REGULAR MEETING

Regular meeting of the City Council of the City of
Clermont was held in the office of the City Clerk on Tuesday -
October 4, 1960. The meeting was called to order at 7:30 P.M.
by Council Chairman, G.Y.Middleton with the following Council
members present: York, Christenson and Roe. Absent: Bishop.
Other officials present were Mayor BonJorn, ~lerk Johnson, Deputy
Clerk Williams, City Attorney Morse, Sup't. Sheldon, Inspector
Snyder and Chief of Police Tyndal. Representatives of the local
Press and the Orlando Sentinel were also present.
Mayor BonJorn reported to the Council that Patrolman Fullwood
who had recently been seriously ill was considerably improved and
expected to be back at work within a week or ten days.
Chief Tyndal submitted his regular monthly Police report
which was accepted and ordered filed.
Inspector Snyder submitted his regular monthly building
report which was accepted and ordered filed.
~~. Roe, Chairman of the water Committee reported on the
progress of the water works, and stated that Mr. John Boyett had
agreed to sell to the City the necessary property upon which to
locate their proposed reservoir, but, that he desired to enter into
a contract with the City with regards keeping the ~ounds in line
with a residential area.
Clerk Johnson submitted a letter-agreement from the ACL
Railroad for the Council's approval, giving the City permission
to construct a temporary line across the railroad's r/w forfue
purpose of draining water from West Lake. The Council accepted
such agreement and signed same.
Clerk Johnson read a letter from the Building Committee of
the First Methodist Church wherein they requested permission from
the City to remove the existing curb and gutter on the south side
of Juniata street between 7th and 8th streets and replace it with
a poured concrete valley gutter. Mstion was made by Mr. Roe, seconded
by Mr. York and carried,that such request be granted.
Clerk Johnson read a letter from Mr. R.L.Wadsworth, Captain
Retired of the San Francisco Police Dep't. wherein he 'commended the
splendid assistance given him by Mrs. Koester, Police Dep't. R~dio
Operator, while in this City.
Clerk Johnson read a letter from Lawrence Campbell wherein
he requested permission to operate a skating rink in the building
located at 650 Bloxam Avenue, which is in an R2 Zone. Mr. Christenson
Chairman of the Parks Committee was requested to investigate the
matter further and report to the Council at their next meeting.
Clerk Johnson read a letter from Mrs. L.A.Phillips wherein
she urged the Council to give favorable consideration to allowing
the Lake Highlands Hotel to operate as a Nursing Home. Inasmuch as
a final decision had been handed down regarding this matter by the
Zoning Board of Appeals and the Council had no further say in the
matter, the letter was ordered filed.

Clerk Johnson read a letter from the Zoning Commission
whereby they submitted recommendations for certain changes in
Zoning.(See attached letter of description and drawings.) ConsiderabJ
discussion took place with regards the recommended zoning changes,
whereupon motion was made by Mr. Roe, seconded by Mr. Bishop and
carried, that the Council meet with the Zoning Commission at their
regular meeting on Wednesday - October 5, 1960, before taking any
legal action.
Mr. Bishop appeared ab the meeting at this time.
Clerk Johnson read a letter from City Attorney Morse to
Chairman Middleton,relative to Zoning.
Mr. Roe offered and moved that it be passed, an ORDINANCE
LEVYING AND IMPOSING UPON ALL INSURERS, NOW OR HEREAFTER ENGAGING
IN OR CARRYING ON THE BUSINESS OF INSURING PROPERTY AGAINST LOSS OR
DAMAGE BY FIRE AND TORNADO AND EXCISE OR LICENSE TAX IN ADDITION TO
ANY TAX NOW LEVIED, OF 1% OF THE GROSS A1'10UNT OF RECEIPTS OF ALL
PREMIUMS COLLECTED ON FIRE AND TORNADO INSURANCE POLICIES INSURING
PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF CLERMONT; AND
PROVIDING WHEN SAID TAX SHALL BE DUE AND PAYABLE; AND PROVIDING
EFFECTIVE DATE.. The motion was seconded by Mr. Bishop and unanimousl~
carri~d. Mr. Roe then moved that the ORDINANCE be read a second time
by title only. The motion was seconded by Mr. Bishop and unanimously
carried. After the second reading of the ORDINANCE by title only,
Mr. Christenson ~ved that the rules be further waived and that the
ORDINANCE be placed upon its passage. The motion was seconded by
Mr. York and unanimously carried. Thereupon the ORDINACE was read
for a third time and upon roll call vote the Ayes were: Bishop'~/~L[ro
York, Christenson and Roe. Nayes: None Absent: None. The ORDINANCE
passed, title as stated and was ordered recorded in the Ordinance
Book and numbered 190. A copy of the ORDINANCE in full appears
immediately following these minutes.
Motion was made by Mr. Bishop, seconde~ by Mr. York and
carried, that the bills be paid.
Motion was made by Mr. Roe, seconded by Mr. Bishop and carried

AN ORDINANCE LEVYING AND IMPOSING UPON ALL INSURERS,
NOW OR HEREAFTER ENGAGING IN OR CARRYING ON THE
BUSINESS OF INSURING PROPERTY AGAINST LOSS OR. DAMAGE
BY FlRE AND TORNAOO AND EXCISE OR LICENSE TAX IN
ADDITION TO ANY TAX NOW LEVIED, OF 1% OF THE GROSS
AMOUNT OF RBCBIPfS OF ALL PREMIUMS COLLECTED ON
FIRE AND TORNAOO INSURANCE POLICIES lNSURINGPROPERTY
WITHIN THE CORPORATE LIMITS OF WE CITY OF CLERMONT;
AND PROVIDING WHEN SAID TAX SHALL BE DUE AND PAYABLE;
AND PROVIDING EFFECTIVE DATE.
WHEREAS, the Legis18ture ot the State of Florida, by Chapter 175,
Florida Statutes, created a Special Fund known as the "Firemen's Relief
and Pension Fundt! and thereby authorized municipalities falling within
the purview of said act, to levy an additional tax upon certain insurance
com.panies or other insurers against loss by fire and tornado designated
in said act, the said proceeds from said tax to be used in partial support
of said fund; and,
WHEREAS, It is the desire of the City of Clermont to put into full
force and effect the provisions of said Chapter 175 in said municipality;
now, therefore,
BE IT ORDAINED AND ESTABUSHED BY THE CITY COUNCIL OF
THE CITY OF CLERMONT, LAKE COUNTY t FLORIDA:
SECTION 1:
That there is hereby assessed, imposed and levied
on every insurance company, corporation or other insurer now engaging
in or carrying on, or which shall hereafter engage in or carryon the busi-
ness of insuring against loss or damage by fire or tornado. as shown by
the records of the Insurance Commissioners of the State of Florida, an
excise or license tax in addition to any license tax or excise tax now levied
by the City of Clermont, which said tax shall be in the amount of 1% of the
gross amount of receipts of premiums from policyholders on all premiums
collected on fire and tornado insurance policies covering property within
the corporate limits of the City of Clermont.
SECTION 11:
That the license or excise tax herein levied shall
be due and payable annually on the first day of March of each year hereafter.

SECTION Ill: This Ordinance shall take effect immediately upon
its passage.

Mr. Bishop reported to the Council that the proprietor of the
Burger Kastle, located at 811 Highway # 50, was burning trash in outside
incinerators late at night, which is in violation of City Ordinances.
Chief Tyndal was requested to look into the matter.
Motion was made by Mr. Christenson, seconded by Mr. Bishop and
