MINUTES
PLANNING & ZONING COMMISSION
December 1, 1992
The meeting of the Planning & Zoning Commission was called to order Tuesday,
December 1, 1992 at 7:30 P.M. by Chairman John Sargent. Members present were
Don Smith, James Brown, Joseph Janusiak, Joseph Wiebush, Wendelt Mcllannel, Ji-n
Hoskinson and Marilyn George. Member Bonnie Kranz was absent. Also attending
were Lanny Harker llirector of Planning and Mimi Shaw Planning 't'echnician.
MINUTES of the meeting held November 3, 1992 were approved as presented.
NEW BUSINESS:
1. REQUEST FOR CONDITIONAL USE PERMIT
APPLICANT: Putt-A-Round, Inc.
LOCATION: 857 E. Minnehaha Avenue
REQUEST: A request for a Conditional Use Permit to allow the addition of batting
cages to an existing miniature golf course located in the C-2 General
Commercial Business District.
Mr. Harker informed the Commission that the applicant is requesting a Conditional
Use Permit for the addition of four (4) batting cages. The site is located in the C-2
zoning district and the UD-2 future land use district which provides designation for
highway commercial, tourist accommodations and park and recreation uses. The
proposed request is also consistent with directives of the i'uture land use map which
indicates provision of commercial oriented uses.
'The surrounding land uses Include U.S. Illghway 27 to the cast, commercial
development to the north, single family residential to the west, and multi-family use
(Oak Ridge Apanments) to the south.
Mr. Harker further stated that staff therefore recommends approval of the CUP n-ith
the following conditions:
1. 1'he conditions as set forth in thls Conditional Usc 1'crmit shall be legally
binding upon any heirs, assigns and successors in title or interest.
2. The property shall be developed in substantial accordance with an approved
site plan incorporating all conditions of this Conditional Use Permit. Said plans
shall be submitted for review and approval of the Site Review Commlttee prior
to authorization and issuance of a development permit.
3. The applicant shall provide the Site Review Committee with a development
plan that indicates methods, forms and materials that s~iall be used to ensure
acceptable levels of noise buffering and visual screening from adjacent
properties.
At this point Mr. Harker noted that the recommendation included in the Commissions
packet for condition #4 suggested the hours of operation be 9:00 a.m. to 10:00 p.m.
Sunday through Thursday and 9:00 a.m. to 11:00 p.m. on Fridays and Saturdays.
However after further discussion with the City Manager, staff would like to change this
recommendation to the following:

4. The applicant shall agree to operate the batting cage facilities between the
hours of 9:00 a.m. to 9:00 p.m. Sunday through Thursday and 9:OO a.m. to
10:00 p.m. on Fridays and Saturdays.
5. All lighting for the proposed facility shall be designed and located such that
light and/or glare shall be directed upon the subject property only.
At this time Mr. Sargent asked all those present who wished to speak in regard to this
case be sworn in.
Persons sworn in were:
Nick Graviano, 1152 Chestnut Street, Clermont, Florida and ltichard Genaitis, 121113
Cypress Lane, Clermont, Florida (applicants).
Mr. Genaitis explained the scope of the project to the Commission.
Wendell McDannel asked if the applicants had any problem with the: hours oi'
operation set for the facility.
Mr. Genaitis stated this was the first time they were informed of the hours. Noting
that he is disappointed with these hours of operation. The balls used in the bauin};
cages do not make as much noise as regular softballs and baseballs due to the fact chat
they are constructed of rubber. Therefore, the noise level will not disturb the
surrounding residential neighbors.
Mr. Sargent noted that the Commission could add a condition to the CUP that if at a
later date the noise proved to be a problem to the surrounding property owners soiree
modification be made to the equipment or some other means to lessen or eliminate
the noise.
Mr. Genaitis stated that they wanted to be a good neighbor to the surrounding
property owners and that they have taken a very personal interest in providing a very
clean, nice facility, and will continue to do that.
Nick Graviano, applicant, presented a sample of the. two types of balls that am used in
the batting cages to the Commission. Mr. Graviano also informed the Commission
that the golf course is currently open until 10:00 p.m. Sunday thru Thursday and
11:00 p.m. on Fridays and Saturdays. They have not had any complaints for the
surrounding property owners.
Jim Hoskinson stated he felt the earlier hours would be better.
Further discussion followed regarding the hours of operation.
A motion was made by Don Smith to recommend approval to the Ciry Council as
presented by staff with the hours of operation (Condition #4) being from 9:00 a.m. to
10:00 p.m. Sunday through Thursday and 9:00 a.m. to 11:00 p.m. on Fridays and
Saturdays, seconded by Joseph Wiebush. Approved by a vote of 7 to 1 with Mr.
Hoskinson voting nay.
2. REQUEST FOR REZONING
APPLICANT: South Lake Memorial Hospital, Inc.
LOCATION: Approximately 1320' north of Highway 50 on the east side of East Jacks
Lake Road
REQUEST: A request for Rezoning -from RR (Rural Residential District) to I2-3
(ResidentiaUProfessional District).

Mr. Sargent questioned whether this request could be heard by the Commission, as
there was no one present to represent the applicant.
Further discussion followed.
A motion was made by Don Smith to table this request until the January 5, 1993,
seconded by Joseph Janusiak, approved by a unanimous vote.
There being no further business the meeting was adjourned.
