SPECIAL MEETING
A Special Meeting of the City Council of the City of Clermont was held in the
office of the City Manager on Friday, January 23, 1976. The meeting was called
to order at 11:45 A. M. by Mayor Claude E. Smoak, Jr., with the following members
present: Councilmen Schroedel, Byrd, and Blackburn. Others present were: City
Manager Hopkins, City Attorney Baird, City Clerk Carroll, Director of Community
Services Smythe, Building Official Nagel, Mr. and Mrs. Ben Cunningham, and Mr.
Max Judy. A representative of the Sentinel/Star was also present.
Mayor Smoak advised the purpose of the meeting was to consider an appeal by Mr.
and Mrs. Ben Cunningham for revocation of the "Stop Work Order" issued to them for
work being performed on a structure located on their property described as Lot
105 and portions of Lots 73 and 104 in Clermont Heights Subdivision.
City Manager Hopkins, Building Official Nagel, and Director of Community Services
Smythe advised the "Stop Work Order" had been issued as a result of it having been
determined that work was being performed on a structure described in the Florida
State Statutes from identifying numbers of the structure, as a mobile home, a .
direct violation to existing City of Clermont Ordinances, except in a designated
Trailer Park. They advised that a structure had been placed on this location and
work being done on it without benefit of having applied for a permit to do so.
Mr. and Mrs. Cunningham advised that prior to their having acquired the structure,
which they desired to use strictly for an office, and following brief inquiries
and conversations with the city officials, it was their understanding the structure
could be placed on the location provided it met the Southern Standard Building
Code, which they intended to do; That a building permit had not been applied for
as yet inasmuch as the certified contractor which would be doing the work was
out of the state, but that it had been necessary to remove the structure from
site of sale, and they were only in the process of weatherproofing the structure
in order to protect their investment. They further advised they felt it would
be damaging to them on the part of the city, if they were not allowed to complete
the work of protecting the structure from the elements; that they wereeof the
opinion the structure could be modified to meet the requirements of the Southern
Standard Building Code and all city ordinances in order that the structure might
be used at that location for an office; and, that at such time as their designated
building contractor returned to the city, would apply for the necessary building
pe rmit.
Motion was made by Councilman Blackburn, seconded by Councilman Schroedel and
carried that the "Stop Work Order" be lifted only for the completion of weather-
proofing of the structure in order to protect it from the elements.
Councilman Byrd inquired if it be necessary to obtain a building permit for the
weatherproofing of the structure. Building Official Nagel quoted the Code wherein
a building permit is needed in all cases wherein the dollar va~uation is of
$100.00 or more. Mr. Cunningham advised that he had already spent much more in
excess of that amount, but that it would be less than that amount for the remaining
work. There was no further action regarding this matter.
The meeting was adjourned by Mayor Smoak at 12:40 P. M.
