07-07-1998 Regular Meeting• , CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION ii JULY 7, 1998 The meeting of the Planning & Zoning Commission was called to order Tuesday, July 7, 1998 at 7:00 P.M. by Chairman Robert Smythe. Members present were Joseph Janusiak, Bill Rauch, Marilyn MacLauchlin, Darryl Bishop, Joseph Wiebush, Keith Mullins and Scott Grubbs. Member Michael Floyd was absent. Also attending were Lanny Harker, Director of Planning and Mimi Ogden, Planning and Zoning Specialist. MINUTES of the Planning and Zoning Commission meeting held June 2, 1998 were approved as presented. 1. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: Donnie Ray Maddox LOCATION: 627 Eighth Street REQUEST: A request for a Conditional Use Permit to allow the operation of a family entertainment and restaurant facility, located in the (CBD) Central Business District. Mr. Harker explained that the applicant is requesting a Conditional Use Permit to operate a family entertainment and restaurant facility where beverages, ice cream, and assorted prepackaged refreshments may be purchased and consumed on-premises. Essentially, the business will provide concession oriented products during daily hours of business, and during certain evening hours will provide additional adult beverages, refreshments and live entertainment. The subject site is located in the Central Business District on the east side of Eighth Street. It is to be situated in the former Gatorland Meat building, adjacent to the newly constructed trail head facility. Surrounding land uses include retail, personal service, professional office and other Central Business District forms of development in all directions. Surrounding zoning is CBD (Central Business District) in all directions. The proposed request is consistent with existing land use of the area, and directives of the adopted Comprehensive Plan which provides for a mixture of uses to be located in the Central Business District. Mr. Harker further stated that based upon information provided for the proposed use, staff recommends approval of the Conditional Use Permit with the conditions as outlined in the Commissions packet. A motion was made by Marilyn MacLauchlin to recommend approval to the City Council as presented by staff, seconded by James Brown, approved by a unanimous vote. • . REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: Lake Sumter Community College GENERAL LOCATION: Parcel generally located approximately 1300 feet north of State Road 50, on the west side of the future Hancock Road extension. REQUEST: To allow the construction of a College Campus and related facilities. Planning Director Harker stated that the proposed project is to be situated on property located between the north extension of Hancock Road and the new hospital complex which is now being constructed adjacent to East Jack's Lake Road. The total campus is to cover approximately eighty-two (82+/-) acres of land. The overall facility is to be developed in a number of stages and is to consist of education buildings, parking areas, athletic fields and open space areas. Phase 1 of the campus is to be approximately ten (10) acres in size. Facilities for Phase 1 of the Campus will consist of an education building, paved entry drive, parking areas, and water retention areas requisite for collection of stormwater for the initial stage improvements. Surrounding land use patterns presently include the new hospital complex to the west, SR 50 to the south, and large parcel vacant property to the east and north. The existing vacant acreage to the east has been approved by the City Council fora 799 unit retirement community (Levitt Homes), and single-family subdivisions have been approved for various properties to the north. The City of Clermont Land Development Regulations allow placement of educational facilities in any of the City Zoning Districts provided that a Conditional Use Permit is granted by the City Council. Planning Director Harker further stated that understanding the Community College is actively trying to construct educational facilities to meet increasing demand in the South Lake area, and based upon demonstrated consistency with future land use development directives, Staff recommends approval of the project conditions as outlined in the Memorandum to the Commission. At this time Chairman Smythe asked all those present who wished to speak in regard to this case be sworn in. Persons sworn in were: Nick Jones of 1322 Bowman Street, Clermont, Florida Jim Hunter, Conklin Porter and Homes Engineers of 1117 E. Robinson Street, Orlando, Florida Ken Stack, Vice President of LSCC, of 9501 US Highway 441, Leesburg, Florida. • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JULY 7, 1998 Page - 3 - Jim Hunter asked for clarification on condition #6 which states all excavated material shall be stored in a location approved by the City Engineer, all the material excavated for the WRA will be used on site. Mr. Hunter asked if there was another purpose for this condition. Planning Director Harker stated that this is a standard condition. Normally during the construction process there will be an over burdened piles that will eventually be leveled, just for clarification the City Engineer and the project engineer will come to an agreement as to where the location of these piles should be. Mr. Hunter asked, regarding condition #15, sidewalks along the length of the property. It is his understanding that the County will be installing the sidewalks along with the construction of Hancock Road. Planning Director Harker stated that they should contact Lake County to clarify who will be installing the sidewalk, this is a standard condition. Mr. Hunter asked, regarding condition #16, which states roadways within the project will be constructed to City standards. It is his understanding that all the roads within the project will be treated as private streets, but there will be curb and gutter along the streets up to the property line. Mr. Harker stated that is correct, essentially what this is referring to is clay and then limerock base, not the curb and gutter. Mr. Hunter asked, regarding condition #18, for clarification, the County will be designing the acceVdecel lanes. Mr. Hunter asked if the City wanted a letter from the County outlining this. Mr. Harker stated yes. Mr. Hunter asked, regarding condition #20, in terms of erosion control, it is there intention to use Hancock Boulevard, in its current condition, as the temporary construction access, until for one reason or another that is no longer possible and an alternate access will be determined. Mr. Harker noted that this was understood by Staff. Mr. Hunter noted regarding condition #22, discussion has occurred regarding needing to extend the 16" water main, the Colleges intention is to extend the water line to the entrance and in a future phase extend it to the northeast corner of the property. • • CITY OF CLERMONI' MINUTES PLANNING AND ZONING COMMISSION JULY 7, 1998 Page-4- Planning Director Harker stated that he would like to have this clarified prior to the City Council meeting, as there are several subdivisions that will be constructed to the north of this property and the usual standard operating procedure is that a developer will carry the utilities to their furthest most property line. Mr. Hunter noted regarding condition #25, an irrigation system has not been designed yet and the College hopes to utilize a lot of Xeriscape. Mr. Hunter asked if the City requires an irrigation system, if so another means of providing the water may be investigated. Mr. Harker discussed the possibility of a well being utilized for irrigation purposes. Mr. Hunter stated regarding condition #31, it is his understanding that the work hours is not normally enforced unless there is a complaint. Mr. Harker explained that they ask that these hours of work be observed as much as possible. A motion was made by Bill Rauch to recommend approval to the City Council as presented by staff, seconded by Joseph Janusiak, approved by a unanimous vote. 3. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: Richey and Crawford, P.A. OWNER: Franklin D. Longenbach LOCATION: Parcel generally located west of U.S. Highway 27 and lying both north and south of Vista Del Lago Boulevard. REQUEST: To allow the construction of a retail business center with associated restaurant and convenience store uses, located in the C-1 Commercial District. Mr. Harker explained that the applicant is requesting a Conditional Use Permit to construct a retail business center with associated restaurant and convenience store uses. The subject site, containing 5 +~_ acres, is located west of and adjacent to US Highway 27, and south of the approved Legends Planned Unit Development. Vista Del Largo Boulevard is essentially the west continuation of Hartwood Marsh Road which enters the Vista Del Largo Subdivision. Surrounding land use includes the Kings Ridge Development of Regional Impact project to the north and northeast, on both sides of US Highway 27. Vista Del Largo Subdivision to the west. Vacant property and residential development to the south, and vacant property to the east. . ~ `~ • CJ CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION JULY 7, 1998 Page - 5 - The Lake County Comprehensive Plan indicates the area to develop in an "urban expansion" land use pattern. The subject property presently has "vested rights" commercial land use in accordance with the adopted Lake County Comprehensive Plan, and commercial zoning (CP -Planned Commercial) was previously established as part of the Vista Del Largo Subdivision approval. In addition, the subject site lies in close proximity to the designated commercial land use area permitted as part of the Kings Ridge DRI. Specific site development criteria required to be utilized includes adopted maximum impervious surface coverage ratios, parking and vehicular use requirements, landscaping standards (all buffer, interior parking, and vehicular use area requirements), and stormwater abatement requirements. Planning Director Harker stated that recognizing the subject site meets all future land use directives and zoning requirements for the proposed use, Staff recommends approval of the Conditional Use Permit for the Retail Business Center subject to the conditions as outlined in the memorandum to the Commission included in their packets. A motion was made by Joseph Janusiak to recommend approval to the City Council as presented by staff, seconded by Darryl Bishop, approved by a unanimous vote. 4. DOWNTOWN REDEVELOPMENT PLAN -Review for comprehensive plan compliance. Planning Director Harker explained that this is essentially the final hurdle for the actual adoption of the Citys' Downtown Redevelopment Plan. As stated in the memo enclosed in the Commission packet from Barry Brown, Principal Planner, the plan was unanimously approved by the Downtown Clermont Partnership, public input was also provided at a hearing on May 28, 1998. Staff does feel that requirements of the Comprehensive Plan have been met with the proposed plan. A motion was made by Joseph Janusiak to recommend approval to the City Council as presented by staff, seconded by Keith Mullins, approved by a unanimous vote.
