01-07-1992 Regular Meeting• • MINUTES PLANNING & ZONING COMMISSION January ?, 1992 The meeting of the Planning &_Zoning Commission was called to order Tuesday, January 7, 1992 at 7:30 P.M. by Chairman John Sargent. Members present were Don Smith, Adelbert Evans, Joseph Wiebush and Wendell McDannel. Members Marilyn George, Bonnie Kranz and James Brown were absent. Also attending were Lanny Harker Planning Director and Mimi Shaw Planning Technician. MINUTES of the meeting held November 5, 1991 were approved as presented. NEW BUSINESS: 1. REQUEST FOR REZONING APPLICANT: Highway 50 Trust, J. M. VanderMeer, Trustee OWNER: Highway 50 Trust, J. M. VanderMeer, Trustee LEGAL DESCRIPTION: Clermont Fairview Place. South 105' of Lots 18, 19, 20, 21, 22, 23, South 105' of East 120' of Unnumbered Block, South 105' Closed Carrie Street, South 105' of West 30' of Closed Strickland Street. GENERAL LOCATION: Approximately 150 feet East of Disston Avenue on the North side. of Minnehaha Avenue. ZONING: Present: R-1-A (Urban Residential District) Proposed: R-1 (Urban Residential District) Mr. Harker stated that the R-1-A urban residential district is a low density residential district as opposed to the R-1 which is designated as a medium density urban residential district. The site is located on the north side of Minnehaha Avenue, basically equidistant between Disston and Bloxam Avenues. It is in an area of the City that demonstrates a significant transitional range of land uses from single family residential to the higher density and intensity multi-family, professional office, and commercial pattern of development. Both the adopted Future Land Use Map and Land Use District classification (NED-5) indicate the proposed use is compatible with future planning activities designated for the area. Mr. Harker stated the primary differences occurring between the two Single Family Districts are: R-1-A R-1 Lot Size 10,000 sq. ft. 7,500 sq. ft. Lot Width 100 Ln. ft. 75 Ln. ft. Living Area 1,200 sq. ft. 1,000 sq. ft. Du.J Acre 4.3 Du./Ac. 5.8 Du./Ac. Mr. Harker further stated that the principal difference between the existing and proposed land use of this particular site is the R-1 District will allow one (1) additional detached single family residence beyond that presently allowed by the R-1-A District (i.e. six lots vs five lots). 1 • • Staff recommends approval of the Zoning District change from R-1-A to R-1 based upon the transitional nature of the general area, the existing higher density pattern (duplex and multi-family) of adjacent and surrounding land uses, and location of the logical physical boundary, Minnehaha Avenue, that effectively separates the established low density residential use from the proposed higher density uses. Mr. Jay VanderMeer, applicant, noted, going in an easterly direction from the corner of Disston Avenue and Minnehaha Avenue, that the parcel on the corner is 140' x 150', the next lot is 102' wide and the next parcel is 100' wide, between the first and second lots a sewer easement has been given to the City, these two lots would remain as they are. There would then be four more lots all being 77' in width. This would basically give one additional building lot. He feels this would be a good trade off with the high density that is behind this parcel and the mixed uses that are across the street. Mr. James Edward, resident of the Willows, stated that he was not here to speak only for himself but to speak for the members of the homeowners association of the Willows, who were unable to be here tonight. The homeowners feel that this is not in the best interest of the people in the Willows. Most of the residents find it a very nice place to live.- A good number of these people are long time residents of this area. The association is not against young people, they would like to see changes in the construction laws made so that true low cost starter houses could be built for young people. But they do feel it would be a mistake to put two different life styles so close to each other. Mr. Edwards further stated he has spoken with somewhere between seven and twelve people and they have stated that they would be friendly to the construction of units like there own (i.e. the Willows). They would like to encourage neighbors that are much like themselves (i.e. childless, single, married couples and. retirees). They are concerned with stability, because they feel that some people will relocate when children move next door. Our designation as an adult community will not stand up under present law, so there is no way we can prevent people with children from occupying vacant units. We would like the board to consider this request on humanitarian basis rather than just legal. Mr. Smith asked Mr. Edwards exactly what the association was asking for. Mr. Edwards clarified that they wanted no additional units to be accommodated. Mrs. Pat McCaffrey, owner of a townhome in the Willows, was present and stated that she personally did not have anything against the proposed plan. Mr. VanderMeer, clarified that this request would allow the creation of one additional lot, however, he had no idea as to who would purchase these lots, retired people or people with children, he would not have control over that. The fact that an additional parcel can be created will most likely lend itself towards a smaller type home. A motion was made by Wendell McDannel that the Commission recommend to the City Council approval of this request as presented by staff, seconded by Don Smith.
