(hereinafter referred to as the User), and dated fd Iri It 2, PURPOSE: The purpose of this MOU is to document the terms and conditions under which PCSO will grant Florida law enforcement agencies access to Florida's Facial Recognition Network (FR-Net), hosted by the Pinellas County Sheriffs. PCSO will grant access and make certain information (as specified below under Terms and Conditions) available to the User to perform automated facial recognition searches and face image comparisons through the Face Analysis Comparison & Examination System (FACES) available via the Florida Department of Law Enforcement's (FDLE) Criminal Justice Network (CJNET). BACKGROUND: The Pinellas County Sheriffs Office maintains the largest collaborative open model Face Recognition System in the U.S. and exclusively hosts Florida's Facial Recognition Network (FR-Net). FR-Net provides facial biometric search capabilities, subject information, face image comparison tools, training for FR search, and face image analysis methods and best practices via CJNET to authorized Florida law enforcement agencies. TERMS AND CONDITIONS: PCSO agrees to provide access to the FACES application described above and will adhere to the following terms and conditions: 1. Provide the User with access to the FACES online training materials to ensure up to (10) User personnel can demonstrate competency with the FR process, FR fact vs. fiction, probe image analysis, and FACES application operations; 2. Provide the User with access to the FACES application after successful completion of the FACES online training materials; 3. Provide the User with automated FR search capabilities, demographic data review, facial image analysis and comparison tools via FACES; 4. Provide the User with informational updates on new or improved FACES features, newly enrolled facial data, and notification of FACES maintenance; S. Respond to specific inquiries from the User; 6. Provide assistance with FACES use and search results review as needed; and 7. Provide the User with the name and contact information of PCSO technical and administrative points of contact. By accepting access to the information services described above, the User agrees to adhere to the following terms and conditions: 1. All User personnel must successfully complete the FACES Online training; 2. The User agrees the FACES application is for criminal justice purposes only and not for public use or dissemination; 3. Use for any purpose other than criminal justice purposes will result in immediate termination of the MOU and immediate loss of access to FACES; 4. User agrees to comply with all FDLE requirements regarding use of FACES and ON ET; S. The User agrees FACES results are investigative leads to assist with subject identification and/or verification; 6. The User agrees their personnel accept responsibility for identity adjudication and take law enforcement action based upon their own identity determination; Ver 4, Oct 2012 page 1 of 3 Pinellas County Shenffs Office Facial Recognition MOU 7. The User agrees to notify PCSO as soon as possible, and in no event not later than 5 business days, after an arrest(s) resulting from the use of FACES; 8. The User agrees to participate in related evaluations to determine the effectiveness of the FACES application; 9. PCSO is to be notified immediately when User personnel have a change in employment status or duty assignment where FACES access is no longer needed; and 10. Provide and update PCSO with the name and telephone number of technical and administrative points of contact. TERMINATION: This MOU may be terminated by either party without cause, upon no less than thirty (30) calendar days written notice. PCSO reserves the right to terminate service, without notice, upon presentation of reasonable and credible evidence that the User is violating this MOU. UABILITY AND DEFENSE OF LEGAL ACTIONS: 1. Subject to applicable law, PCSO or we shall defend any lawsuit filed against PCSO which arises out of services performed by PCSO under this MOU. PCSO's procedures shall be followed in handling such suits. PCSO shall pay any judgment rendered against him according to law. Nothing contained herein shall be construed to waive the provisions of §768.28, Fla. Stat. as to any parry to this Agreement; 2. User shall defend any lawsuit filed against it which arises out of services performed by User under this Agreement. User's procedures shall be followed in handling such suits. User shall pay any judgment rendered against it according to law. TERM OF AGREEMENT: This MOU will become effective upon signature of both parties and will remain in force until it is determined by PCSO that a new agreement is required. The User should initiate the execution of a new agreement when a change of agency head occurs.
