07-05-1988 Regular Meeting• • CITYOF CLERMONT MINUTES PLANNING & ZONING COMMISSION JULY 5, 1988 The regular scheduled meeting of the Planning & Zoning Commission meeting was called to order on July 5, 1988 at 7:30 p.m. by Chairman John Sargent. Members attending were Adlebert Evans, Debbie Gaines, Cecil Smart, Don Smith, Marilyn George, Bonnie Kranz, Curt DiCamillo and Rob Mitchell. Also attending were James McAllister Planning Director and Jane Warren Planning and Zoning Technician. MINUTES of the meeting held June 7, 1988 were approved as presented. NEW BUSINESS Mr. Sargent introduces item NO. 1. REQUEST FOR CONDITIONAL USE PERMIT Dal-Don Produce Inc. 1959 So. Highway 27 Mr. Sargent stated the request is to expand the existing facilities to include a refrigerated warehouse, office and approximately 29,000 sq. ft. of paved parking loading area. Mr. Sargent asked for staff's recommendation. Mr. McAllister stated there are numerous issues associated with the proposed project, the most important being the access issue. The existing situation is such that there is no deceleration lane northbound on 27 for vehicles to safely slow down before entering the facility. US 27 is a four lane median divided highway with a design speed and normal operating speed of 55 mile per hour and as such requires some sort of control access. To facilitate safe entering and exiting of this project, it is recommended that the existing 200+ feet wide access point be reconstructed so as to provide for two (2) 40 foot wide access points with a curbed landscaped area lying between the two access points. Mr. McAllister also suggested the construction of a deceleration lane northbound on US 27 and acceleration lanes northbound and southbound on US 27, to further facilitate safe and efficient traffic flow. Mr. McAllister pointed out that there are numerous oak trees on the site which should be preserved. Mr. McAllister recommended approval of this Conditional Use Permit request with the addition of the following conditions to the standard Conditional Use Permit. 9. Construction of NB deceleration lane be completed before a Certificate of Occupancy is issued. 10. Construction of acceleration and deceleration lanes shall be completed within eighteen (18} months on the approval date of the Conditional Use Permit. 1 • • CITY OF CLERMONT MINUTES 11. No paving or grade change of any kind will take place closer to trees than what is designated on the site plan. Posts shall be used as protective barriers to the roots and trunks of every tree to be saved. Absolutely no equipment of any kind will be stored within the protected area and any landscaping activity within this area shall be by hand labor only. 12. Site will conform to existing Clermont Sign Code and applicant shall apply for an Open Air Sales Permit to legitimize existing open air fruit stand. 13. Applicant will tie into City sewer when available and septic tank use will be discontinued. Impact fees will be assessed at that time. 14. Refrigerated warehouse will operate as a "dry operation" only. 15. The reconstruction of access points shall include one sixty (60) foot access point and one forty (40) foot access point. 16. Road improvements will be based on final FDOT approval. 17. Performance Bond, Cash Bond, Letter of Credit or Lenders Agreement be obtain to insure the completion of all off-site improvements. Mr. McAllister informed the Commission that no public input either in favor or in opposition to this request has been received. Mr. Rick McCoy, engineer for the project, was presented and stated he was in agreement with the recommended conditions. Mr. Smart questioned the need for a "dry operation" as requested in Condition No. 14. Mr. McAllister explained the produce is hosed down, therefore creating a run off of contaminated water from the pesticides on the produce. After a brief discussion a motion by Mr. Smart to recommend to the City Council approval of this request as presented, seconded by Mr. Mitchell and approved by unanimous vote. Mr. Sargent introduces item NO. 2. REQUEST FOR CONDITIONAL USE PERMIT Joka Properties Inc. 501 Almond Street Mr. Sargent explained the request is to allow the construction of Professional Offices in the R-3 Residential District with a variance to the point of access for parking that will be extended in the residential district. Mr. Sargent asked for staff's recommendation. 2 • • CITY OF CLERMONT MINUTES Mr. McAllister informed the Commission that the applicant submitted a site plan for staff review on June 15, 1988. The plan was found to be deficient and consequently, needed to be redrawn and resubmitted for a second review. The applicant was not able to receive site plan approval before the one (1) year expiration date on the Conditional Use Permit, June 23, 1988, hence the request for an extention. Mr. McAllister recommended approval of this request as granted by Resolution No. 556 with the following revisions: Condition No. 7. This permit shall expire if construction has not begun within ninety (90) days of the date of this Conditional Use Permit. Condition No. 9. Sidewalks along Disston and Almond Street shall be constructed simultaneous. Mr. McAllister also requested that the Commission address the issue of the future use of the existing office building and its future use. Mr. McAllister suggested if the building is to remain vacant it should be removed. Mr. Mitchell questioned why staff was recommending a ninety (90) day restriction in Condition No. 7. Mr. McAllister explained that Mr. Dougherty is essentially requesting an extention of his original Conditional Use Permit and ninety (90} days would be sufficient time to comply. Mr. Dougherty stated that he felt more than ninety (90) days would be needed to apply to all the required regulatory agencies and to also have the necessary revisions made to the site plan. Mr. Dougherty stated he agreed that the current building is an eyesore, but suggested that there are other buildings on Highway 50 that are more detrimental in appearance than his building, that would not be condemned by the City. Mrs. Gaines suggested Mr. Dougherty's rights as a property owner would be imposed on if he were required to removed a structurally sound building for appearance reasons. Mr. Dougherty pointed out that the sidewalks if constructed as recommended would be damaged by large construction trucks having to drive over them during the completion of Phase II. Mr. Smith agreed with Mr. Dougherty regarding the construction of sidewalks and suggested that the sidewalks be constructed along Almond and Disston Street in Phase II. After a brief discussion a motion was made by Mr. Smith to recommend to the City Council approval of this request with the following revision: 9. Sidewalk will be constructed along the entire west side property line from Hill Street to Almond Street. 3 • CITYOF CLERMONT MINUTES • Motion was seconded by Cecil Smart and approved by unanimous vote.
