SPECIAL MEETING
A Special Meeting of the City Council of the City of Clermont was held in the office
of the City Manager on Wednesday, February 21, 1973. The meeting was called to order
at 7:30 P.M. by Mayor Don E. Smith with the following members present: Councilmen
Beals, Smoak, Schroede1 and Byrd. Other officials present were: City Manager Hopkins
City Clerk Carroll, City Attorney Vason and Director of Community Services Smythe.
Representatives of the local Press were also present.
Mayor Smith advised the purpose of the meeting was to consider and/or take action
on matters pertinent to the sanitary sewer system.
City Manager Hopkins reported that in his recent meeting with the Department of
Pollution Control, they were still insistent that the city acquire additional property
on which to utilize spray irrigation on a temporary bais while pursuing a long
term and permanent arrangement. As he had been instructed at the meeting held on
February 13th, Mr. Hopkins reported he had offered Peter H. Johnson the sum of
$20,000.00 for his grove property located in Johnson's Rep1at and that Mr. Johnson
had declined this offer and advised that his selling price was firm at $30,000.00
plus the current fruit crop.
Motion was thereupon made by Councilman Beals and seconded by Councilman Schroedel
that necessary proceedings for condemnation of this property be instigated. The motion
carried with Councilman Smoak voting, Naye. Councilman Smoak advised his reason for
voting against the motion was because he didn't feel that enough information was
readily available at this time as to costs involved for such proceedings.
Councilman Smoak reported that he had contacted officials of the Blessed Sacrament Church
with regards the city using their grove property located at the NW corner of State
Road 50 and Twelfth Street for spray irrigation, and that they were agreeable if
arrangements for sale of the current citrus crop were made prior to its being used,
and, that official permission would have to be given at a regular meeting of their
Council. Councilman Smoak further advised that if it be the desire of City Council, he
would contact a buyer and attempt a satisfactory sale between buyer and officials
of the church. Motion was made by Councilman Byrd, seconded by Councilman Schroede1
and carried that Councilman Smoak proceed with cDnsumation of such a deal, and if
successful, immediately set up and start the spray irrigation system at that location.
Councilman Smoak offered AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF
CLERMONT, FLORIDA, DECLARING AN EMERGENCY SITUATION IN REGARD TO THE OPERATION OF ITS
SEWER TREATMENT FACILITIES AND PROVIDING FOR THE CONDEMNATION OF ADJOINING PROPERTY
FOR DISPOSAL OF ITS EFFLUENT and the ORDINANCE was read in full for a first reading
by City Attorney Vason.
Councilman Smoak offered and moved the immediate adoption of, under emergency measures,
AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, FLORIDA, DECLARING
AN EMERGENCY SITUATION IN REGARD TO THE OPERATION OF ITS SEWER TREATMENT FACILITIES
AND PROVIDING FOR THE CONDEMNATION OF ADJOINING PROPERTY FOR DISPOSAL OF ITS EFFLUENT
and the motion was seconded by Councilman Beals. The ORDINANCE was read in full by
City Attorney Vason and upon roll call vote on passage of the motion, the result was:
Ayes: Smoak, Beals, Smith, Schroedel and Byrd. Total Ayes: Five. Nayes: None. So
the ORDINANCE was adopted, the Number 52-M was assigned to it and a copy ordered
posted.
Motion was made by Councilman Smoak, seconded by Councilman Byrd and carried that City
Attorney Vason be instructed to take whatever steps necessary for visibly acquiring
the Peter H. Johnson property in the fastest possible way.
The meeting was adjourned by Mayor Smith.
