PLANNING AND ZONING COMMISSION
APRIL 7, 1998
The meeting of the Planning & Zoning Commission was called to order Tuesday, Apri17, 1998 at 7:00
P.M. by Chairman Robert Smythe. Members present were Keith Mullins, Joseph Janusiak, Bill
Rauch, Marilyn MacLauchlin, Joseph Wiebush, Darryl Bishop and Scott Grubbs. Member Michael
Floyd was absent. Also attending were Lanny Harker, Director of Planning and Mimi Ogden, Planning
and Zoning Specialist.
MINUTES of the Planning and Zoning Commission meeting held March 3, 1998 were approved as
presented.
Planning Director Harker stated that the Pastor for the St. Matthias Church has requested that their
request be placed last on the agenda (Items #1 and #2 on the agenda were withdrawn prior to the
meeting).
4. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: Nick A. Jones
LEGAL DESCRIPTION: Lots 19, 20 and 21 of Block 7, Sunnyside Unit and Lot 6, Sunnyside
Terrace.
LOCATION: 1320 and 1322 Bowman Street
REQUEST: A request for a Conditional Use Permit to amend Resolution No. 372 and Resolution No.
906 to allow the expansion of an existing professional office and dwelling unit, located in the R-3
ResidentiaUProfessional District.
Mr. Harker explained that the applicant is requesting a Conditional Use Permit to allow a 1200 square
feet expansion to the existing professional office for two (2) additional office units, and a 500 square
feet enlargement of the existing dwelling unit for a bedroom.
The subject site is situated on the west side of Bowman Street across from the Sunnyside Shopping
Plaza. Surrounding land use is professional office to the north, commercial (Sunnyside Plaza) to the
east and residential uses to the west and south.
The subject property is situated in the EBD-2 Future Land Use District which allows both residential
and professional office uses. The parking requirement for a professional office use is one space for
each 200 square feet of office space. The proposed expansion to the existing residential use for a
bedroom does not require any additional parking space to be provided.
According to the site plan submitted with the request, adequate parking (6 spaces) for the proposed use
can be provided on the site.
Mr. Harker further stated that based upon data and criteria specified above, Staff recommends
approval of the Conditional Use Permit with the conditions as outlined in the Commissions packets.

At this time Chairman Smythe asked all those present who wished to speak in regard to this case be
sworn in.
Persons sworn in were Cheryl Olivenbaum of 175 Sunnyside Drive, Clermont, Florida and Nick Jones
of 1322 Bowman Street, Clermont, Florida
Ms. Olivenbaum, adjoining property owner, stated that her only concern would be water run-off onto
her property.
Mr. Jones stated he believes berming will be necessary during construction. Mr. Jones also noted that
there is about ten feet of pure sand which will enhance the absorption of the stormwater runoff.
Mr. Harker stated that if the CUP is approved the applicant will then have to proceed through the Site
Review process which will require turbidity barriers to be in place during construction.
A motion was made by Bill Rauch to recommend approval to the City Council as presented by staff,
seconded by Marilyn MacLauchlin, approved by a unanimous vote.
5. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: The Gant Group, Inc.
GENERAL LOCATION: Parcel generally located east of Sunnyside Drive, northeasterly of Laurel
Street and west of Bowman Street.
LEGAL DESCRIPTION: Lots 25, 26, 27, 28 and 28A of Block 7 Sunnyside Unit.
REQUEST: A request for a Conditional Use Permit to allow the construction of amulti-family
complex (7 units), located in the R-2 Medium Density Residential District.
Mr. Harker explained that the applicant is requesting a Conditional Use Permit for amulti-family
housing project consisting of seven (7) units to be constructed as three (3) townhouse units and one (1)
standard single family unit.
The property is generally located on the south east corner of Laurel Street and Sunnyside Drive,
adjacent to Lake Sunnyside. The existing land use is predominately a mixture of two family, triplex
and multi-family unit development surrounding the lake. Professional office construction lies adjacent
to the property on Bowman Street.
The subject site is established as ERD-2 (Established Residential District) which permits limited multi-
family residences consistent in density and character with the surrounding area. New residential
development is limited to a maximum density of eight (8) dwe[Iing units per acre. The property has an

established R-Z zoning district classification (medium density residential) which permits multi-family
development when a Conditional Use Permit is obtained for the proposed use. The request is also
consistent with Future Land Use Map which indicates the area to develop
in a residential manner.
Planning Director Harker explained that Staff does have reservation about the proposed driveway
coming offof Laurel Street. The location of the driveway on the preliminary site plan is very close to
the intersection.
Member Marilyn MacLauchlin asked what the purpose was of the azea designated as "future parking".
Mr. Harker stated that he believes Mr. Gant is going to request a Comprehensive Plan Amendment to
allow professional office uses on a portion of the subject property. The "future parking" indicated on
the site plan should however be considered as part of the requested CUP for the multi-family project
being addressed. Consideration for "future parking" should be limited to that context and not subject
to speculation concerning any other use.
Further discussion followed regazding the "future parking area" and the location of the driveway on
Laurel Street.
Mr. Jones stated that on the conceptual site plan, two units would be located in the flood plain. The
site may need to be redesigned with six units in one building.
Planning Director Harker stated that essentially what the Commission is approving is the conceptual
site plan, which should then only have minor modifications made to it, but six units in one mass is
atypical of this azea.
Member Marilyn MacLauchlin stated that years ago Mr. Hart, the previous owner of this property, did
have approval to build more units onto the existing duplex to the north of this property.
Mr. Harker again stated that the density is correct, however, six units clustered together is atypical for
this area.
A motion was made by Marilyn MacLauchlin to recommend approval to the City Council as presented
by staff, seconded by Joseph Janusiak, approved by a unanimous vote.
3. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: St. Matthias Church, Inc.

REQUEST: A request for a Conditional Use Permit to amend Resolution No. 941 to add additional
property and allow the conversion of an existing residence to be utilized for Sunday School classes and
other church related meetings, located in the R-3 Residential/Professional District.
Mr. Harker explained that the applicant is requesting modification of the existing Conditional Use
Permit to add the adjacent single family residence to the overall Church property and convert the
structure for use as additional Sunday School space and Church related meetings. As part of the
Conditional Use Permit application the applicant has also requested use of mulch parking for the four
(4) spaces required for the proposed use.
The subject site is situated at the northeast corner of Lake Avenue and Montrose Street. The property
is presently zoned R-3 ResidentiaUProfessional District which provides with approval of a Conditional
Use Permit (CUP) Churches and ancillary related uses.
Land uses of the surrounding area include residential to the north and east, multi-family residential to
the south, and Central Business District uses to the west.
Based upon consistency with the adopted City Zoning Regulations and compatibility with existing and
adjacent land uses, Staff recommends approval of the Conditional Use Permit with the conditions as
outlined in the Commissions packet.
A motion was made by Marilyn MacLauchlin to recommend approval to the City Council as presented
by staff, seconded by Joseph Janusiak, approved by a unanimous vote.
There being no further business the meeting was adjourned.
