Motion by Mr. York, seconded by Mr. Bishop and carried, that
the recommendations of the Zoning Commission be accepted and that
the City Attorney proceed with the necessary advertising for a
Public Hearing on hhe matter. The motion carried with Mr. Christ-
enson abstaining inasmuch as he is a member of the Zoning Commission
Mr. Christenson reported that he had received numerous com-
plaints relative to the construction of a "Green Housell on the
Hulett property on 5th Street. Other members of the Council stated
that they had also received complaints regarding the matter. When
asked about the matter, Inspector Snyder stated that he had refused
them a permit when they applied, but had later been advised by City
Attorney Morse that a permit could not be withheld and that when
Mro Hulett applied the second time that 11r.Hulett had stated that
the total cost of the structure would not exceed thirty-five dollars
and he had therefore been advised that a building permit was not
necessary. No definite action was taken regarding the matter, but
it was ggreed that Council members and the Building Inspector would
make an investigation.
The matter of the old building, which had been knocked over by
a truck, located on the North side of Highvray "50" in the three
hundred block, was discussed. The Council were in agreement that
this building should be removed without further delay. City Attn'y.
Morse reported that he had obtained bids for its removal and con-
tacted the owner and that she was in agreement with the removal of
the building.
Police Chief Tyndal was directed to investigate the reported
location of a house trailer at the cornen of Fifth Street and Hv~.
"50", and, to collect a license fee for the operation of a laundary
at the same location.
Motion was made by Mr. York, seconded by Mr. Bishop and
carried~ that the City Tax Assessor be authorized to waive the
license fee to the American Legion for the operation of a carnival
at the corner of 12th Street and Minneola Avenue.
t~. York stated that he was of the opinion that the City
Council should come to some agreement regarding circuses and carni-
vals operating in zones where they are prohibited, and, that if it
was the decision of the Council that such Zoning Ordinances be en-
forced, that the American Legion should be notified of such action
in order that the matter will not come up again in the future. It
was decided to table the matter.
A replat of vtnona Bay Shores subdivision was presented to the
Council for their consideration. The plat was given tentative app-
