This regular meeting of the Planning and Zoning Commission was
called to order at 7:30 p.m. on Tuesday, August 6, 1985 by
Chairman John N. Sargent.
• Roll Cal 1. The following members were present: Don Beal,
Adelbert Evans, Debbie Gaines, Nick Jones, Marie McKinney,
Herbert Rogers, Jr., John N. Sargent, James Shepherd and Bob
Thompson. Planning and Zoning Technician Marilyn George
represented the City.
Conditiona 1 Dse Permit. Mr. Sargent introduced a Conditional Use
Permit request by the Shepherd of the Hi 1 1 s Lutheran Church to
construct a new sanctuary building on property with the present
church structures.
Ms. George explained that the City staff suggested two conditions
peculiar to this request. The first (No. 2) recommended grass
parking in two of the three proposed parking areas, and the other
(No. 5) referred to drainage overflow.
The Reverend Mr. George Becker explained that the existing build-
ing will be used for educational, administrative and fellowship
purposes. He went on to say that a survey of other churches in
the City showed that none of them have the full number of parking
spaces required by the ordinance, and that the number proposed
for the Lutheran Church compared favorably with all other Cler-
mont churches.
• Mr. Beal stated that he would refrain from participating in the
discussion and from voting in the matter because of a conflict of
interest since he is a director of Lake County Bank, which owns
the adjacent property.
Mr. Evans asked that consideration be given to saving the oak
trees on the south part of the property, and that grass parking
be allowed in that area, because of the nature of the use of
church parking lots.
A lengthy discussion regarding parking requirements ensued,
during which it was pointed out that percolation in the area of
the north parking lot is poor, and that the lot should be paved.
A motion was made by Mr. Evans, seconded by Mrs.Gaines and
carried with one dissenting vote THAT CONDITION NO. 2 BE AMENDED
BY THE DELETION OF ALL BUT THE FIRST SENTENCE, AND THE ADDITION,
• BEFORE THE FIRST SENTENCE OF: SPACES 1 - 42 SHALL BE PAVED AND
SPACES 43 - 55 SHALL BE GRASS PARKING. Mr. Sargent voted nay
because he felt that spaces 1 through 28 should be left for grass
parking.
A motion was made by Mr. Evans, seconded by Mr. Shepherd and
approved by unanimous vote THAT IT BE RECOMMENDED TO CITY
COUNCIL THAT THE CONDITIONAL USE PERMIT FOR THE SHEPHERD OF THE
HILLS LUTHERAN CHURCH BE GRANTED SUBJECT TO THE FOLLOWING
CONDITIONS:
1. The property must be developed in substantial accordance
with an approved site plan.
2. Parking spaces 1 - 42 shall be paved and spaces 43 - 55
shall be grass parking. If, at a future date, parking at

this site proves inadequate, the applicant understands and.
agrees that the City may require more parking or rescind
this CUP.
3. No further expansion of the use or additions to this
facility shall be permitted except as approved by another
CUP.
4. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, drainage, parking and
sign regulations, and all yard setbacks. All required
landscaping must be served with a permanent irrigation sys-
tem and must be properly maintained. The drainage and
stormwater retention requirements of the Lake County Pollu-
tion Control Board and FAC 17-25 must be met and approved
by the City Engineer. These areas must be properly
maintained.
5. Drainage overflow must be provided to the inlet
approximately due east of the retention pond on East Avenue.
6. This property may be used only as a church. No other
business operation may be conducted from this facility.
• This CUP is not transferable to any other business use,
person or corporation.
7. The final certificate of occupancy cannot be issued until
each of the stated conditions has been met.
8. This permit shall expire if construction has not begun
within one year of the date of this CUP.
9. If any of the stated conditions is violated, the applicant
understands and agrees that the City Council may revoke this
CUP by resolution.
Attendance. Mr. Sargent emphasized the importance of regular
attendance by Commission members, and suggested that members who
had frequent conflicting activities should examine their priori-
ties, and resign if it appeared to be expedient.
There being no further business, the meeting was adjourned at
8 : 2 0 p.m.
