CITY OF CLERMONT
MINUTES
REGULAR MEETING
A Regular Meeting of the City Council of the City of Clermont was held in the Jenkins
Auditorium on Tuesday, May 8, 1979. The meeting was called to order at 7:30 P.M. by Mayor
Claude E. Smoak, Jr., with the following members present: Councilmen Cole, Honey, and Byrd.
Other officials present were: City Manager Forbes, City Attorney Baird, City Clerk Carroll,
Public Works Director Smythe, Utilities Director Davis, Building Official Nagel, and Chief
of Police Tyndal. A large representation of local citizens was also present.
The invocation was offered by Councilman Byrd, followed by repeating of the Pledge of
Allegiance in unison by those present.
The Minutes of the Regular Meeting held on April 24, 1979, and of the Special Meeting held
on April 26, 1979 were approved as written.
PUBLIC HEARING: CUP REQUEST
City Manager Forbes advised of a request by Jacob's Chapel Baptist Church for a Con-
ditional Use Permit to utilize the property described as Lots 2, 4, 6, and 8 in City
Block 45, a C-l zoning district, for construction of a church building and additional
facilities; and, That following consideration of this request by the Planning and
Zoning Commission in a Public Hearing held on May 1, 1979, it had been their recom-
mendation that the request be granted subject to the following conditions:
1. That the existing frame chapel be demolished within 18 months
from the starting date of the project;
2. That a variance from the 50' required setback from Highway 50
to 45' be granted;
3. That a variance to allow grass parking be granted;
4. That a 5' privacy fence be constructed on the north side of the
proposed chapel to buffer the chapel from the abutting residential
zone;
5. That the parking spaces along Fourth Street, as shown on the site
plans presented, be shifted in such a way as to be contiguous with
the proposed entrance driveway off Fourth Street;
6. That the driveway exiting the Church onto Highway 50 be angled and
constructed in such a way as to make it impossible to make a
left-hand turn;
7. That all applicable regulations and ordinances be met; and,
8. That the use not be expanded except with a Conditional Use Permit.
Architect Nick Jones, representative of the Church, appeared before Council in support
of the request, and advised it was their desire to locate the building as far away
from Highway 50 as possible with the chapel facing Fourth Street, and that they were
agreeable to the conditions as recommended. Inquiry was made from the Chair as to
anyone else present who desired to address the matter, and there being none, motion
was made by Councilman Byrd, seconded by Councilman Cole and unanimously carried that
the recommendation of the P&Z Commission be accepted, and the necessary Resolution be
prepared for granting a CUP to allow the construction of a church and additional
facilities.

PUBLIC HEARING: RE-ZONING REQUEST
City Manager Forbes advised of a request by Leonard H. Baird, Sr., for the re-zoning
of Lots 4, 5, and 6 in Highland Terrace Subdivision from the existing R-l zoning status
to R-2 zoning classification in order to construct duplexes on the property; That
following consideration of this request by the Planning and Zoning Commission in a
Public Hearing held on May 1, 1979, it had been their unanimous recommendation that the
request be granted inasmuch as the property location meets the general requirements of an
R-2 Medium Density Residential area as set forth in the City's Comprehensive Plan.
Inquiry was made from the Chair as to anyone present who desired to comment on the matter,
and there being none, motion was made by Councilman Cole, seconded by Councilman Byrd
and unanimously carried that the request be granted and the necessary ordinance be
prepared.
ORDINANCES
Councilman Honey offered and moved the adoption of AN ORDINANCE UNDER THE CODE OF ORDINANCES
OF THE CITY OF CLERMONT, FLORIDA, AMENDING SECTION 26-25 (B)(2) OF ARTICLE VI OF APPENDIX
A OF THE CODE OF ORDINANCES; PROVIDING FOR RETAIL USE, and the motion was seconded by
Councilman Byrd. The Ordinance was read for a second and final .reading by title only by
City Clerk Carroll, and upon roll call vote on passage of the motion the result was: Ayes:
Byrd, Cole, Honey, and Smoak. Total Ayes: Four. Nayes: None. Absent: Schroedel. So
the Ordinance was adopted and the Number 194-C assigned to it.
Councilman Byrd offered and moved the adoption of AN ORDINANCE UNDER THE CODE OF ORDINANCES
OF THE CITY OF CLERMONT; ADOPTING THE STATE OF FLORIDA MODEL ENERGY EFFICIENCY BUILDING
CODE, and the motion was seconded by Councilman Honey. The Ordinance was read for a
second and final reading by City Clerk Carroll by title only, and upon roll call vote on
passage of the motion the result was: Ayes: Byrd, Honey, Cole, and Smoak. Total Ayes:
Four. Nayes: None. Absent: Schroedel. So the Ordinance was adopted and the Number
195-C assigned to it.
There being no further business to be brought before the Council at this time, the meeting
was adjourned by Mayor Smoak to a Town Hall meeting at 7:50 P.M.
