1970-03LEASE AGREEMENT
THIS LEASE AGREEMENT MADE AND ENTERED into this 1st
day of May, A.D. 1970, by and between the City
of Clermont, a municipality, in Lake County, Florida, herein-
after called the CITY, and Lake County, a political subdivi-
sion of the State of Florida, hereinafter called the COUNTY.
In the consideration of One Dollar ($1.00) in hand
paid by the County to the City, receipt whereof is hereby ac-
knowledged and the further consideration hereinafter set forth;
the City does hereby demise and lease unto the County the fol-
lowing described garbage disposal area located in Lake County,
Florida and owned by the City:
PARCEL NO. 1 : Tracts 17, 18, 31 and 32 in Sec;
tion 21, township 22 South, Range 25 East, in
Groveland Farms, a subdivision in Lake County,
Florida according to the plat thereof recorded
in Plat Book 2 pages 10 & II, Public Records
of Lake County, Florida.
PARCEL NO. 2 : That part of Tract 16 in Section
27, Township 22 South Range 25 East, in Groveland
Farms, a subdivision in Lake County, Florida, ac-
cording to the plat thereof recorded in Plat Book
2 pages 10 & 11, Public Records of Lake County,
Florida, bounded and described as follows: From
the Northwest corner of Section 27, Township 22
South, Range 25 East; in Lake County, Florida, run
thence North 88 degrees 54' East 311.57 feet; thence
run South 15 degrees 40' East 690.2 feet; thence run
East 51 feet; thence run South 25 degrees 18'30"
East 302.06 feet to a point hereby designated as
point "A"; from the said point "A", run thence
South 70 degrees 26' West to a point on the East
line of the said Tract 16, the same being the point
of beginning of the Tract herein described. From
said point of beginning, run thence South 70 degrees
26' West to a point that is South 70 degrees 26'
West 256.5 feet from the above mentioned point "A";
thence run North 56 degrees 39' West 130.8 feet;
thence run South 63 degrees 46' West to a point on
the West line of the said Tract 16; thence run South
,along the West line of the said Tract 16 251.48 feet,
more or less, to the Southwest corner of the said
.Tract 16; thence run Bast along the South line of
the said Tract 16 to the Southeast corner of the said
Tract 16; thence run North along the East line of the
said Tract 16 to the point of beginning
For a period of FIVE (5) years. County shall have the option to
renew this lease under the same terms and conditions for an ad-
ditional period of FIVE (5) years provided, however, that County
has fulfilled their obligations, set forth herein.
During the term of this lease the City shall have
the right, as part of the consideration herefore, to use the
facilities of the garbage disposal area for the purpose of
dumping garbage and trash without charge and with the further
agreement that the County will, at the final termination of this
lease, return said property to the City in a clean sanitary con-
dition.
The parties hereto agree to the following stipulations
to control during the term of the lease:
1. The COUNTY agrees to supply an attendant at the
garbage disposal area during the established working hours which
shall be agreed upon.
2. The garbage disposal area will be closed to the
public during off -working hours, but the City will be furnished
with keys so that city employees may enter the area whenever
necessary.
3. The existing gate will be taken down and re-
installed well inside the property boundaries (approximately
600 feet) allowing a small trench to be constructed outside
the main compound for use of individuals who may desire to
use the dump during off hours.
4. Present dumping area shall be reduced or lim-
ited to that which is necessary for handling the existing im-
coming loads.
5. To comply with air and water pollution laws,
all burning of trash and garbage will be prohibited during
the term of this lease.
6. the COUNTY agrees to clean up the entire site
for the purpose of disposing of existing debris and promis-
cuous dumping.
,7. No salvaging will be permitted except with the
mutual consent of the County and the City.
8. The COUNTY shall have the right to charge any
commercial garbage collection agency duly ,franchised to oper-
ate within Lake County, such fee as .hall be determined for

use thereof by commercial garbage collecting agencies to help
defray the.cost of operating the same.
THIS LEASE is executed in duplicate and shall be
binding upon the respective parties hereto during the term
hereof.
IN WITNESS WHEREOF, the parties hereto have caused
this Lease to be executed in their respective names by their
duly authorized officers, all as of the day and year first
above written.
