PLANNING AND ZONING COMMISSION
JANUARY 7, 1997
The meeting of the Planning & Zoning Commission was called to order Tuesday, January
7, 1997 at 7:00 P.M. by Chairman Robert Smythe. Members present were Keith Mullins,
James Brown, Darryl Bishop, Joseph Janusiak, Joseph Wiebush and Marilyn
MacLauchlin. Member Bill Rauch was absent. Also attending were Lanny Harker,
Director of Planning and Mimi Shaw Ogden, Planning Technician.
MINUTES of the Planning and Zoning Commission meeting held December 3, 1996
were approved as presented.
1. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: Alfred H. Earls
LOCATION: 898 West Montrose Street
REQUEST: A request for a Conditional Use Permit to allow the expansion of an existing
service station in the Central Business District (CBD)
Mr. Harker explained that the applicant has requested that this case be postponed until
the next scheduled meeting of the Planning and Zoning Commission.
2. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: Herb Smith Construction
LEGAL DESCRIPTION: Lots 28, 29, 30, 31 and 32, Edgewood Lakes
GENERAL LOCATION: Southwest corner of Bloxam Avenue and Division Street
REQUEST: To amend Resolution No. 776 to allow the construction of aMulti-family
development, consisting of four (4) quadruplexs.
Mr. Harker explained that the applicant is requesting an amendment to the existing
Conditional Use Permit for a Planned Unit Development in the existing R-3
(Residential/Professional) and C-2 (General Commercial Business) districts located at the
northwest corner of the intersection of Grand Highway and U.S. 27. The request is to
allow construction of four (4) quadruplexs along Bloxam Avenue as opposed to five (5)
single family units as originally approved.
The requested action is a response to existing, severe elevation (slope) differences that
occur between the right-of--way and the rear lot lines of the subject properties.
Essentially, the existing elevation differences do not realistically permit the construction
of single family structures due to the excessive relief that exists on the subject lots.

The lots in question lie directly across Bloxam Street (west) from the previously
permitted and constructed multi-family units approved by the original Conditional Use
Permit. Ingress/egress and parking of tenant vehicles can be accommodated along the
rear property line of the proposed residences without encroachment into defined single
family areas of the Planned Unit Development.
Mr. Harker further stated that the proposed request is consistent with the UD-3 and
UD-4 (undeveloped district) future land use district designations and the general future
land use map classifications for the proposed uses.
Staff recommends approval of the amendment for additional multi-family residences
subject to the previous conditions of Resolution No. 776 and the following conditions:
1. The conditions as set forth in this Conditional Use Permit shall be legally binding
upon any heirs,. assigns and successors in title or interest.
2. No further expansion of the use or additions to this PUD shall be permitted
except as approved by another Conditional Use Permit.
3. The property shall be developed in substantial accordance with an approved site
plan incorporating all conditions of this Conditional Use Permit. Said plans
shall be submitted for review and approval of the Site Review Committee prior to
authorization and issuance of a development permit.
4. All ~ylicable rules and regulations for development within the City shall be met,
including but not limited to, final site plan approval, landscaping, drainage,
parking and sign regulations, and all yard setbacks. All required landscaping must
be served with a permanent irrigation system and must be properly maintained.
The drainage and stormwater retention requirements of the City and the
appropriate regulatory agencies shall be met, and approved by the City Engineer.
These areas shall be properly maintained.
5. All inspection costs will be borne by the applicant. This shall include final
inspection and ongoing random inspections for compliance with Conditional Use
Permits conditions.
6. Sidewalks shall be required along all road frontages in accordance with adopted
City Codes.

7. Buffering, screening and placement of approved trees shall be required in
accordance with adopted City Codes and in conformance with the approved site
and landscaping plan approved by the City Site Review Committee.
8. All dumpster and other equipment sites shall be enclosed with masonry structures
and landscaped in accordance with plans approved by the City Site Review
Committee.
9. All signage shall conform to adopted City Codes and Regulations.
10. A St. John's River Water Management District stormwater permit or letter of
exemption shall be required and filed with the City prior to receipt of a building
permit or any development activity.
11. If any of the stated conditions are violated, the applicant understands and agrees
that the City Council may revoke this Conditional Use Permit by resolution.
12. This permit shall become null and void if substantial construction work has not
begun within one (1) year of the date of issuance of this Conditional Use Permit.
"Substantial construction work" means the commencement and continuous
prosecution of construction of reauired improvements ultimately finalized at
completion.
At this time Chairman Smythe asked all those present who wished to speak in regard to
this case be sworn in.
Persons sworn in were Herb Smith of 223 Bloxam Avenue, Clermont, Florida.
Member Keith Mullins noted that is would appear that the parking lot would be abutting
the water retention area.
Planning Director Harker stated that this was correct. In review of this project Staff
realized that it would be very difficult to develop this as single family residential with
driveways exiting onto Bloxam Avenue. With the proposed site plan Mr. Smith has
presented for the multifamily units it would appear that the ingress/egress will be much
more equitable for everyone.
Mr. Smith explained to the Commission that this property lies at the bottom of the hill
on Bloxam Avenue, which would make it difficult for single family residential units to
back out onto Bloxam Avenue, especially with the excessive speed of cars going down
that hill.

A motion was made by Marilyn MacLauchlin to recommend approval to the City Council
as presented by staff, seconded by Keith Mullins, approved by a unanimous vote.
There being no further business the meeting was adjourned.
