AGREEMENT
This Agreement, by and between the CITY OF CLERMONT, a municipal corporation,
and HAROLD A. MACHIAS, hereinafter referred to as GRANTEE, dated this ~ day of

WHEREAS, Section 11-22 of the Code of Ordinances of the CITY OF CLERMONT requires

property owners to keep their real property free from trash, weeds, etc., and to
mow said real property to prevent excessive growth, and
WHEREAS, Section 11-24 of the Code of Ordinances provides that the CITY may
contract for the services of mowing and cleaning that real property which the owner
does not keep clean, and
WHEREAS, GRANTEE is desirous of providing this service for the CITY OF CLERMONT,
NOW THEREFORE, the parties agree as follows:
1. The CITY grants to GRANTEE an exclusive contract to provide mowing services
as provided in Section 11-24, Code of Ordinances.
2. The CITY shall provide to GRANTEE a list of lands and the owner thereof
as shown on the last ad valorem tax roll which lands the CITY deems in violation
of Section 11-22 and 11-23, Code of Ordinances.
3. GRANTEE agrees to mow said lands within a ten (10) day period and to provide
to CITY a record of the condition of the lands, time spent, equipment used, and date
of mowing.
4. CITY shall pay to GRANTEE the sum of $13.25 per hour for lots or parcels
mowed during the first year of this Agreement and $13.91 per hour during the second
year of this Agreement.
5. GRANTEE agrees to comply with all governmental and licensing agencies and
obtain all appropriate permits and licenses.
6. This Agreemnt may be terminated by either party upon ninety (90) days'
written notice. If not terminated sooner, this Agreement shall expire two (2) years
from date.

A proposal for Private Lot Mowing Contract with the
City of Clermont.

I propose a lo~ mowing .service for the City of Clermont
and its residents.
I offer to mow the lots that need mowing as deemed by the
City's seasonal mowing survey and finish these lots within
10 days of my notification (assuming that the city be devided
in quarters then mowing for each quarter of city will be
mowed within 10 days of my notification).
I propose to mow these lots @ a cost to the City of Clermont
of $13.25 per hour the first calendar year and $13.91 per hr.
the second calendar year. I would hope that the City would charge
the landowner a higher rate so that City administrative costs
will be provided for. I propose to offer to mow lots for city
residents who haven't been put on the survey list for a cost
of $10.00-$13.00 per hr. depending on lot condition. I would
charge the city $13.00 for any small lot that takes less than
one hour to cut. I would also request that Mr.Nagel furnish
me with information of the time spent on these lots in past
years so that I would have some idea how loug it would take to
mow certain lots.
1 would like exclusive rights to cutting the lots listed
on the survey unless the landowner has someone else cut it first.
I will keep records of the time on each lot. its condition, and
date it was mowed. Iwill furnish this to the City prior to
payment for services.
My proposal is.two-fold in purpose. First. I expect to
show a profit for the service and build a business of summer
work. Second, lam trying to offer the City of Clermont as well
as its residents a better alternative and a mowing service at
a substantial savings, I feel my proposal will free the city
from more and more unkept lots and eventually the City will .
be out of the mowing business. Most residents will turn to
private mowing contractors rather than deal with the City- I
also see that the number of lots to be mowed for the City will
decreese each year therefore I ask for a two-year contractual
agreement with the city for this service. I plan to use a
utility tractor and 5' bush hog mower. 1 plan to operate this
vehicle (at times) on city streets when moving from one lot
to another. I realize that last year approx. 250 lots were mowed
for the city twice a year. The city was devided into quarters
and cut in quarters.

Summary of Proposal
1.) Mow all lots on survey for $13.25 first year and $13.91.
second year.
2.) Offer same service for less to residents (if they desire
and before the survey is completed).
3.) Ask that the City charge landowner enough to cover
administrative costs.
4.) Agree to notify city of time spent on lots, their
condition and date mowed. Also to mow them within 10 days of
notification.
5.) Ask Mr.Nagel to furnish me with some information on time
spent mowing some of these lots in the past.
6.) Require a 2-year contractual agreement for the service.
