REGULAR MEETING A regular meeting of the City Council of the City of Clermont was held in the office of the City Clerk on Tuesday, May 2, 1961, The meeting was called to order at 7:30 p. m. by Vice Chairman Boyd. Council members present were Messrs. Turville, Boyd and York. Other city officials present were Mayor BonJorn, Clerk Johnson, Deputy Clerk Williams, City Attorney Morse, Superintendent Sheldon, Inspector Snyder and Police Chief Tyndal. Also present were Mr. Frank B. Innis, Mrs. Lois Cochrane Rogers and representatives of the Orlando Sentinel and the local press. The minutes of the adjourned meeting held Tuesday, April 18, 1961 and the Special Meeting held Tuesday, April 25, 1961 were read and approved. Vice Chairman Boyd stated that the first order of business was for the Council to sit as a Board of Equalization, as advertised, to hear complaints, if any, regarding the special paving assess- ments against abutting propertYofor the paving of Scott Street. Vice Chairman Boyd inquired if any one present had any objections to the special paving assessments as levied. There were no objections. Chairman Boyd inquired of Clerk Johnson if he had received any communications objecting to the special paving assessments as levied. Clerk Johnson replied in the negative. Motion was made by Mr. Turville, seconded by Mr. York, and carried, that the special paving assessments for the paving of Scott Street between DeSoto and Pitt Streets be accepted and confirmed. Lois 60chrane Rogers protested to the Council that the southern boundaries of the Transient COm3ercial zone along Chestnut Street in the neighborhood of her property was being used for the parking of junked cars and other such unsightly articles. Mrs. Rogers stated that this was particularly true in the rear of the Bowen Ford Company and stated that, while she was not partic- ularly interested in that area, her concern was whether or not such conditions would be allowed in any Transient Commerical zone. Mrs. Rogers was advised that the Mayor would investigate the ~atter and thanked for calling it to the Council's attention. Mr. Pool arrived at this time. Clerk Johnson presented a replat of Block 6, Woodlawn for consideration by the Council. City Attorney Morse advised that the replat as submitted did not comply with existing State and County laws. Motion was made by Mr. Pool, seconded by Mr. Turville, and carried, that the replat of Block 6, Woodlawn, be returned to the property owners in order that they might make the necessary corrections and that the Mayor and City Clerk be authorized to approve same when such corrections are made. Mayor BonJorn complimented Superintendent Sheldon on the progress being made in connection with the clean up of vacant property and stated that he hoped the program would be completed in the very near future. Mayor BonJorn also inquired of Mr. Sheldon if he had completed the work order issued to him sometime ago to correct existing hazardous conditions as outlined by our insurance company. Mr. Sheldon advised Mayor BonJorn that all items had been completed with the exception of putting new glass in the j windows at the pump house and that this item was being hel~ up pending the installation of new pumping equipment. Mayor BonJorn recommended that the drainage tile ~djacent to the boat ramp at the Jaycee Beach be extended approximately 20' into Lake Minneola and that the existing wash out be sanded and leveled. This matter was referred to the Parks Committee for necessary action. Mayor BonJorn reported that a small wooded area on Lake Minneola, lying west of the boat ramp at the Jaycee Beach, was badly in need of cleaning, but that it appeared that it was privatemy owned and that it would, therefore, be necessary to obtain permission from the owner before cleaning. Mayor BonJorn further advised the Council that it was necessary that some ordinances be drawn whereby it would be possible for the City .'..~ to compel property owners to remove junk and other such debris from their property. This matter was referred to the taws and Auditing Committee for study and preparation of the necessary ordinances. .. ---,., Chief Tyndal submitted his regular monthly report which was accepted and order filed. Vice Chairman Boyd requested that the Police Department make a survey of the overgrown shrubbery in front of the Standard Oil Station at the corner of West Avenue and Montrose Street which was causing a hazard to the motoring public. Building Inspector Snyder submitted his monthly report for April, which was accepted and ordered filed. Mr. Boyd, Chairman of the Water Committee, reported that new pumping equipmeA~ had been ordered for the well on Highlands Avenue and that it would be installed within a few days. Clerk Johnson read a letter from Mr. George Nagel requesting water service for a residence which was to be built just outside the city limits. City Attorney Morse ruled that there was a possibility that under existing State laws the City would not be allowed to furnish additional water outside of the city limits. Motion made by Mrl Pool, seconded by Mr. Turville, and carried, that City Attorney Morse check the laws regarding this matter and that if it was permissible for the city to furnish water to the residence in question that he prepare an agreement between the City of Clermont and Mr. Harold Gore, the owner of the residence in question, whereby the city would furnish water and sanitation service at existing rates plus 25% and that Mr. Gore bear the entire expense for all necessary mains and other installations outside the city limits. Mr. Turvil1e reported that there was considerable debris under, the bridge at the south side of Lake Winona and that he and Superintendent Sheldon would try to remove same. Motion was made by Mr. Pool, seconded by Mr. Turville, and carried, that the Finance Officer be authorized to make expendi- tures of approximately $5,000 in excess of the amount budgeted for the repairs and sand sealing of city streets and that the necessary financial arrangements to cover this deficit would be made before the end of the fiscal year. Mr. Pool, Chairman,of the Parks Committee, reported that the stands and ball park haq been completed and that the boat ramp at the Jaycee Beach was nearing completion,- Mr. Pool reported that the Dad's Club had emp~oyed Mr. Tom Kelly and Mr. Jack Gaines as recreational supervisors for the summer months and that Mr. Tom Kelly was to receive $300 and Mr. Jack Gaines $600 for their services. Motion was made by Mr. York, seconded by Mr. Pool, and carried that the Clerk be authorized to pay Mr. Tom Kelly $75.00 a month for four months, and Mr. Jack Gaines, $150.00 for four months, such payments to start in both cases on June 1st. Mr. York stated that the Dad's Club had made a request for several street lights in the area of the ball park but that he and his committee desired to make an investigation before making a recommendation. ~ . Mr. Turville, Chairman of the Laws and Auditing Committee, reported that after making a study of present zoning that it appeared that kindergartens were allowed in any part of the city. Clerk Johnson was requested to write to the Zoning Commission and request that they make a study of this matter as well as the Transient Commercial zoning in general, the existing building code for fire limit zones and the possible creation of additional fire limit zones. City Attorney Morse advise that he had sent in the old occupational licenses ordinance to the firm codifying city '='-:-'~--:-;-'':::--''=- and charters and that as this was the major hold up the work should be completed before too long. ~ -.,., 0lerk Johnson read a letter from E. Earle and John P. DeLoe, Architects, offering their services with regards to the construc- tion of a new fire and police station. Clerk Johnson was re- quested to advise the architects that the city did not contemplate such construction at this time but that their letter would be placed on file for future reference. Clerk Johnson read a letter from A. P. and R. K. Michaels, Consulting Engineers, requesting the opportunity to meet with the Council to discuss their qualifications. Clerk Johnson was requested to advise this firm that the Council would be happy to have them meet with them at the next Council meeting. Clerk Johnson read a letter from B. J. Van Ingen Company, Fiscal Agents, pertaining to the issuing and sale of revenue certificates for the City of Clermont. At the suggestion of City Attorney Morse motion was made by Mr. Turville, seconded by Mr. Pool and carried that the Clerk write to Central Florida Utilities, Inc. and request a copy of the firm's brochure. Chairman Bishop arrived at this time. It appeared to be the consensus that the necessary financing for the proposed water system could be handled locally. Clerk Johnson read a letter from C. Welborn Daniels wherein Mr. Daniels advised that he would contact the State Road Department as soon as possible in an effort to alleviate some of the hazardous traffic conditions existing on Highway 50 through Clermont. Motion was made by Mr. Turville, seconded by Mr. Pool and carried that due to the existing emergency that the rule of soliciting bids be waived and that Fishback Irrigation Company of Orlando be awarded an order for a motor and pumping equipment at' an approximate cost of $10,000. Motion was made by Mr. Pool, seconded by Mr. Turville, and carried that the Finance Officer be authorized to borrow $10,000 from the Equipment Replacement Fund at an interest rate of 3~ to cover the cost for immediate expenditure for capital outlay in the Water Department and that such amount would be repaid when the financial arrangements for the overall program are completed. Motion by Mr. York, seconded by Mr. Turville and carried that bills be paid. Mayor BonJorn requested an Executive Session. EXECUTIVE SESSION: Motion by Mr. York, seconded oy Mr. Turville, and carried that the Clerk be authorized to pay Mr. McCarthy a cash deposit of $300 for incidental expenses.
