Mrs. Barbara Ramos was present and stated :she had spoken to many of the residents in the area and felt such a facility would k>e an asset to the community. l • CITY OF CLERMONT MINUTES Mr. George Karst, owner of the property was present and stated it was his intention to improve the appearance of the property and to bring the site up to code, but felt all of the conditions listed would create a financial hardship. Mr Karst stated the conditions listed would be applicable to a new building and requested that the Planning and Zoning Commission work with him in a way that would be economically feasible. Mr. Saunders agreed with Mr. Karst, and stated all the conditions listed would be applicable to a new building, but felt it would be advantegous to work with Mr. Karst and improve the site in a way that would be agreeable to the City and the property owner. After much discussion the Planning and Zoning Commission decided to review each of the stated conditions. Conditions NO. 1, 2, 3, 6, 7, 8, 10, 11, and 13 were recommended for approval. Condition No. 12 was recommended to be deleted. Condition No. 4 Mr. Saunders stated there would not be any additional drainage requirements, as long as there were no additonal paving . Mr. Saunders also suggested rather than having all the required landscaping buffers, that a buffer on the west property line which joins the residential use would be sufficient. Recommended Condition No. 4 4. All applicable rules and regulations shall be met, including final site plan approval, parking and sign regulations, and all yard setbacks. The right-of-way area on Fifth Street may be utilized for ingress and egress and turn around area. Condition No. 5. Mr. Karst stated that in the future he plans to use the area shown on the site drawing as the "tin addition" as a office for himself and questioned if he would need to request a Conditional Use Permit at that time. Mrs. George suggested that the permit should clarify the portion of the property addressed in this request. Recommended No. 5. 5.This portion of property addressed in the Conditional Use Permit may be used as a day care center only. No other use business operation may be conducted from this facility. This Conditional Use Permit is not transferable to any other business use, person or corporation. Conditions No. 9. Mrs. George pointed out if the applicants complied with this condition it would include all the city's right-of-way up to the applicant's property line. Mr. Smith suggested eliminating the sidewalk and require that some type of curbing be required with a defined ingress and egress. Mr. Smith expressed his concerns regarding the traffic going in and out on the property line without a established route. 2 i ~ CITY OF CGERuONT MINUTES Mr. Sargent suggest eliminating this condition, and working with the applicant for something that would be agreeable to the city and na so costly to the applicant. Mr. Smith suggested the paving of the parking and sidewalk areas and having these areas delinated with paint, as a cost saving alternative for the applicant. Recommended No. 9 9. Paving will be required from the street to the edge of the property with delinated sidewalk. Condition No. 11. Mrs. George suggested that a four (4) foot high fence be constructed on the north an east boundaries. Mrs. Gaines also suggested that the irrigation be address in this condition. Recommended Condition No. 11. 11.A 6'high solid fence with required landscaping to be constructed on the west property line and a 4' high fence fence on the north and east boundaries of the playground. After further discussion a motion was made by Mrs. George to recommend to the City Council approval of the Conditional Use request with the recommended changes, seconded by Mr. Carden and approved by unanimous vote At this time Mr. Saunders recommended that the Planning and Zoning Commission review the attendance records of Gloria Johnson and recommend to the City Council replacement of Mrs. Johnson. Mr. Saunders pointed out that Mrs. Johnson has been absent 8 of the last nine meeting. Mr. Saunders also stated that the Code of Ordinances for the Planning and Zoning Commission states that any member who accumulates three consecutive absences may upon recommendation from the Planning and Zoning Commission be removed from the commission by a majority vote of the City Council. Mrs. George stated she had spoken to Mrs. Johnson and she indicated that this appointment was more time consuming that she realize and would be like to be relieved from this responsibility. A motion was made by Mrs. George to recommend removal of Mrs. Johnson from the Planning and Zoning Commission to the City Council, seconded by Mr. Carden and approved by unanimous vote.
