08-27-1968 Adjourned Meeting . . MINUTES N~ HI~ 541 ADJOURNED MEETING An adjourned meeting of the City Council of the City of Clermont was held in the Council Chambers on Tuesday, August 27, 1968. The meeting was called to order at 8~OO P. M. by Mayor Don Smith with the following members present: Councilmen Prior, Beals and Cochran. Other officials present were: City Manager Johnson, City Clerk Carroll, Controller Fleming, Super- intendent Sheldon, Inspector Snyder, City Attorney Langley and Chief of Police Tyndal. Others present were: Mr. and Mrs. John Drees, Mrs. D. W. Swaffar and the Messrs. Leslie Baron and Albert Sherman. Representatives of the local Press were also present. The Invocation was given by City Attorney Langley. The Minutes of the Meeting held on August 13, 1968 were approved as written. City Manager Johnson submitted his report, both orally and written. City Manager Johnson reported he had received a petition from abutting property owners along DeSoto Street, from East Avenue to Second Street, protesting the proposed construction of Second Street from Broome Street to DeSoto Street, and the Clerk read the petition in full. Messrs. John Drees and Albert Sherman spoke briefly to the Council endorsing the petition as presented. Motion was made by Councilman Cochran, seconded by Councilman Prior and carried that inasmuch as the full Council was not present, that any action of this petition be tabled until such time as the Council has opportunity to study same and such time as all Council members were present. Controller Fleming submitted his report, both orally and written. A copy is attached hereto and becomes a part of these Minutes. Motion was made by Councilman Beals, seconded by Councilman Cochran and carried that Business Personal Property Tax Bills for 1967, which Conbr~&ler Fleming had listed, as, in his opinion, uncollectible, be voided. Councilman Beals introduced AN ORDINANCE AMENDING ORDINANCE NUMBER 126 ADOPTED DECEMBER 7,1954 BY THE CLERMONT CITY COUNCIL: BEING A COMPREHENSIVE ZONING ORDINANCE FOR THE PURPOSE OF PROMOTING THE GENERAL WELFARE OF THE COMMUNITY: REGULATING THE EHIGHT, NUMBER OF STORES AND SIZE OF BUILDINGS . AND OTHER STRUCTURES, THE PERCENTAGE OF LOT THAT MAY BE OCCUPIED, THE SIZE OF YARDS, COURTS, AND OTHER OPEN SPACES, THE DENSITY OF POPULATIONS, AND THE LOCAt TION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES: CREATING DISTRICTS FOR SAID PURPOSES AND ESTABLISHING THE BOUNDARIES THEREOF: REGULATING OFF-STREET PARKING AND LOADING SPACES: DEFINING CERTAIN TERMS USED HEREIN: PROVIDING FOR THE METHOD OF ADMINISTRATION: ESTABLISHING THE DUTIES OF THE ZONING COMMISSION AND BOARD OF ADJUSTMENT: RROVIDING FOR THE ENFORCEMENT AND AMENDMENT THEREOF: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH: AND PRESCRIBING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE. Motion was made by Councilman Beals, seconded by Councilman Prior and carried that the rules be waived and the ORDINANCE be read by Title only for a first reaming. The ordinance was read by Title only by City Attorney Langley. City Manager Johnson advised the Council that each mf them had received a copy of a letter to Mr. C. A. Mobley of Mobley's Used Car Lot at 634 Highway #50, wherein he was advising Mr. Mobley that it was his intention to recommend to the Council that his Occupational License be revoked until such time as he complied with existing city ordinances, and that he had been notified of such violations on May 21st, and that he now wished to make this recommendation. Motion was made by Councilman Beals, seconded by . . }fll. 542 Councilman Prior and carried that the recommendation of City Manager Johnson be accepted and the Occupational License issued to Mobley's Used Car Lot be relVoked, and he be so advised of this action by City Attorney Langley. MINUTES N~ Mayor Smith reported that, in his opinion, there were several inequities in the City's Pension and REtirement Plan and urged that the Council and City Attorney study and consider changes in same. He referred them to Chapter 16, page 287 of the Clermont Code. This matter was referred to the City Attorney.
