09-02-1997 Regular MeetingCITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION SEPTEMBER 2, 1997 The meeting of the Planning & Zoning Commission was called to order Tuesday, September 2, 1997 at ?:40 P.M. by Chairman Robert Smythe. Members present were Keith Mullins, Darryl Bishop, Joseph Janusiak, Marilyn MacI.,auchlin, Joseph Wiebush, Michael Floyd and Bill Rauch. Also attending were Lanny Harker, Director of Planning and Mimi Shaw Ogden, Planning Technician. MINUTES of the Planning and Zoning Commission meeting held June 3, 1997 were approved as presented. 1. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT: Clermont Venture Ltd. LOCATION: Clermont Regional Shopping Center REQUEST: A Conditional Use Permit to amend Resolution No. 825 to allow the erection of a ground sign on each of the two (2) shopping center out-parcels. Mr. Harker explained that the shopping centers original CUP and amendments thereto, were approved under the old Land Development Regulations and therefore did not make provisions for ground signs for the out-parcels. The present Land Development Regulations do allow for the erection of ground signs on shopping center out-parcels. The requested action will simply provide consistency between the existing shopping center Conditional Use Permit and applicable standards adopted in the current Land Development Regulations. Based upon consistency with the adopted Land Development Regulations, Staff recommends approval of this Conditional Use Permit with the following conditions: The out-parcel ground signs shall comply with all sign regulations, including but not limited to size, height and setback requirements. 2. Approval of the proposed use shall be conditioned upon compliance with all previous conditions specified in Resolutions 773, 811 and 825, respectively. 3. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and/or successors in title or interest. 4. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by Resolution. A motion was made by Marilyn MacLauchlin to recommend approval to the City Council as presented by staff, seconded by Joseph Janusiak and approved by a unanimous vote. • CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION SEPTEMBER 2, 1997 Page - 2 - At this time Principal Planner Barry Brown briefly explained to the Commission that he is in the process of preparing the Evaluation and Appraisal Report (EAR) that must be transmitted to DCA in the near future. As the Local Planning Agency, this body is responsible for preparing the EAR report. Hence, it will be necessary to have several special Planning and Zoning Commission meetings where portions of the EAR will be reviewed as they are completed.
