building and other materials areas are proposed to be located in the C-2 (General Commercial District) area of the site. Specific location of all proposed uses are indicated on the site plan supplied with the request. Surrounding zoning is C-2 (General Commercial District) to the south and east, and R-3 (ResidentiaUProfessional District) to the north and west. Surrounding land use is commerciaVquasi-commercial (Ambassador Cleaners) to the south and east, assorted single and multi-family residential to the west, vacant land and the City of Clermont water retention area to the north. Based upon compliance with future land use directives of the City and consistency with established development and zoning patterns of the area, Staff recommends approval of the Conditional Use Permit with the conditions as outlined in the Commissions packet. At this time Chairman Smythe asked all those present who wished to speak in regard to this case be sworn in. Persons sworn in were Rick McCoy of 713 West Montrose Street, Clermont, Florida and Hosea Wootson of 505 East Montrose Street, Clermont, Florida. Rick McCoy, Project Engineer, stated that he would ask that condition #20, regarding sidewalks, be changed as the sidewalk could be a danger (i.e. skateboards) and also the sidewalk would basically go to no where. Mr. McCoy further stated that his client would agree at such time as Highway 27 is six laned and the bridge is installed with pedestrian traffic to tie a sidewalk in. Mr. Hosea Wootson, adjacent property owner, asked if there would be access to the site from Highway 27. CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION AUGUST 4, 1998 Page-4- Chairman Smythe, noted that FDOT is limiting the number of curb cuts to a minimum, in many cases they are installing service roads which parallel the highway to service properties such as this. This may be a decision that will be made by the Site Review Committee. Rick McCoy stated that they are presently looking into getting access through the property to the south of Mr. Werts property and further noted that they would be willing to dedicate the front 50' as an ingresslegress easement. Planning Director Harker brought the Commissions attention to condition #22 which states "The permittee/developer shall construct internal traffic connection links that provide direct transportation access between the subject parcel and the adjacent parcel to the south". This should be amended to read "and the adjacent parcels". A motion was made by Darryl Bishop to recommend approval to the City Council as presented by staff with item #22 being amended to state "the adjacent parcels", seconded by Marilyn MacLauchlin, approved by a unanimous vote.
