09-08-1992 Regular Meeting• CITYOF CLERMONT MINUTES REGULAR COUNCIL MEETING SEPTEMBER 8, 1992 A Regular Meeting of the City Council of the City of Clermont was held Tuesday, September 8, 1992 in the Council Chambers. The meeting was called to order at 7:30 p.m. by Mayor Pool with the following Council Members present: Council Member Turville, and Council Member Cole, Council Member Ivey, and Council Member Norquist. Other City Officials present were City Manager Saunders, City Attorney Baird, and Deputy City Clerk Whitlock. INVOCATION The Invocation was offered by Council Member Ivey followed by the repeating of The Pledge of Allegiance to the Flag by all present. MINUTES The minutes of the Regular Meeting held August 25, 1992, and Workshop meetings held August 18 and 27, 1992 were approved as presented. CITY MANAGER SAUNDERS' REPORT Special Meeting September 10, 1992 City Manager Saunders reminded Council Members of the Special Council Meeting to be held Thursday, September 10, 1992 at 7:30 p.m. Property owners have received notice of this Public Hearing on their tax statements. The final adoption of the 1993 Fiscal Year Budget will be held at the September 24, 1992 Special Council Meeting, also held at 7:30 p.m. Water Service to Nearby Developments City Manager Saunders stated he has been contacted by two developers about obtaining water service from the City. One development is east of Clermont by Johns Lake and the other is south on the south side of Bronson Road. They are both within the boundaries of the Clermont Utility Service District. Both developers propose to build a water system which would be required to meet the specifications of the Department of Environmental Regulations, and turn the system over to the City. One site has already had a test well. There would be no cost to the City to build the water systems, however the City would be responsible for maintaining the systems. The City would collect impact fees and hook up fees and send monthly bills. Mayor Pool stated there is a potential income from these developments and it would be a good idea to explore servicing these areas with water service. Council Member Turville was concerned because the City has not done an engineering study of wells in the two areas. If the wells become contaminated, it would be the City's responsibility to correct the well or transport water to the area. City Manager Saunders stated that a • CITYOF CLERMONT MINUTES REGULAR COUNCIL MEETING SEPTEMBER 8, 1992 PAGE 2 feasibility study has been done regarding extending 12" water lines from Brogden Road, which would require a cost to the City. He proposed that the City Engineer be asked to research the requirements and costs of extending the line. 92-131 After a short discussion, a motion was made by Council Member _. -Norauist. seconded by Council Member Ivey and unanimously carried to proceed with drafting the necessary documents to provide water service to the developments and research the easibilit~of servicing the developments. CITY ATTORNEY BAIRD'S REPORT City Attorney Baird reported that one of the properties that he has initiated condemnation proceedings on has an outstanding $9,000 water bill. The bank has repossessed this property and a new purchaser is proposing to pay half of the outstanding water bill ($4,500) at closing and $4,500 with 10% interest payable in one year. He explained that law prevents us from going after a subsequent purchaser for an old water bill. 92-132 After considerable discussion, a motion was made by Council Member Ivey .seconded by Council Member Norquist and carried unanimously to allow the new purchaser o the apartment complex on Desoto Street to pay one-half ($4.500) of the outstanding water bill at closing and the other half ($4.500) due in one year with 10% interest MAYOR POOL'S REPORT Constitution Week Proclamation Mayor Pool proclaimed the week of September 17-23, 1992 to be Constitution Week in accordance with Public Law 915. He read the City of Clermont Constitution Week Proclamation in its entirety, encouraging citizens to understand the provisions and principles in the Constitution in order to support it, preserve it, and defend it against encroachment. Florida Power Incentive Programs Mayor Pool stated he received information from Florida Power on energy saving incentive programs. City Manager Saunders stated the energy audit has been done and he will report the outcome to the Council. • CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING SEPTEMBER 8, 1992 PAGE 3 UNFINISIiED BUSINESS Spray Field, Consideration of Management Proposals City Manager Saunders stated that only one proposal was received for the management of the spray field and it included land spreading of composted sludge. They were informed that spreading sludge was not permitted. They stated they would re-work their proposal, but have not yet done so and have not returned several telephone calls. 92-133 After discussion, a motion was made by Council Member Turville. seconded by Council Member Cole. and carried unanimously to authorize City Manager Saunders and Public Service Director Davis to approach other individuals who ma~possibly be interested in managing the spray field and negotiate an agreement,for Council approval. NEW BUSINESS Bid Award -Jenkins Auditorium Flooring City Manager Saunders explained that all bidders were informed that it was the bidder's responsibility to determine what was necessary for removal and disposal of the old tile. The bid was awarded to the first low bidder, Quality Carpet & Vinyl, at the August 11, 1992 Council meeting. Both the first and second low bidders have stated they did not include the cost for removal of asbestos vinyl flooring and have asked to be released from their bids. The third low bidder has been contacted, Bishops Paint & Decorating of Clermont, and they are investigating the recent changes that DER has made regarding the disposal of the old flooring. 92-134 After a brief discussion, a motion was made by Council Member Turville seconded by Council Member Cole. and carried unanimously to table the Jenkins Auditorium Flooring bid award. Sewer Service -Oaks Condominiums, Minneola City Manager Saunders stated that several months ago the Owners Association for the Oaks Condominiums contacted him regarding the possibility of providing sewer service to them in Minneola. They were asked to discuss it with the City of Minneola and to request the service jointly with the City of Minneola. Minneola City Council asked City Manager Saunders to meet with them in a workshop session to discuss sewer service to the Oaks Condominiums. It was unanimously agreed in the Workshop that it would be in the best interest of all for Clermont to provide sewer service to the Oaks Condominiums. The Oaks Owners Association has already hired an engineer who recommends installing a private force CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING SEPTEMBER 8, 1992 PAGE 4 main from the Oaks private lift station, with the line connected to the Clermont system at Lake Minneola Drive and East Avenue. The Oaks owners will be responsible for all construction costs. They will also be required to pay the Clermont sewer impact fee and will be billed monthly for service. Clermont will be responsible for maintaining the line after it is in place. The Minneola City Council and the Oaks Owners Association have asked us to draft an interlocal agreement between the City of Minneola and Clermont. The billings will be sent the Owners Association and Minneola will help collect if there is a problem. Mr. Jack Sargent asked why the 8-10 homes on the lake in Minneola were not included in this service. City Manager Saunders stated that Minneola is not in favor of connecting anyone else. They want to look at it on an individual basis and conduct research of state statutes and county ordinances regarding sewer service in order to avoid a domino effect. 92-135 After a brief discussion, a motion was made by Council Member Turville seconded by Council Member Cole. and carried unanimously to have an interlocal agreement and any other necessary documents drawn up and present them to the Cit~of Minneola for connecting sewer service to the Oaks Condominiums.
