NO. 403-M
AN ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, ADOPTED PURSUANT TO
SECTION 12S.0I(l)(q), FLORIDA STATUTES (1999), CONSENTING TO THE
INCLUSION OF THE CITY OF CLERMONT, FLORIDA, WITHIN THE
COUNTY-WIDE MUNICIPAL SERVICE TAXING UNIT FOR THE PROVISION
OF AMBULANCE AND EMERGENCY MEDICAL SERVICES, AS ADOPTED
BY THE BOARD OF COUNTY COMMISSIONERS OF LAKE COUNTY,
FLORIDA; PROVIDING FOR THE CITY TO BE INCLUDED WITHIN SAID
M.S.T.U. FOR A SPECIFIED TERM OF YEARS; PROVIDING FOR
SEVERABILITY, PROVIDING FOR AN EFFECTIVE DATE AND PROVIDING
FOR PUBLICATION.

WHEREAS, Lake County's contract with its current ambulance service provider
expires September 30, 2000, and although the provider originally agreed to extend its
services for an additional sixty (60) days it ultimately decided against such an extension;
and
.
WHEREAS, Lake and Sumter Counties have taken action to create a non-profit
corporation to provide, ambulance services in Lake and Sumter Counties effective
September 30, 2000; and
WHEREAS, Lake County has detennined that the best mechanism to s'ecure the
necessary funding to provide sàid ambulance services is to create a countywide municipal
service taxing unit authorizing the County to levy ad valorem taxes therein for the
provision of ambulance and emergency medical services, and has enacted an emergency
ordinance creating that municipal service taxing unit; and
WHEREAS, Section 125.01(l)(q), Florida Statutes, provides that the boundaries
of a municipal service taxing unit may include all or part of the boundaries of a
municipality if the affected municipal consents, by ordinance, to be included therein; and
WHEREAS, the City Council of the City ofClennont has detennined that it is in
the best interest of and serves the health, safety and general welfare of the residents of
Clennont to include the City of Clennont within the Lake County municipal service
taxing unit for ambulance and emergency services; and
WHEREAS, Lake County's emergency ordinance expressed its intent to include
the City of Clennont within the boundaries of the "Lake County Municipal Service
Taxing Unit for Ambulance and Emergency Medical Services," subject to the adoption of
an approving ordinance by the City Council of the City of CleI1lKlnt;

NOW THEREFORE, be it ordained by the City Council of the City of
Clennont, Florida:
Section I.
The City Council of the City of Clennont consents to the inclusion of the
City of Clennont within the boundaries of the "Lake County Municipal Service Taxing
Unit for Ambulance and Emergency Medical Services."
Section 2.
This initial consent shall be for a tenn of one (I) year.
Section 3.
All Ordinances or parts of this Ordinance in conflict herewith are hereby
repealed.

Section 4.
Should any section or part of this section be declared invalid by any court
of competent jurisdiction, such adjudications shall not apply to or affect any other
provision of this Ordinance, except to the extent that the entire section or part of the
section may be inseparable in meaning and effect from the section to which such holding
shall apply.
Section 5.
This Ordinance shall take effect immediately upon final adoption by the
City Council of the City ofClennont, Florida.
