CODE ENFORCMENT BOARD
JUNE 19, 2007
The regular meeting of the Code Enforcement Board was called to order on Tuesday,
June 19, 2007 at 7:00 p.m. Members attending were James Purvis, Chairman, Joe
Janusiak, James Davern, A. D. Van Demark and Les Booker. Also attending were Betty
McMinamen, Code Enforcement Officer, Yvette Brown, City Attorney, Valerie Fuchs,
Code Enforcement Board Attorney, Jim Hitt, Planning and Zoning Director, and Joy
Thys, Code Enforcement Clerk. Terry Felder was absent.
Code Enforcement Chairman Jim Purvis read the Opening Remarks.
The Pledge of Allegiance was recited.
The minutes from the Code Enforcement Board Meeting of May 15, 2007 were
approved as written.
Code Enforcement Officer Betty McMinamen and everyone testifying were sworn in.
Jim Purvis gave the floor to Code Enforcement Staff and Attorney.
NEW BUSINESS
CASE NO. 07-343
Stephen V. Weaver, Jr.
2149 S. Waterview Drive
Clermont, FL 34711
LOCATION OF VIOLATION: 249 S. Waterview, Clermont, FL 34711
VIOLATION: Ordinance No. 281-C, Chapter 122, Section 122-348. Permit required for
Temporary Structures.
City Attorney introduced the above referenced case.
Code Enforcement Officer McMinamen presented the details of the case and
read the violation summary as follows: You are hereby notified that you are in
violation of the referenced section of the City of Clermont Code of Ordinances for
erecting three (3) temporary tent structures before first obtaining the required
permits from the City of Clermont along with City Council approval necessary for
these structures to remain an extended length of time. Compliance of this
violation will be when the two (2) enclosed-quonset-style temporary tent
structures in the rear yard of the property, along with the open-carport-style
structure over the front driveway, and the like, have all been properly permitted
as required by Ordinance or completely removed from the property.

Code Enforcement Officer McMinamen exhibited pictures that are a true and accurate
depiction of the condition of the property on the date taken.
City Attorney asked the Respondent be given until July 17, 2007 (30 days) in order to
comply. Ms. Brown said the Staff is recommending a fine of $50.00 a day pursuant to
Florida Statute section 162.09 (b) which states in determining the amount of the fine,
the Code Enforcement Board shall consider: 1) the gravity of the violation, 2) the actions
taken by the Respondent in order to correct the violation, and 3) any previous violations
by the Respondent.
Mr. Stephen V. Weaver of 2149 S. Waterview Drive, Clermont FL. 34711 was sworn in
and stated he has worked tirelessly on trying to bring his property into compliance. He
would like to get a permit in order to keep the tent on his property and would like to
know what he has to do so.
Code Enforcement Board Chairman Jim Purvis said he would need to speak to the
Planning and Zoning regarding getting a permit for this structure.
Les Booker made a motion to find the Respondent in violation of the cited City code and
be given until July 77, 2007 to comply or be fined at a rate of $50.00 per day; seconded
y Joe Janusiak. The vote was unanimous in favor of finding the Respondent in
violation, the time period, and the amount of the fine.
CASE NO. 07-344
Frank H. & Deborah L. Sachs

LOCATION OF VIOLATION: 1399 Legendary Blvd, Clermont, FL 34711
VIOLATION: Ordinance No. 281-C, Chapter 122, Section 122-344 (a). Building Permit
Required.
City Attorney introduced the above referenced case.
Code Enforcement Officer McMinamen presented the case and read the violation
summary as follows: You are hereby notified that you are in violation of the
referenced section of the City of Clermont Code of Ordinances due to, but not
limited to, the conversion of the 2-car garage into a living space, currently being
used as a family/recreation room after adding electrical lighting and air
conditioning, without first obtaining the required building permit necessary for

these renovations. Compliance of this violation will be when the zoning clearance
has been obtained from the City of Clermont Planning & Zoning Department and
the Building Permit has been obtained from the Lake County Department of
Growth Management, Building Services Division, for the work that has been
completed for this conversion to a living space, or the work required to return this
area to a 2-car garage.

Ms. Deborah L. Sachs of 1399 Legendary Blvd, Clermont, FL 34711 was sworn in and
stated she had been out of town since the early part of November and did not come
back into town until Friday June 15th. Ms. Sachs said she has already been to the City
of Clermont and obtained her Zoning Clearance and to the Lake County Building
Department in order to start the permit process. Ms. Sachs said she should have her
permit within two weeks.
There was discussion among the Code Enforcement Board members about one picture
regarding this case that was emailed to the Code Enforcement Board Officer. Since this
picture was not taken by the Code Enforcement Officer, this picture was not taken under
advisement.
James Davern made a motion to find the Respondent in violation of the cited City code
and be given until August 21, 2007 to comply or be fined at a rate of $50.00 per day;
seconded by Joe Janusiak. The vote was unanimous in favor of finding the Respondent
in violation, the time period, and the amount of the fine.

Standards Ch. 3, Sec. 301-307.6
City Attorney introduced the above referenced case and said the Respondent asked to
the placed on the agenda in order to address the Board. Ms. Brown stated this case
was first heard before the Board on April, 17, 2007.
AI-Karim Jivraj of 528 W. Minneola Drive was sworn in and stated he would like more
time in order to bring his property into compliance. He said he has done a tremendous
amount of work on his property however; he is still in the process of trying to complete a
couple of cosmetic items. Mr. Jivrag would like four months in order to complete this
process due to the amount of time it takes to obtain building permits and the costs of the
repairs that needs to be completed.
James Davern made a motion for the Respondent to be given until October 16, 2007 to
comply, with an oral report to be submitted to the Board on August 21, 2007 seconded
by Joe Janusiak. The vote was 4 to 1 favor of the time period with Jim Purvis opposing.

VIOLATION: Ordinance No. 249-C, Chapter 14, Section 76.
City Attorney introduced the above referenced case and said the Respondent asked to
the placed on the agenda in order to address the Board.
Code Enforcement Officer McMinamen showed before and after pictures of the
Respondent's property that he purchased as T & E Harvest Holdings, LLC in 2006. The
property was in disrepair when it was purchased and the new owner has done a lot of
work on the property. The current liens were paid at the time of closing by T & E
Harvest Holdings and the new liens began accruing under the same owner as East
Desoto, LLC. The total lien amount that has been paid on this case is $6678.00 and the
remainder of the lien is $1,213.80.
Mr. Ed Kern of 3266 Chadwick Road, Apopka FI, 32702 was sworn in stated he would
like forgiveness of the remainder of the lien which is $1,213.80.
James Davern made a motion to recommend the lien be heard for the City Council for
forgiveness; seconded by Joe Janusiak.

City Attorney introduced the above referenced case and said the Respondent asked to
the placed on the agenda in order to address the Board.
Code Enforcement Officer McMinamen showed before and after pictures of the
Respondent's property that he purchased as T & E Harvest Holdings, LLC in 2006. The

like forgiveness of the remainder of the lien which is $2,429.30.
James Davern made a motion to recommend the lien be heard for the City Council for
forgiveness; seconded by Joe Janusiak.
ADDITIONAL ITEM
James Davern made a motion to request a lien status report be given to the Board at
the next meeting; seconded by Les Booker.
There being no further business, the meeting was adjourned.
