A regular meeting of the City Council of the City of
Clermont was held in the office of the City Clerk on Tuesday,
April 4, 1961. The meeting was called to order at 7:30 P. M.
by Vice Chairman William Boyd with all council members present
with the exception of Mr. Bishop. Other officials present
were Mayor BonJorn, Clerk Johnson, Deputy Clerk Williams, City
Attorney Morse, Superintendent Sheldon, Building Inspector
Snyder and Chief Police Tyndal. Visitors present were Messr8~
Joe Duncan, F. B. Innis, Art Permenter, Jack Gaines, Harley
Beals, V. W. Brinkerhof and representatives of the local press
and Orlando Sentinel.
The minutes of the adjourned meeting held March 21, 1961
were read and approved.
Mr. Jack Gaines appeared before the Council to make oral
application for the position of Recreational Director during
the summer months. Mr. Gaines was advised that his application
would be given consideration.
Mr. Permenter and Mr. Duncan spoke to the Council relative
to the possibility of a sewerage system in the City of Clermont,
and stated that a committee appointed by the Chamber of Commerce
had done some ground work regarding this matter. Mr. Permenter
advised the Council that their reason for appearing before
them was that they wished to determine if their efforts had
the sanction of the Councilor if it was preferred that the
matter be dropped. Considerable discussion concerning this
matter followed and the consensus of the Council appeared to
be that there was a need for a sewerage system if it could be
determined to be feasible and if the necessary arrangements
for financing could be worked out. At the suggestion of Clerk
Johnson, motion was made by Mr. Turville, seconded by Mr. Pool,
and carried, that the preliminary engineering surveys and
feasibility reports previously made for the city pertaining to
a sewerage system be made available to Mr. Permenter and his
committee to assist them in their further study.
Building Inspector Snyder submitted his regular monthly
report which was accepted and ordered filed.
After some discussion regarding the matter, Clerk Johnson
was requested to issue a work order to Superintendent Sheldon
authorizing the sprigging of the parkway in front of Mr. Austin
Rinella's residence on Disston Avenue.
Chief Tyndal submitted his regular monthly report which
was accepted and ordered filed. Chief Tyndal reported that
the unsightly condition previously existing at the filling
station at the intersection of Minnehaha Avenue and Highway 27
had been considerably improved during the past ten days. Chief
Tyndal requested permission from the Council to allow him to
send his pa'tDo.lmen to a Police Training School in Eustis wi thin
the next two weeks. Clerk Johnson advised that this was a
budgeted item and motion was made by Mr. Turville, seconded
by Mr. Pool, and carried that Chief Tyndal's request be granted.
Mr. Pool, Chairman of the Parks Committee, gave a progress
report on the work being done at the City ball park on East
Avenue.

The matter of the completion of the boat ramp at the
Jaycee Beach was discussed and Clerk Johnson advised that approx-
imately $750 was available for this project. It was suggested
that Mayor BonJorn contact the Marine Corps Reserve of Orlando
in an effort to get some help from them on the project. Motion
was made by Mr. Turville, seconded by Mr. Pool, and carried,
that Mayor BonJorn be authorized to proceed with the completion
of the boat ramp at a material expenditure not to exceed $750.

Mr. Beals inquired if the Council had given consideration
to his previous request that Minneola Avenue be opened to East
Avenue. Mr. Beals was advised that the Streets Committee had
not made any recommendation regarding this matter to date.
A general discussion took place concerning the alcoholic
beverage ordinance being considered by the Council. Opinion
appeared to be divided as to whether or not restaurants should
be allowed to serve alcoholic beverages along with meals on
Sundays between the hours of 12 o'clock noon and 7 P. M. Further
study regarding this matter was agreed upon.
Council Chairman Bishop arrived at the meeting at this
time.
Councilman Turville stated that he had been approached
regarding the possibility of the land lying west of the Jaycee
Beach and North of Highway 561 being rezoned for commercial use.
The consensus was that this was a matter to be handled by the
Zoning Commission and only upon the request of the owner of the
property.
Mr. York, Chairman of the Street Lighting Committee, re-
ported that he had received a request for the installation of
street lights at West Lake Drive and Carroll Street and Carroll
and Short Streets; that he had made an inspection of the area
in question and that he recommended and moved that the street
lights be authorized. The motion was seconded by Mr. Pool,
and carried.
Clerk Johnson read a copy of a letter from Mrs. Dorothy Innis,
Secretary of the Home Owners Civic Improvement Association to
Billups Petroleum Corporation appealing to them that they take
the necessary steps to have the unsightly condition now existing
at their Spar Station located on U. S. Route 27 cleaned up as
soon as possible.

Clerk Johnson read a letter from Mr. Buddy Bumbalough making
application for the position of life guard at the Jaycee Beach.

Clerk Johnson read a:pet:i:"tion from interested property owners
agreeing to furnish the necessary street right-of-way and for
and requesting the paving of Lake Shore Drive westwards from
Twelfth Street for a distance of 1200 to 1500 feet. Clerk
Johnson called the Council's attention to the fact that they
would not be able to take any definite action regarding this matter
until the necessary right-of-way had been deeded to the city.
Motion was made by Mr. Turville, seconded by Mr. Pool, and
carried, that the City make surveys to determine the location
of the proposed street and that the necessary deeds be prepared
for the transfer of the right-of-way from the interested property
owners to the City and that the cost of the surveys and the
preparation of the deeds be included in the overall cost of the
street.

Mayor BonJorn was requested to contact Mr. Joe Mims of
the State Road Department in an effort to have them designate
that area in front of Kidder's Restaurant as a "no parking"
zone.
A discussion took place with regards to the matter of
traffic lights along Highway 50 through Clermont and the inability
of the city to have such lights installed. Motion was made by
Mr. TUFville, seconded by Mr. Pool, and carried, that Clerk
Johnson write to the Honorable C. welborn Daniel and request
that he lend his efforts towards getting permission to install
such traffic lights.

Upon the recommendation of Clerk Johnson, motion was made
by Mr. Turville, seconded by Mr. York, and carried, that the
following Personal Property Tax accounts be cancelled due to
their having been assessed through error: #1999 - $3.70; #22~6
~ .93; 2312 - $3.70; #2325 - $3.70; and #2341- $9.25. At the
further recommendation of Clerk Johnson, motion was made by Mr.
Turville, seconded by Mr. York, and carried that assessments on
Household Personal Property be eliminated from the 1961 tax roll.
At the recommendation of Clerk Johnson, motion was made by Mr.
Turville, seconded by Mr. Boyd and carried, that the Occupational
License Ordinance be amended to eliminate an occupational license
tax on apartment houses having less than three apartments.
Clerk Johnson advised the Council that his office probably
had more complaints regarding overgrown and unsightly vacant lots
than for any other reason and that in his opinion the existing
ordinance requiring property owners to keep vacant property
properly mowed and cleaned was unworkable and would never prove
satisfactory; that in view of this opinion he recommended that
the City clean such vacant lots twice yearly, or as often as
necessary, without expense to the property owners. Motion was
made by Mr. Turville, seconded by Mr. Pool and carried, that
the recommendation of Clerk Johnson pertaining to the cleaning
of vacant City property be accepted and that the Mayor be author-
ized to issue work orders for such cleaning whenever he deemed
necessary. It was also suggested that Mayor BonJorn proclaim
that the last two weeks in April be designated as "Clean-up"
weeks in Clermont.

Clerk Johnson reported to the Council that the amount budgeted
for street materials had already been over-expended and that if
they intended continuing with street repairs that it would be
necessary that some arrangements be made regarding the finances
for same. Clerk Johnson further reported that the City had
received approximately $2500 for the rental of City equipment
used in the construction of new streets which had not been in-
cluded in the anticipated revenue which the City would receive
for this fiscal year, and that he recommended that this amount
be used for street repairs and that the Street Department budget
be increased by that amount. Motion was made by Mr. Boyd, seconded
by Mr. Turville, and carried, that Clerk Johnson's recommendation
be accepted and that the $2400 in question be used for materials
f-or the repair of City streets and that the Street Department's
budgeted expenses be increased by that amount.
Clerk Johnson called to the Council's attention that there
was a vacany in the membership of the Zoning Board of Adjustments
and recommended that this vacancy be filled as soon as possible.
Motion was made by Mr. Boyd, seconded by Mr. Turville, and carried,
that Mr. Frank B. Innis be appointed to membership on the Board
of Zoning Adjustments to fill the unexpired term of Mr. James
J. Harris.
Clerk Johnson asked the Council for clarification as to who
was authorized to request that he issue work orders for city
operations. Some discussion took place regarding this matter
and it appeared to be the consensus that excepting in cases
of emergency or for general routine work that authorization
should come fro~ the Council at regular, adjourned or special

Clerk Johnson advised the Council that he had received a
bill from Mr. William Anderson in the amount of $356.00 for work
done at the ball park; that such work had not been authorized
by the Council and that he had not issued a purchase or work order
for same. Motion was made by Mr. Turville, seconded by Mr. Pool,
and carried, that Clerk Johnson be authorized to issue a work
order to Mr. Anderson and to pay the amount in question if the
work was satisfactory.
Clerk Johnson brought to the Council's attention the matter
of drives in Oakhill Cemetery Second Addition, as well as in the

old cemetery, and stated that there was approximately $900 in
the budget available for this project. A discussion regarding
the manner of construction of such drives took place and it was
decided that probably the best method of construction would be
of stablized clay with a gravel surface. Motion was made by
Mr. Turville, seconded by Mr. Pool, and carried, that the con-
struction of the drives as suggested by Clerk Johnson be
authorized at an expense not to exceed the amount available in
the budget.
Clerk Johnson read a letter from Mrs. Dorothy Koester
expressing her appreciation to all City officials for their
kindness during her recent bereavement.
A discussion took place concerning the canal under the
Lake Shore Drive bridge, near the O. H. Keene property. Chair-
man Bishop stated that it was necessary that the chanel be
increased in depth and Clerk Johnson was requested to make the
necessary arrangements to have the work done.
Motion by Mr. York, seconded by Mr. Boyd, and carried,
that bills be paid.
Chairman Bishop called the Council into an Executive Session
at this time. City Attorney Morse was instructed to prepare
an ordinance adopting the Southern Standard Building Code by
reference as th~ building code of the City of Clermont.
Clerk Johnson was requested to issue a work order for the
connection of the well located at the intersection of Highlands
Avenue and Disston Avenue with the City water supply as soon
as samples had been submitted and found to be free of bacteria.
Upon the recommendation of City Attorney Morse, motion was
made by Mr. Turville, seconded by Mr. Pool, and carried, that
City Attorney Morse be authorized to publish immediately the
City's intention to apply for an amendment to Section 72 of
Chapter 8296 of its Charter, whereby it would be necessary
that the City be notified 30 days in advance of any tortious
action being brought against the City.
Motion by Mr. Boyd, seconded by Mr. York, and carried,
that meeting be adjourned.
