11-03-1959 Regular Meeting REGULAR MEETING: -e A.regular meeting of the City Council of the City of Clermont was held in the office of the City Clerk on Tuesday - November 3, 1959. Chairman of the Council, Charles B. Roe, called to the attention of the Council that as the Mayor of the City of Clermont would be absent for an indefinite time, that under the Charter it was now necessary for him to serve as President of the Council and it was necessary that the Council elect a President Pro Tem. Thereupon Mr. Oswalt was duly nominated, and upon nominations being ~iliosed, the Clerk was directed to cast an unanimous ballot for Mr. Oswalt, President Pro-Tem. t~. Oswalt then took charge of the meeting and called for the reading of the minutes of the meeting held October 20, 1959. The minutes of the meeting held October 20, 1959 were read and approved. Those being present at the meeting were: All members of the Council - Clerk Johnson - Deputy Clerk Williams - Sup't. Sheldon - Inspector Snyder - Chief of Police Tyndal - City Attn'y. Morse - Patrolman Fullwood - Messrs. Cole~rove and Sadler, representatives of the Florida Power Corp., and Messrs. Dean and Thomas. A representative of the local Press was also present. Mr. Albert Nolze again called to the Council's attention the unfavorable drain.age"-lcondi tion which exists on J;>rince Edward Street. Chr. Pro-Tem Oswalt advised ~~. Nolze that the City's street equipment had been tied up in the construc- tion of Disston Avenue, but, assured Mr. Nolze that this unfavorable drainage situation would be taken care of soon as possible. ~~. Forrest Colegrove spoke to the Council and submitted a plan and figures, with regards a proposed 'whiteway' on Highway # 27. Considerable discussion followed and it was the concensus of opinion that the matter be deferred at the pre- sent time. Messrs. Dean and Thomas appeared before the Council with regards to application for an Occupational License for the operation of a dinette and amusement denter in that part of the Lincoln Park area now zoned R 2. Clerk Johnson read a petition from property owners in that area advising that they had no objection to the operation of such business. Chr. Pro-Tem Oswalt advised Messrs. Dean and Thomas that this matter was in the hands of the Zoning Commission, and, that they,in all probability, would make recommendations in the near future. City Inspector Snyder submitted his regular monthly report which was ac~epted and ordered filed. Sup't. Sheldon reported that work was progressing on Disston Avenue, and, back door garbage pick-up had been started on Monday and was progressing with but little trouble. The Laws and Auditing~Committee was requested to make a study of the present Garbage Ordinance and to have City Attn'y. Morse to prepare an amendment to such ~rdinance Whereby the placing of garbage cans at street curbs would be prohibited. Mr. Boyd, Chr. of the Water Committee, recommended that additional water pipes, fittings and mains, be ordered as soon as possible. ~~. Boyd was requested to cooperate with Mr. Sheldon in preparing a list of such water requirements and turn same over to the purchasing agent in order that he might invite bids. Mr. Christenson, Chr. of the Parks Committee, recommended that the rest room doors at the ball park be padlocked until needed, and, that a floor runner be installed at the Community Bldg. in Kehler Park. Clerk Johnson stated that he would take care of these two matters. Chr. Pro-Tem Oswalt, a member of the Parks Committee, reported that the survey of the new .. . cemetery addition would be completed in a few days. Sup't. Sheldon was directed to have the area mowed in order to expedite the work of the surveyor. ~~. Christenson stated he had received several com- plaints from local merchants with regards to their having been notified to keep wares off the sidewalks in front of their buildings. City Attn'y. Morse advised Mr. Christenson that an Ordinance restricting the placing of wares on side- walks had been in effect for many years, but had not been enforced. Chief of Police Tyndal submitted his regular monthly Police report which was accepted and ordered filed. Chief Tyndal introduced Mr. Charles E. Lecroy, an applicant for position on the Police Department. Mr. Lecroy was advised that his application would be considered later on in the meeting. Sup't. Sheldon was directed to make the necessary re- pairs on the boat ramp and walkways at Jaycee Beach, as soon as possible. !1r. Oswalt, Chr. of the Streets Committee, gave a brief progress report on streets under construction, and a short discussion took place with regards paving of additional streets, Mr. Roe submitted a sample Ordinance and agreement per- taining to the City of Clermont and the Lake Apopka Gas Dis- trict. Clerk Johnson read a letter from Mrs. Mary Taylor wherein she joined with lir. William Gross in a request, that, Division Street lying on the North boundary line of the City of Clermont and a part of Bloxam Avenue in the northern part of Clermont, be permanently closed. Motion by Mr. Boyd, seconded by ~~. Roe and carried, that any authorization pertaining to closing of streets in question, be ~eferred. Clerk Johnson was directed to open bids for the construc- tion of rest rooms at the City Barn. In opening of the bids, Mr. Middleton objected to the fact that plumbers were being invited to submit bids on a project that should be bid by a general contractor. After some discussion of the matter, motion was made by Mr. Boyd, seconded by Mr. Middleton and carried, that all bids be rejected and that invitations to bid be submitted to general contractors. Cler~ Johnson read letters from Messrs. Camp and Weber submitting bids on 8 fire extinguishers at $15.75 and $14.95 ea., respectively. Motion by Mr. Roe, seconded by !1r. Middleton and carried, that the bid be awarded to Mr. Camp inasmuch as he was a local tax payer and a local licensed agent in the City of Clermont. Clerk Johnson opened bids on a water pipe trenching machine, which were as follows: Prescott Motor Sales of Leesburg $1.486.00 Diesel Equip. Co. of Orlando $1,608.75 Motion by r~. Boyd, seconded by Mr. Roe and carried, that the low bid be accepted and a trenching machine be ordered from Prescott Motor Sales of Leesburg at a price of $1,486.00. Clerk Johnson opened bids on price of approximately 2400 tons of limerock from Qualtiy Lime Products, Inc. of Ocala at $2.10 per ton - delivered Clermont, and, from C~rroll Contracting Company,Inc. at $3.00 per cubic yard - delivered Clermont. Motion by ~~. Middleton, seconded by Mr. Christenson and carried, that bid from Qualtiy Lime Products, Inc. be accepted. Clerk Johnson read a letter from Mr. C.C.Holloway pro- testing the fact he had been requested to obtain a local Nurseryman's Occupational License. Clerk Johnson read a letter from Mr. Ritchey Green of the State Road Department, expressing thanks for the kind letter which he had received from the Council. Motion by r~. Roe, seconded by !1r. Boyd and carried, that Tax Collector Johnson be authorized to adjust any tax statements whereby widows and disability exemptions \vuuld be allowed provided that a tax statement from Lake County allowing such exemptions is produced as evidence. ~ . " Mr. Roe recommended and moved, that the steam heating system at the old city hall be converted to~hot water system at an approximate cost of $100.00. The motion was seconded by Mr. Christenson and carried. ~~. Roe was re- quested to contact Hr. M.J.Barnes regarding this matter. Motion was made by Mr. Christenson, seconded by Hr. Middleton and carried, that Clerk Johnson be authorized to dispose of the old city owned building located on Lot 19, Block 80, without compensation to the City, provided it be removed immediately. Mr. Roe offered and moved it be passed, AN ORDINANCE FOREVER ABANDONING, ABOLISHING, CLOSING AND VACATING FRACT- IONAL HIGHLAND AVENUE LYING EAST OF TENTH (lOth) STREET AND IrJEST OF WEST AVENUE, ACCORDING TO THE OFFICIAL f'1AP OF THE CITY OF CLERI10NT: PROVIDING THAT ALL LANDS LYING \,lITHIN BOUNDARIES OF SAID FRACTIONAL HIGHLAND AVENUE SHALL REVERT IN FEE SII'TPLE AND BECOME THE PROPERTY OF THE OWNERS IN EQUAL SHARES OWNING THE LANDS ADJO!NING AND ABUTTING SAID FRACTIONAL HIGHLAND AVENUE: PROVIDING FOR OTHER ~lliTTERS RELATING THERETO AND FOR EFFECTIVE DATE HEREOF., The motion was seconded by Mr. Christenson and unanimously carried. Mr. Hiddleton then moved that the Ordinance be read a second time by title only. The motion was seconded by Mr. Boyd and unanimously carried. After the second reading of the Ordinance by title only, Mr. Christenson moved that the rules be waived and the Ordinance passed upon its passage. The motion was seconded by Mr. Roe and unanimously carried. Thereupon the Ordinance was read in full the third time and upon roll call vote the Ayes: were: Roe - Middleton - Boyd - Christenson; Nayes: None Absent: None. Thereupon the Ordinance was passed, title as stated, and ordered recorded in the Ordinance Book and numbered 183. A copy of the Ordinance in full appears immediately following these minutes. Chairman Pro-Tem Oswalt called for an executive session at this time. o~ The application~Mr. Lecroy for a position on the Police Department was considered at this time and it was decided to postpone hiring of an additional patrolman until around December 1, 1959. Roe, seconded by Mr. Christenson and carried, that salary increases provided for in the 1959- 1960 budget become effective November 1, 1959 - (POlice Chief - $400.00 per month Police Patrolman (after 6 mots. service) $350.00 per mo. .. Fire Chief - $800.00 per year City Sup't. - $350.00 per month City Inspector - $250.00 per month Deputy Clerk - $65.00 per week City Clerk - $500.00 per month Municipal Judge - $75.00 per month) Clerk Johnson was authorized to tentatively appoint clerks and inspectors to serve at the general election for the City of Clermont to be held on December 8, 1959.
