AGREEMENT
THIS AGREEMENT entered into this ~~-;;ay of September, 1983, by and between
the CITY OF CLERMONT, FLORIDA, hereinafter known as CITY and T. ANTHONY ARNONE,
individually and as Trustee, hereinafter known as ARNONE.
WITNESSETH:
ARNONE has submitted a .surveyed Plat to the CITY in which the CITY has been
requested to resubdivide the following described real property:
That portion of Lots 7, 8, 9, 36, 37 and 38, Block 7
and Lots 47, 48, and 49, Block 9, lying south of the
southerly right-of-way line of State Road No: 50, all
of Lots 10 to 18, inclusive, and all of Lots 31 to 35,
inclusive, Block 7, Sunnyside Unit, Clermont Heights,
as recorded in Plat Book 8, page 67, Public Records of
Lake County, Florida.

The new subdivision shall be known as SUNNYSIDE TERRACE.
There presently is a storm sewer line running across the real
both parties agree needs to be moved.
The parties hereto agree as follows:
1. The storm s,ewer line shall be moved to the easement shown on
the proposed Plat of SUNNYSIDE TERRACE.

of the CuS~S of moving the storm sewer line shall
be paid by the CITY and one-half (1/2) of the costs of moving the storm
sewer line shall be paid by ARNONE.
3. ARNONE shall have the following options:
a. Soliciting and accepting a bid for moving the line.
b. Allowing the CITY to solicit and accept a bid for moving
the line.
In any event, all specificiations of the CITY OF CLERMONT must be met
in moving the storm sewer line.
4. Either party breaching this agreement shall be liable for all costs
of such breach.
5. This agreement shall be binding on the heirs and assigns of the
parties.

WHEREAS DEVELOPER desires to develop the property subject to a certain covenant
and restriction for the mutual benefit and protection of the property and all persons
purchasing or acquiring an interest in any portion thereof:
NOW THEREFORE, DEVELOPER hereby declares that all the property described above
shall be held, sold and conveyed subject to the following covenant, condition and
restriction which shall run with the property and be binding on all parties having
any right, title or interest in the property or any part thereof, their heirs,
successors and assigns, and shall inure to the benefit of each owner thereof:
Before a Certificate of Occupancy shall be issued by the
City of Clermont, Florida, for the occupancy of any build-
ing constructed on the above described property, the owner
of the lot on which such building is constructed must construct
a sidewalk across the lot in accordance with the specifications
of the City of Clermont.
