PLANNING AND ZONING COMMISSION
AUGUST 6, 1996
The meeting of the Planning & Zoning Commission was called to order Tuesday, August
6, 1996 at 7:00 P.M. by Chairman Robert Smythe. Members present were Joseph
Janusiak, Joseph Wiebush, Marilyn Macl.auchlin and Bill Rauch. Members Wendell
McDannel, Keith Mullins, James Brown and Darryl Bishop were absent. Also attending
were Lanny Harker, Director of Planning and Mimi Shaw Ogden, Planning Technician.
MINUTES of the Planning and Zoning Commission meeting held July 2, 1996 were
approved as presented.
1. REQUEST FOR REZONING
APPLICANT: Tracy B. McT.,emore
LEGAL DESCRIPTION: Lots 28, 29 and 30 of Hillcrest Subdivision
GENERAL LOCATION: Prince Edward Avenue
REQUEST: Rezoning from R-1 Urban Residential District to R-2 Medium Density
Residential District.
Planning Director Harker explained that the applicant is requesting rezoning of three (3)
lots located on the west side of Prince Edward Avenue, approximately 150 feet south of
the intersection with Pitt Street. The petition is a request to provide consistency between
the existing, physical land use of the property and the overlying zoning established for
the three lots specified. Essentially, the three subject lots are a portion of an existing
multi-family development that encompass lots 21 through 30, inclusive.
According to documentation provided from the Lake County Property Appraisers .office,
the duplex and quadruplex located on lots 28, 29, and 30 were constructed in 1963 and
1966, respectively. As of todays date, the land use and zoning classification remain
inconsistent. In effect, the units are considered non-conforming and under City Code
could not be rebuilt in the event of a disaster.
In an effort to provide future compatibility and reconcile the historic inconsistency
between land use and overlying zoning, City Staff recommends approval of the rezoning
from R-1 Urban Residential District to R-2 Medium Density Residential District.
A motion was made by Marilyn MacLauchlin to recommend approval of this rezoning to
the City Council, seconded by Bill Rauch and approved by a unanimous vote.
