08-10-1971 Regular Meeting . . MINUTBS .REGULAR MEETI NG Nt} 749 A Regular Meeting of the City Council of the City of Clermont was held in the Council Chambers on Tuesday, August 10. 1971. The meeting was called to order at 7:30 P.M. by Mayor Don E. Smith with the following members present: Councilwoman Watson and Councilmen Cochran and Beals. Other officials present were City Manager Hopkins. City Controller Fleming. City Attorney Langley. Chief of Police Tyndal and Director of Public Utilities Asbury. Others present were Mesdames Langley. Wrightam. Thomas and DaYi Messrs. Travis Kennedy. Donald Thomas. E. Schumann. Paul DiToma, Thomas Day, Lester Cole. ~ichard Oswalt. George Hovis and Messrs. Homer and Allen and Bill williams and othe~of Konsler Steel Company. Representatives of the local press and the Sentinel were also present. The Invocation was given by Councilman Beals. The Minutes of the Regular Meeting held on July 27. 1971. !nd of the Special Meeting held on August 3. 1971 were approved as written. Mayor Smith announced the first order of business to be a Board of Adjustment hearing with regards an appli~ation from Syrus H. Johnson for a variance in front yard setback to construct an addition to his residence. The City Manager read a letter from Mr. Johnson wherein he stated his reasons for the requested variance. Motion was made by Councilman Beals. seconded by Councilwoman Watson. and carried, that this request be tabled until the August 24th meeting inasmuch as Mr. Johnson asked for a 14 feet variance and was not in attendance ~o justify his request. The Mayor announced a Public Hearing on the request of Konsler Steel Company for the closing of a portion of Juniata Street. Mr. Bill Williams. representing Kons1er Steel Company. appeared before Council and explained in detail a four-phase expansion of their facilities which would require the closing of a portion of Juniata Street. Objections to the street closing were expressed by Richard E. Oswalt. Attorney George Hovis. representing Francis Oswalt, and Mr. 'William Boyd. Motion was made by Councilman Cochran. seconded by Councilwoman Watson. and carried, that the Hearing be continued until the meeting of A~gust 24, 1971 to allow f1r. Williams to furnish more detailed information for his request. City Manager Hopkins submitted his report both orally and written and a copy is attached hereto. City Manager Hopkins reported he received a request from Mr. Lionel Barfield, 480 East Lake Shore Drive. for a lake front easement directly south of his property. Motion was made by Councilman Beals, seconded by Councilman Cochran, and carried, that such easement, described as follows, be granted. All lands lying South of Lake Shore Drive. North of the low water mark of Lake Minnehaha and between the extended East and West boundaries of Lot 52. Clermont Heights. accroding to the official map of the City of Clermont duly filed on February '-', 1926 and recorded in Plat Book 8 pages 17 to 23, inclusive, public records of Lake County, Florida. City Manager Hopkins reported that he had received a letter from Mr. Robert Shingler wherein he stated that he was unable to contact Mrs. LOCkmiller. an abutting property owner, concerning the closing of Milholland . . MINUTBS Nt} 750 Street and, therefore, decided to request closing of Hampton Street only and requested a Public Hearing on closing Hampton Street. Motion was made by Councilman Cochran, seconded by Councilwoman Watson. and carried, that the City Manager be directed to proceed with the advertising of a PubJtc Hearing to be held on August 24. 1971 to consider a request by Robert J. Shingler to permanently close th~ following ~esignated portion of Hampton Street located 1 n the C1 ermont'.Hei ghts subdvi si on of theCity of Clermont: That portion of Hampton Street abutting Lots 265. 267. 268 of Clermont Heights Subdivision on the West. and abutting Lots 300. 301 and 302 of Clermont Heights, Subdivision on the East. The Mayor requested those members of the Council who plan to attend the Florida League of Cities meeting in St. Petersburg on October 24, 25. 26 to advise the City Manager as soon as possible so that advance reservations can be made. Upon the request of the City Manager. the Mayor called a special meeting of the 'i ty Council to be held on Augus t 31. 1971 1 n the Council Chambers to discuss the Public Utilities preliminary budget and to finalize the General Fund Budget. At his suggestion, the City Manager was directed to invite the Library Board and the Chamber of Commerce Board of Directors to attend the meeting ~o discuss their respective appropriations. City Attorney Langley stated that he had received a letter from Lake News and since it was evident that they were not going to cooperate to the utmost with our request to discontinue the distribution of the Lake News throughout the City without residents having requested it. he suggested that the city ordinance regarding littering be enforced. The City Manager was directed to have the littering ordinance enforced. City Attorney Langley advised that the time for Date of Taking on the sanitary sewer Condemnation suits had been changed from 2:30 PM to 10 AM on August 31. 1971. in the Courty Court House. Councilman Cochran reported that he. the City Manager and Councilman Beals had met with Mr. C. A. Bsoedict of the Department of Transportation in Deland. on August 9. concerning grade separations on East and West Avenues at their intersection with State Road 150 and had received a promise from Mr. Benedict to give the City.s request consideration in their plans for 4 laning Highway 150. It was felt that the State Road Department is keenly aware of the City.s problem. The Secretary read a communication as follows: From Elberta Ritchie, Librarian, Cooper Memorial Library. wherein she expressed a need for increased financial support for the library. Councilwoman Watson offered and moved the adoption of AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT. LAKE COUNTY, FLORIDA. CLOSING CERTAIN PORTIONS OF ALL OF THE FOLLOWING STREETS SHOWN BY A PLAT RECORDED IN PLAT BOOK 8. PAGE 19. PUBLIC RECORDS OF LAKE COUNTY. FLORIDA. LYING SOUTH OF SEMINOLE STREET AND WEST OF TWELFTH STREET IN THE CITY OF CLERMONT. FLORIDA. TO-WIT. POINSETTA DRIVE. VIRGINIA DRIVE. MT. VERNON DRIVE. FLORENCE DRIVE. HIAWATHA PLACE. AND MAGNOLIA STREET and the motion was seconded by Councilman Beals. The ORDINANCE was read in full for a second and final reading by City Attorney Langley. Upon roll cll1 vote on passage of the motion the result was: Ayes: Beals. Cochran. Watson and Smith. Total Ayes: 4. Hayes: None. So the ORDINANCE was adopted. the number 37-M assigned to it and a copy ordered posted. Councilman Cochran offered and moved the adoption of a RESOLUTION ~ . . .. . I . i:" . . . MINUTBS Nt} 751 requested by the Department of Transportation wherein the City would assume the responsibility for the proper diversion and traffic control on any detour so designated by the City concerning the diversion of traffic from State Road 561 as necessary on certain days and hours in order to lay Sanitary Sewer laterals across the highway. The motion was seconded by Councilman Beals and unanimously carried. The RESOLUTION was read in full by City Attorney Langley. the Number 183 assigned to it and a copy ordered posted. Councilman Cochran introduced AN ORDINANCE AMENDING ORDINANCE NO. 55-C BY PROVIDING AN ADDITIONAL EXCEPTION TO THE ADOPTION OF THE 1967 SOUTHERN STANDARD PLUMBING CODE and the ORDINANCE was read in full by the City Attorney for a first reading. Councilman Cochran introduced A~ ORDINANCE UNDER THE CODE OF ORDIN~UCES OF THE CITY OF CLERMONT. FLORIDA. AMENDING ORDINANCE NO. 36-M BY DELETING SECTION 2 (a) THEREOF AND ADDING SECTION 4 (2) GOVERNING HOOK UP OF SEPTIC TANKS and the ORDINANCE was read in full by the City Attorney for a fi rst reading.
