MINUTES
PLANNING AND ZONING COMMISSION
The regular scheduled meeting of the Planning and Zoning
Commission was called to order on November 3, 1987 at 8:10 p.m.
by Chairman John Sargent. Members attending were Don Smith, Curt
DiCamillo, Cecil Smart, Debbie Gaines, Marilyn George, Ron Carden
and Buck Evans. Member Dorothy McGriff was excused. Also
attending were Jim McAllister City Planner, and Jane Warren
Planning and Zoning Technician.
Mr. Sargent introduced Jim McAllister, the new Planning Director
to the Planning and Zoning Commission.
MINUTES of the meeting held October 6, 1987 were approved as
presented.

Conditional Use Permit

The owner is requesting the addition of a 308 sq. ft. storage
area on the north of the building as indicated on the enclosed
site plan. The attached addendum states that two additional
parking spaces will be designated for the additional square
footage.
Mr. Sargent requested staff's recommendations.
In his memo to the Planning and Zoning Commission, Mr. Saunders
referred to Article IX Section (D) of the Zoning Ordinance which
states that in granting a Conditional Use Permit the City Council
may impose such conditions as it deems necessary and desirable
to protect the public health, safety and welfare in accordance
with the purpose and intent of the Zoning Ordinance.
Mr. Saunders pointed out that the shopping center is deficient
in two major areas. The storm water retention is below standard
and the required parking is short by approximately 100 spaces
under todays standards. Very little can be done about the
parking due to space not being available, but one relatively
minor change could be made to greatly improve the stormwater
runoff. At present a large quanity of water leaves the property
at the south west corner east of Kentucky Fried Chicken, floods
the sidewalks and spills into an already overloaded D O T
drainage. This could be easily diverted into the oversized
retention area in front Kentucky Fried Chicken.
Mr. Saunders recommended approval of this with request with the
following conditions:
1. The property must be developed in substantial accordance
with an approved site plan.
2. If, at a future date, parking at this site proves inade-
quate, the applicant understands and agrees that the City
may require additional parking or rescind this Conditional
Use Permit.
3. No further expansion of the use or additions to this
facility shall be permitted except as approved by another
Conditional Use Permit.

4. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, drainage, parking and
sign regulations, and all yard setbacks. All required
landscaping must be served with a permanent irrigation
system and must be properly maintained. The drainage and
stormwater retention requirements of the appropriate
regulatory agencies must be met, and approved by the City
Engineer. These areas must be properly maintained.
5. This addition may be used as a storage area only. No other
business operation may be conducted from this facility. This
Conditional Use Permit is not transferable to any other
business use, person or corporation.
6. The final Certificate of Occupancy cannot be issued until
each of the stated conditions has been met.
7. This permit shall expire if construction has not begun
within one year of the date of this Conditional Use Permit.
8. If any of the stated conditions are violated, the applicant
understands and agrees that the City Council may revoke this
Conditional Use Permit by resolution.
9. Necessary alteration to the south west corner~of the parking
area shall be made to divert stormwater now leaving the
property into the retention area in front of Kentucky Fried
Chicken.
Mr. Chris Giachetti was present as a representative of the owner,
John Hurtak, and stated his client would be willing to comply
with the stated conditions.
Mr. Smith expressed his concerns regarding the capacity and
capability of the retention area in front of Kentucky Fried
Chicken as far as handling additional runoff, and also to the
eventual build up of oil on the bottom of the pit which could
hamper the normal percolation. .
Mr. Giachetti stated that the shopping center owned the retention
area and could divert the water to the retention area several
ways. Mr. Giachetti also pointed out the size of the retention
area is larger than suggested by engineers at the time of
construction of the Kentucky Fried Chicken Restaurant.
Mr. Evans pointed out that the swales around the retention area
are both bionic, and if there should be a build up of oil in the
area the vegetation would begin to die and would signal a slow
down in percolation.
After a brief discussion a motion was made by Marilyn George to
recommend to the City Council approval of this request, seconded
by Ron Carden and approved by unanimous vote.
There being no further business the meeting was adjourned.
