11-04-1997 Regular Meeting• CITY OF CLERMON7' MINUTES PLANNING AND ZONING COMMISSION NOVEMBER 4, 1997 The meeting of the Planning & Zoning Commission was called to order Tuesday, November 4, 1997 at 7:00 P.M. by Vice-Chairman Joseph Wiebush. Members present were Keith Mullins, Joseph Janusiak, Marilyn MacLauchlin and Bill Rauch. Members absent were Darryl Bishop, Michael Floyd and Robert Smythe. Also attending were Lanny Harker, Director of Planning and Mimi Shaw Ogden, Planning Technician. MINUTES of the Planning and Zoning Commission meeting held October 7, 1997 were approved as presented. 1. REQUEST FOR A CONDITIONAL USE PERMIT APPLICANT: Immanuel Temple Church LOCATION: 792 East Montrose Street REQUEST: A request for a Conditional Use Permit to allow the operation of a church located in the R-3 ResidentiaUProfessional District. Mr. Harker explained that the applicant is requesting a Conditional Use Permit to convert a former commercial building located at 792 East Montrose Street to a church. The building was formerly utilized as a community tavern serving patrons of the general area. However, due to a fire at the premises, the business was closed and the structure has been standing vacant for an extended period of years. The applicant now wishes to repair the previous damage and convert the building to a permanent church facility. Mr. Harker further explained that the applicant will also be requesting the City Council to permit grass parking for the church. The driveway area and the handicapped parking facility are indicated to have a paved surface, only the actual parking stalls are to remain grass. In addition, the applicant has received written authorization from the adjacent property owner to allow overflow parking upon any unforseen necessity. The parking proposed at the site is more than adequate for present functions and activities of the congregation . The requested Conditional Use Permit action would not be contrary to any directives of the adopted comprehensive plan or zoning district classifications. Essentially, the proposed request would assist in comprehensive plan compliance by furthering directive for redevelopment activities to occur in this area of the City. Based upon compliance with comprehensive planning and zoning district directives for the area staff recommends approval of the Conditional Use permit subject to the following conditions: The conditions as set forth in the Conditional Use Permit shall be legally binding upon any heirs, assigns andlor successors in title or interest. The property shall be developed in substantial accordance with an approved site plan incorporating all conditions of this Conditional Use Permit. Said plans shall be submitted for review and approval of the Site Review Committee prior to authorization and issuance of a development permit. 3. All applicable rules and regulations shall be met, including but not limited to final site plan approval, landscaping, drainage, sign regulations and all yard setbacks. All required landscaping must be served with a low volume permanent irrigation system including City approved and State mandated backflow prevention device and rain sensor gauge. All landscaped areas must be properly maintained. 4. The site shall be provided with a masonry dumpster enclosure with wooden gates which shall be indicated on the approved site plan. 5. The structure shall be inspected by the Fire Marshall for life safety requirements, all requirements must be met prior to any certificate of occupancy being issued. 6. The structure shall be inspected by the County Building Inspector and all building code violations must be corrected prior to a certificate of occupancy being issued. 7. Required on-site parking spaces may be grass but drive isles and handicapped parking areas must be constructed of impervious materials in accordance with City Code. 8. The permittee shall construct a five (5} foot wide sidewalk along Montrose Street the length of the subject property. 9. The property may be used as a Church Facility only. No expansion of the use or additions to this facility shall be permitted except as approved by another Conditional Use Permit. 10. This permit shall become null and void if substantial construction work for the church offices has not begun within eighteen (18} months of the date of grant of this Conditional Use Permit. "Substantial Construction Work" means the commencement and continuous prosecution of construction of required improvements ultimately finalized at completion. 11. The final Certificate of Occupancy shall not be issued until each of the stated conditions has been met. 12. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. Page - 3 - A motion was made by Marilyn MacLauchlin to recommend approval to the City Council as presented by staff, seconded by Joseph Janusiak, approved by a unanimous vote.
