CODE ENFORCEMENT BOARD
WORKSHOP
JUNE 19, 2007
The workshop of the Code Enforcement Board was called to order Tuesday,
June 19, 2007 at 6:33 p.m. by Code Enforcement Board Attorney Valerie
Fuchs. Members present were Jim Purvis, Joe Janusiak, A. D. VanDeMark,
James Davern, and Les Booker. Also in attendance were Jim Hitt, Planning
Director, Betty McMinamen, Code Enforcement Officer, Valerie Fuchs,
Code Enforcement Board Attorney, and Joy Thys, Code Enforcement Clerk.
Terry Felder was absent.
Code Enforcement Board Attorney, Valerie Fuchs, presented a program
about Code Enforcement Procedures and General Matters Work Session.
Ms. Fuchs went over Chapter 162 of the Florida Statue regarding the duties
of the Code Enforcement Board, the rules and conduct of the hearings, etc.
The second item on the agenda was the explanation of aQuasi-Judicial
Board. Ms. Fuchs explained to the Board they are acting as judge and due
process has to govern the proceedings. Ms. Fuchs explained to the board
their decision needs to be based on substantial evidence and the Board is a
not a money making board but a compliance board.
Ms. Fuchs also went over due process. Ms. Fuchs advised the Board to be
careful in "lecturing" the Respondents' when they are in front of the Board,
especially the commercial owners. The board needs to protect itself from a
Respondent feeling they have been treated unfairly.
There being no further business, the meeting was adjourned.
