11-05-1996 Regular Meeting• CITY OF CLF.RMONT MINUTES PLANNING AND ZONING COMMISSION NOVEMBER 5, 1996 The meeting of the Planning & Zoning Commission was called to order Tuesday, November 5, 1996 at 7:00 P.M. by Chairman Robert Smythe. Members present were Keith Mullins, James Brown, Darryl Bishop and Bill Rauch. Member Joseph Janusiak, Joseph Wiebush and Marilyn MacLauchlin were absent. Also attending were Lanny Harker, Director of Planning and Mimi Shaw Ogden, Planning Technician. MINUTES of the Planning and Zoning Commission meeting held October 1, 1996 were approved as presented. 1. REQUEST FOR REZONING APPLICANT: Dixie E. Royal, Jr. and David S. Royal LEGAL DESCRIPTION: Tract 30, Lake Highlands Company Subdivision, Sec. 20, Twnshp. 22, Rng. 26. GENERAL LOCATION: Parcel generally located approximately 3,300 feet east of Grand Highway and 3,960 feet north of SR 50. REQUEST: Rezoning from UE Urban Estate to R-1 Urban Residential District. Mr. Harker stated that the subject site, containing 10 +\- acres, is located east of the existing Northridge Subdivision. At the time the property will be annexed into the City of Clermont it will automatically receive designation as Urban Estate (UE) which requires a one (1) acre lot size. The owner of this site is requesting rezoning to R-1, Urban Residential District, for the property described above. However, modification of the R-1 to include certain R-1-A specifications, similar to the Northridge Subdivision development scenario, has been requested. The property was historically utilized as a citrus grove but since the freezes of the 1980,s that form of agricultural has been terminated and the site has remained dormant to this time. Discussion with the applicant has occurred concerning development in the same manner as the Northridge Subdivision where larger lot (R-1-A, lot size and frontage) platting would occur. The applicant has requested entering a predevelopment agreement with the City where lot requirements would mirror those of the Northridge Subdivision. This scenario for rezoning and development has been approved by the City Council for various adjoining properties in recent meetings. In order to maintain continuity with the existing and recently approved development pattern for this area, a predevelopment agreement consistent with previous City actions should be executed. Existing land use of surrounding properties shows residential to the west (Northridge Subdivision), and vacant/agriculture to the east, north and south. • • Cl7Y OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION NOVEMBER 5, 1996 Page-2- Mr. Harker further explained that the City Comprehensive Plan and zoning of adjacent property indicates a residential expansion pattern for the area. The applicant has indicated future development as residential. Based upon consistency with the approved Comprehensive Plans of the City and County, Staff recommends approval of the rezoning from UE (Urban Estate District) to R-1 (Urban Residential District) subject to formal execution of a predevelopment agreement. A motion was made by Keith Mullins to recommend approval of this rezoning to the City Council, seconded by Bill Rauch and approved by a unanimous vote. 2. REQUEST FOR REZONING APPLICANT: City Council REQUEST: Lots I1, 13, I5, 17 and 19 of Block 93 and parcel bounded on the south by Osceola Street, on the west by West Avenue, on the east by Eighth Street and on the north by Lake Minneola. FROM R-3 RESIDENTIAL/PROFESSIONAL DISTRICT TO CBD CENTRAL BUSINESS DISTRICT And Lots 12, 14, 16, 18 and 20 of Block 93; Lots 1 through 6 of Block 94; And a portion of closed Osceola Street lying west of West Avenue and parcel located north of said closed Osceola Street and Lake Minneola. FROM C-1 LIGHT COMMERCIAL DISTRICT TO CBD CENTRAL BUSINESS DISTRICT Mr. Harker explained that the City Council is initiating rezoning of the present residential and commercial properties located between West Lake and Eighth Street, and Minneola Avenue and Lake Minneola from R-3 and C-1 to CBD to facilitate requests made by the existing property owners, and permit complementary expansion of the Central Business District. The rezoning will amend only those properties situated within City Blocks #93 and #94 that have not already been requested and approved for rezoning to CBD. The proposed action is simply a continuation of the prevailing development pattern within the lake frontldowntown business area. Surrounding zoning of the area is C-2 to the south, C-1 and M-1 to the west, R-3 to the east, and Lake Minneola to the north. ,! CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION NOVEMBER 5, 1996 Page - 3 - The proposed zoning classification CBD is consistent with the Future Land Use District designation (EBD-1, Established Business District) which would allow commercial, residential, and professional office uses. It is also compatible with Future Land Use Map directives which indicate mixed commercial, residential, and professional office use development to occur in this transitional area of the City. Based upon consistency with existing development patterns, and demonstrated compliance with Future Land Use directives for the area, Staff recommends approval of this request for rezoning from R-3 and C-1 to CBD. At this time Chairman Smythe asked all those present who wished to speak in regard to this case be sworn in. Persons sworn in were Ahmad Saidi, part owner of Lake Minneola Trust, which is the property west of the City pier. Mr. Saidi asked if the CBD zoning would still allow the construction of condominiums. Mr. Harker noted that this may require a CUP, not having the Land Development Regulations with him, Mr. Harker noted that he believed amulti-family type use such as condominiums would require a CUP in the CBD zoning district. After further discussion, a motion was made by Bill Rauch to recommend approval of the rezoning to the City Council, seconded by Darryl Bishop and approved by a unanimous vote.
